Pond drained in Haleigh investigation
But sheriff mum on what's being sought; family told nothing.

As draining of a Putnam County pond continued Saturday as part of the continuing search for Haleigh Cummings, family members of the missing 6-year-old said they had not been told of any finds.

"I saw them out there with the heavy equipment, the pumps running, and they made me leave," said Annette Sykes, whose grandson Ronald Cummings is Haleigh's father.

She said her grandson and his wife, Misty Croslin Cummings, were with her at home in Welaka in southern Putnam County Saturday and had not been contacted by authorities.

Saturday, they said divers were looking for possible evidence and that the pond, described by neighbors as 2 to 3 acres, was being drained to shrink the area for them.

The St. Johns County and Clay County sheriff's offices are assisting in the search.

St. Johns Sheriff David Shoar said his agency was called mid-week and asked for help from their special-operations team that includes divers and the air unit.

To improve access to the pond in the rural area off Stokes Landing Road, an access road was bulldozed into the woods off Florida 19. Neighbors said the pond is popular for fishing and accessible on a pair of narrow dirt roads. It is known locally as the L-Shaped Pond.

The Putnam County Sheriff's Office released the information Saturday in response to a "widespread false rumor of Haleigh being found." Internet reports had suggested the girl's body was discovered.

Divers are searching the pond in response to a tip that physical evidence in the case was located there, according to the sheriff's office.

To assist them, the pond level was lowered to reduce the search area.

The sheriff's office declined to provide details on the possible evidence.

The tip was one of more than 4,000 received in the case and not the result of recent interviews with Hank Thomas Croslin Jr. and Kristina Prevatt, according to the sheriff's office.

Staubs reported it to the Putnam County Sheriff's Department but nothing was ever done. Investigators say they finished draining and searching a Putnam County pond Saturday. Maj. Gary Bowling with the Putnam County Sheriff's Office tells Channel 4 that crews found no evidence in relation to the search for six-year-old Haleigh Cummings.

Area residents said that while the pond is a 35-minute drive from the mobile home where Haleigh was last seen, it's not that far from water access across the river from Satsuma.

"It's a place back in here in the ponds that (are) further on down, where they go to have their fun in the mud holes, but very few people come back in here on the north end of the Mondex," said Putnam County resident Ronald Charles Ussery.

Locals said it wouldn't be a shock if Haleigh's body was found in the area.

"I wouldn't be surprised, because there are so many rumors that she's out here," said Putnam County resident Brooke Owens. "We've been hearing so much, so I wouldn't be surprised."

Divers from the PCSO, St. Johns County Sheriff's Office and Clay County Sheriff's Office conducted underwater searches in the area. In an attempt to assist the divers, the decision was made to lower the water level in the pond to reduce the search area, Greenwood said.

It took some time for the pumps to work and the water to recede, but it eventually drained, helping searchers look for evidence and possibly find out what happened to Haleigh.

The search for physical evidence through Sunday night, as the last person to see the Haleigh was brought into the Putnam County Sheriff's Office. WESH 2 News has learned that Misty Croslin, the wife of the child's biological father, was picked up by investigators, brought to the sheriff's office and released hours later.

Work continued for the second day at a 3 acre pond deep in the woods south of Palatka.

The pond was completely drained as the Putnam County Sheriff's Office searches for physical evidence connected to the Haleigh Cummings disappearance.

Investigators walked almost every inch of the mud looking for clues in the pond and surrounding area.

The Sheriff's Office is saying only that a tip led them to the pond and they are following up.

Dunham and Clifford Tenant live at one of the narrow dirt roads leading to the pond and say Sunday was probably the busiest day so far with trucks driving past and manpower going in.

"We heard a bunch of different rumors, a bunch of different things. We heard they were looking for a stolen car to begin with, we heard they found Haleigh, found a bunch of marijuana plants, but you don't really know what the truth is because no one will tell you," says Tenant.

If investigators found anything in the pond related the disappearance of Haleigh Cummings, they didn&#8217;t say.

A look at the completely drained pond revealed various items dumped and discarded over the years. Investigators did remove and bag several small items but declined to elaborate on what was taken. Sheriff&#8217;s officials have told family members that nothing was found in the pond.

Searchers came up empty and finished searching a Putnam County pond south of Palatka for evidence in the case of missing Haleigh Cummings.

"There is nothing in there," Maj. Gary Bowling of the Putnam County Sheriff's Office said this morning.

Bowling said much of the intense interest was driven by publicity the activity generated.

"We did a search last weekend and the weekend before," related to the case, he said. "We do searches all the time."

Bowling said a decision was made to drain the pond rather than just put divers in the water. He said the search had been planned.

"We realized it would be quicker to pump," he said.

He would not say what evidence investigators hoped to find. He said he expects the department to conduct another search next weekend.

One man said he supports what the sheriff's office did over the weekend in searching for Haleigh, but he said he's not happy with how they did it and how he said it left his property.

Tim Pritchard said he's upset with how the search was handled.

"The water's just like as if we had a hurricane," Pritchard said.

He lives near the pond and said his yard is now full of water.

Croslin tells cops: No one was home

Croslin told investigators he went to the house about 10 p.m. on Feb. 9 at the request of Ronald Cummings, Haleigh's father, who had been trying to reach Misty Croslin by telephone for two hours.

"He had tried more than 20 times, and those calls went unanswered," sheriff's Maj. Gary Bowling said Monday, citing telephone records obtained by authorities.

In addition, Bowling and other sheriff's officials have said Misty Cummings' statements to investigators have been inconsistent and that she has walked out of at least one interview.

On Monday, Misty Cummings' attorney disputed her brother's statements to investigators.

"Misty says she was there, so that's that," Robert Fields said. "He didn't go in, so there's no way he could have verified that she wasn't there."

Fields said there was no proof Hank Croslin Jr. went to the house that night.

"He might just be telling investigators what they want to hear," Fields said. "He might not even remember that night. There's so many problems with that it's almost countless."

Hank "Tommy" Croslin Jr. told detectives Thursday that he was called by Haleigh's father Ronald Cummings to find 17-year-old Misty Croslin and went to the Satsuma mobile home about 9:45 p.m. Feb. 9 to see her.

"He told us he banged on the door," said Maj. Gary Bowling of the Putnam County Sheriff's Office. "He said it was dark and no lights were on."

Teresa Neves, who is Ronald Cummings' mother, said her son told her he spoke with Hank Croslin that night but did not tell him to go to the mobile home.

Bowling said detectives talked with Misty over the weekend but would not say what was discussed. He said investigators are attempting to corroborate what Croslin said.

"If he's telling the truth it means a lot," Bowling said. "We took it for what it is worth."

Robert Fields, Misty Cummings attorney, said she maintains that she was home.

"She told me yesterday she was definitely there," he said this morning.

He said his client may have been asleep and that the time Hank Croslin said he was there may be wrong.

"Trying to nail a time line down is one of those greasy pig issues," he said.

What she&#8217;s told us is a farce&#8230;and the idea that she was doing what she says she was doing and how she was doing it is just not believable&#8230;its totally unbelievable in fact, said Major Gary Bowling of the Putnam County Sheriffs Office .

We believe that releasing some of the information we&#8217;ve found out advances the investigation. And particularly the way that we think this will advance it is that Misty&#8217;s family now knows about this information that I&#8217;m telling you now about Hank. We hope that the family or maybe Misty by her own conscience, if there is a discrepancy, that if she was indeed not home or she wants to explain why Hank banged on the door, with no response we want to hear Misty&#8217;s side of that, said Major Bowling.

Major Bowling went on to say that on the Saturday following the interview with Hank Jr., Misty voluntarily came into the Sheriffs Office for questioning. But, he says she did not talk discuss Hank Jr.s interview.

Action News spoke with Misty&#8217;s lawyer on Tuesday. Robert Fields tells us Misty is out of town and will be for the next few days. He says Misty is sticking to her story that she was home the night Haleigh disappeared. He also says he believes the story Hank Jr. is telling deputies is not true.

Fields says as soon as the Sheriffs Office contacts him to do a formal interview with Misty, he will be glad to consider it.


We&#8217;ve said for some time now, quite unapologetically, that we think that Misty has some information that she needs to tell us, and its information like this just like this that she needs to clarify so we can understand better what she was doing that evening. If Misty, who is represented by attorney Robert Fields, if they want to come down here, we would love to ask her some questions specifically and narrowly about that evening, said Major Bowling.

Major Bowling also talked about Misty&#8217;s cell phone. Action News asked him if he could use GPS technology to track down exactly where Misty was the night Haleigh disappeared. Major Bowling wouldn&#8217;t go into details, but says they are investigating those facts.

There are some things we can do with electronics, and there were some problems with the electronics&#8230;that&#8217;s about as far as I can go into that&#8230;there&#8217;s some things were still working on trying to get cleared up in regards to electronic intelligence, said Major Bowling.

Action News asked the Putnam County Sheriffs Office about possible charges it might file against Misty if it turns out that she was lying about where she was the night Haleigh disappeared.

We haven&#8217;t arrived at a place that will allow us to articulate probable cause for arrest yet&#8230;the issue is that---we have a lot of little things, but really coming to the point where we can in good faith go to a judge and seek a warrant or simply make a probably cause arrest, were simply not there, said Major Bowling.

Ryan said that phone records show that Ronald Cummings made 20 attempts to reach Misty during the evening of Feb. 9. Hank Croslin, who lived down the street, told investigators that Cummings asked him to check on Misty, Haleigh and Cummings' 3-year-old son, Ronald Cummings Jr., who Cummings believed were all at the mobile home where they lived as a family.

Hank Croslin told investigators that when he arrived at the home at about 9:45 p.m. there were no lights on inside and no one answered the door when he banged on it.

"What Hank Croslin told us is contrary to what Misty told us," Ryan said.

Misty previously told investigators that she put the children to bed and was doing housework before she went to bed sometime around 10 p.m.
