Just beginning now.

Mr. Dillard doing voir-dire on the lady doctor who testified at the last hearing.

1. She only took one course in gastroenterology in Saudi Arabia
2. One course in pediatrics
3. Applied for medical license.
4. Not board certified in dermatology, psychology, etc.

I missed the last hearing, and I thought this doctor only reported the material she reviewed.

Objection: One doesn't need certified in something to be an expert. Judge warns this questioning could cause problems for Dillard.

Discussion of her methodology. Pros. objects, this is not the purpose of voir dire.

Overruled.

Asks if she only looked at medical records. No

So, it seems he is questioning her qualifications to testify. Judge rules he should keep to her qualifications.

Did she personally interview child, parents, Monique, FBI, Kids Talk... No to all but last. Objection/sustained.

Tons of objections. Lots of inappropriate questions as they don't go to her expertise.

What did she do to formulate her opinion? Reviewed medical records, as she continued objection sustained.

These are all questions as to her methodology.

Counsel, you are wasting the court's time! Judge!

How much was she paid? 0$
Kids Talk and DMC, Wayne State not paid anything.

How many times did she testify for pros. NONE

Testified 10-15 times in criminal cases. Convictions are irrelevant!

She has been subpoenaed for this and other cases.

Dillard asks if she's familiar with torture something from UN.

Judge: How much more are we doing of this.

Dillard: None

Mr. Smith? (Don't know the names). He asks a few questions about previous testimony. She is always qualified as an expert in child abuse pediatrics or other different titles in the same field.

Sorry, but this is a bit confusing to me since I don't know all the characters involved.

I'm wondering if I got the testifying for the prosecution wrong.

Sometimes she talks to the children, other times she relies on forensic interviews.

Now, prosecutor is up:

Asks for the definition/duties/responsibilities of a pediatrician.

I love this judge. She brooks no nonsense.

Defense attorneys want her to be a psychologist and she has extra training in psychology and psychiatry in order to sit for exam as pediatrician.

2 years of training in child abuse with varying topics of child abuse: physical, psychological, sex abuse, etc.

Finally pros. asks her to be qualified as pediatrician and child abuse pediatrician.

Defense asks to re-cross. DENIED Then, they want her to be excluded from testifying on many different types of information. Too many to list.

25 minutes and no testimony.

Judge certifies the witness in pediatrics and child abuse pediatrics.

The prosecutor is Ms. Goldfarb? I'll use that unless I can hear it better.

Prosecution:

Specialty is child abuse pediatrics.

Chief of child protrection team at Michigan Children's Hospital.

Evaluates medical records of children where child abuse is suspected.

They work in educating other doctors and publications.

So, we are now getting more of her bona-fides.

I'll pick up with information about this particular case.

Thank goodness this judge is quick to rule and keep attorneys in line.

Mr. Dillard is related to defendant, Monique Dillard-Bothuell, and is representing her. Smith is a court-appointed defense attorney representing Mr. Bothuell who was declared indigent in a prior hearing.

Charlie's Report included:

Summary of emergency note.
Summary of overnight admission.
Summary of social work evaluation.
Summary of interviews by FBI and KidsTalk

Looked at photographs. Based on medical records she was able to form a diagnoses.

She found an opinion of child abuse due to:

Medically: Charlie's disclosures of abuse, (more quacking by defense), victim of multiple forms... physical abuse, (objection arguing as to if Monique did it), said he was beaten by a pipe on buttocks and chest. Had some marks on his skin. One on chest and one on buttocks to show he was abused on more than one occasion. Phychological abuse (was told to stay in basement). Isolated in basement 10 days, homeschooled, threatened to be killed and nobody would know, nobody cares about him. Deprived of the main rights of children... proper food, water, use of bathroom. Held bowel movements for 10 days. She was scared, afraid, anxious, afraid Dad or Step-Mom would find him. Intimidation, isolation, deprivation = child torture.

Admitted by police under an alias for his own protection.

Charlie was weighed and measured (objection). He was dirty, had eczema, and anxious his parents would find him.

Initial photos taken.

Charlie described his living conditions for the previous 10 days.

Ms. Goldbar?

Charlie's physical appearance was consistent with what he had stated to the doctors, etc.

He sneaked up the stairs for food. He said Monique put him down there because he didn't do his work-out.

Charlie said he stayed in the basement because he was afraid of the adults.

LOL! I'm about 12 minutes behind!

#1A C-shaped white scar in middle of chest (from PVC pipe Dad hit him with)

#1B lower back/buttocks, dry skin on lower back, injury on buttocks. Linear scar (keloid scar) Some people get them, some don't. Is consistent w/Charlie's history... beaten there with a pipe. (Father)

Charlie was home-schooled for the past 2 years. It's a parental decision.

They were concerned about Charlie being isolated. In other cases of child torture, children were homeschooled.

Charlie did not report a school routine. He did report his "physical training" regimen.

The amount of exercise was excessive for a child his age.

(I'm thinking of the little girl who was run to death.

Now discussing earlier medical records concerning Charlie's growth and weight.

Charlie had lost about 25 pounds between 2009 and 2011 and had not gained weight for the past 2 years. Charlie was not obese prior.

Charlie was not given adequate nutrition for the amount of exercise he did.

He had no medical condition to explain the weight loss.

I'm leaving out mostly overruled objections. 2 defendants, 2 lawyers!

Body-mass index was over 85% at one point. They allow children to "grow into" their weight vs. putting on a diet.
