Alexie, 24, is due in court Wednesday on felony murder and first-degree child abuse charges... Steven Kaplan, Alexie’s court-appointed attorney, said Tuesday he believes his client is competent to stand trial and assist in her defense. Kaplan said he will not request she undergo a competency exam.

But whether she bears criminal responsibility is a separate issue that will be addressed later in the case, Kaplan added. After meeting with Alexie, Kaplan said he’s confident that while the baby may have died because it was neglected, his client did not knowingly harm the child.

Alexie, Kaplan said, suffers from “severe, chronic depression,” possessed a “a dearth of parenting skills” and lacked strong family support. “We expect the evidence to show she cared for the child as best she could,” Kaplan said.

The dead baby found by employees of a Roseville Recycling center Jan. 14 remains at the Macomb County morgue awaiting burial. It could be a while. A representative for the Macomb County Medical Examiner's Office said the autopsy is still pending and can take up to 12 weeks from receipt of the body.

According to Kaul Funeral Homes, which is donating burial services, no timeline has been set for receipt of the body and they are awaiting the completion of DNA tests...

Alexie's attorney, Steven Kaplan... said in court Thursday his client is waiving any burial rights she might have as a mother.

Four prosecution witnesses were enough to establish probable cause for Alexie to be bound over on both felony murder and first-degree child abuse charges. Alexie admitted the child was hers, but said that she did not leave the boy in a recycling container...

Prosecutors contend that Alexie hid her pregnancy from everyone out of embarrassment. Macomb County Assistant Prosecutor Bill Cataldo spoke about Alexie’s first-degree murder charge. “Slow killing, fast killing — what’s the difference? Killing is killing, whether it’s by gunshot, by knife, by strangulation, by burning, by leaving the child exposed to the elements,” Cataldo said.

“No food, no water, no clothing, no warmth, no blanket, no protection against the elements — this child had no chance,” Cataldo said.... “That child was 15 feet from a door that would have led that child to warmth.”

The newborn's 24-year-old mother, now charged with first-degree murder, appeared in Macomb County Circuit Court for an arraignment hearing Monday.

She pleaded not guilty and her attorney, Steven Kaplan, requested a criminal responsibility analysis for his client. The Michigan Center for Forensic Psychiatry could determine that Alexie was temporarily insane at the time of her son's death. She's already been ruled competent to stand trial.

The test is expected to be completed in about 45 days and a review date was set for 8:30 a.m. April 28.

According to Roseville Police Chief James Berlin, the body of baby boy Henry Alexander Macomb will lie in state from 6 p.m. to 9 p.m. Tuesday at Kaul Funeral Home, located at 27830 Gratiot in Roseville.

Although final plans for interment have yet to be made, the funeral service will take place Wednesday at Resurrection Cemetery in Clinton Township.

“Anyone who wishes to pay their respects and show this child the love he did not receive in life is welcome,” Berlin said.

For weeks after the autopsy, the body remained unclaimed by any other relatives entitled by law to have custody of the body and have it sent to a funeral home. Police say they still do not know the identity of the father of the boy. “Some were willing, but didn’t have any resources,” Berlin said. ‘No one came forward to take care of this.”

A public administrator was appointed in Macomb County Probate Court and this week proceeded with the legal release of the body.

Resurrection Cemetery is donating the plot for the grave. Kaul Funeral Home is donating the casket and providing its services at no cost. Meantime, an unidentified “business person” has offered to pay for the tombstone, Berlin said. The Clinton Township Firefighters Association, Rizzo Environmental Services, Henry Ford Macomb Hospital and McLaren Macomb hospital also will contribute to pay for it.

A woman accused of leaving her newborn baby for dead appeared at a legal proceeding Thursday in response to an attempt to terminate her parental rights...

The state DHS is seeking to extinguish her parental rights for three other children ages 4, 2, and 1. Prior to the incident involving Baby Henry, the other children were taken away from her and Jeffrey Blanton, the father of two of the children, and have been in foster care due to their parenting issues.

October 2015 - trial set for Jan. 12 -

A second, independent exam for criminal responsibility determined Angela Alexie did not lack criminal culpability, said Randy Rodnick, an attorney representing her during a competency hearing today in Macomb County Circuit Court.
A prior forensic exam at a state facility also showed she did not lack criminal culpability.
Her attorney, Steve Kaplan, previously said that if the second exam showed the same result, he would not have an insanity defense but would pursue the lesser charge of involuntary manslaughter.

‘I know he died ... hungry, cold,’ mom says of newborn

In the video shown Thursday, Alexie described in riveting detail giving birth alone in the garage and then chewing off the umbilical cord. She said she wrapped the baby in a T-shirt to keep him warm and went back and forth sporadically into the garage for three days to check on him. She said the baby cried when she checked on him and she tried to get him to breast-feed.

“Twenty times he cried. He wouldn’t feed,” Alexie said during the nearly two-hour long police questioning. “He wouldn’t latch.”

On the third day, Christmas Eve, she found him dead late at night. She said she put his lifeless body in a bag and took him to a shed outside her parents’ house.

An Eastpointe woman was convicted Friday of felony murder and first-degree child abuse in the death of her newborn son, whom she gave birth to in a cold garage and left there.

A jury of six men and six women took just over an hour to convict 25-year-old Angela Alexie. She faces up to life in prison without the possibility of parole on the murder conviction alone.

Alexie faces sentencing 8:30 a.m. April 19*
