Just my 2 cents. These numbers can be somewhat misunderstood. Each year both of my boys, on paper, fall into what is considered obese per these percentages. My 14 year old is 6'1" and 208 lbs. He is nowhere near obese. He is off the charts for height and weight since he was a baby. He is a powerhouse football player. When I asked his pediatrician he said those percentages can be misleading and not to worry. My 8 year old is bigger than my first. My neighbor on the other hand has thin, small framed yet healthy boys who because of the stature are considered underweight. If I showed you pictures of either you'd think the report was nuts!

I absolutely agree with you. The defense was really messing around with percentiles there. There are at least 3 that I can think of: height, weight, and BMI. Graph a kid on all 3, and there is still no assurance as to whether a specific child fits into it all. Add in the fact that the experts keep changing the criteria!

IIRC, Charlie IV once mentioned on NG that he'd had a heart attack and didn't want to set his son up for one. That's how he explained the awful exercise regimen. He should have tried it himself!

^ In recent photos of young Charlie, the boy looks painfully thin - almost anorexic. If Mr. Bothuell wanted his son to be healthy and physically fit, he should have set an example by participating in physical activity with his son instead imposing the unreasonable exercise regimen on Charlie V. Outdoor activities like riding a bike, playing basketball with neighborhood kids or some organized athletic team would have benefited Charlie physically, socially, and emotionally. This boy was deprived of social contact with others his age. If he lived in a fantasy world at times, it's because he was deprived of normal and necessary social contacts outside his stringent home environment. :moo:

I also wonder about how much he was actually home schooled? Was step-mom there to help him with his work? I don't think so!

Charlie needed some serious intervention to turn him around. He didn't need a drill sergeant. He needed professional help and should have had socialization, fresh air, and a good, nutritious diet. Perhaps he needed medication to help him focus.

I've know children with ADD, ADHD, etc. They have an awful time early on in school. They can't sit still, they can't focus on their work, and they tend to get up and wander around the classroom and disrupt others. If he was so diagnosed, where were people working to help him back then?

My nephew was diagnosed with ADHD in kindergarten. His elementary school experience was terrible. Add to his diagnosis an anxiety disorder and he was a hot mess. My sister put him on Ritalin for a while and it helped him. Unfortunately, it also made him feel "not himself" and refused to take it. My brother-in-law bought him a used drum set. Nephew started drum lessons in school. His class was the first of the day, every day. He practiced in his spare time. It helped him tremendously to get the anxiety down and forced him to focus. Today, he is 36 years old, married, and still has a "garage band" that used to play heavy metal. They now do weddings and other events. His other occupation? He is a math professor at a major, Ivy League university.

I think judge does other cases first. Yesterday, she was done early and the lawyers came late, assuming they would have extra time. Yesterday, she warned them to be there at 9:00 so they would be ready to roll when she was finished with other cases.

Nope, the sound problem is from the feed!

Complaint from a LE that back of Officer Dillon's head was shown.

Officer Dillon continues her testimony from yesterday.

Cross by Dillard begins.

Member of FBI violent crime Taskforce.

Charlie went missing June 14, 2014, she was notified the 19th. Not present for interviews of parents. She went to home to assist w/search warrant. She didn't see it or the affidavit.

Arrived around 6-7 PM. She wasn't briefed by Lt. Cole(sp). She prepared a report. She was briefed by Cole when she arrived at the location.

She and Officer Penn(sp) arrived separately. There were others there and she names most of them.

Trooper was coming with cadaver dog.

Nobody was in the house when she arrived

Dog examined vehicle. Registered to Rent a Jalopy.

She observed clothing in a plastic bag in the trunk. Does not know if it was seized.

Vehicle search took about 20 minutes.

Did not observe dog made a hit. Later on, there was a hit but she doesn't remember where. She was there for moral support.

There was also a search warrant for a dog search of the house. This was not a search for evidence, just for canine search.

She went into the house. Dillon asked if she saw search warrant delivered - NO
There were already officers inside. She doesn't recall how many.

She didn't see any officers with the search warrant.

When she came in, the other officers were sitting at a table talking with Mr. Bothuell.

She saw no one searching the house.

She observed the dog in the house but didn't follow him around on his search.

Ms. Bothuell asked to go upstairs because she had 2 children up there. There were no officers or dog upstairs. They were sleeping in parents' bed.

She went downstairs with Ms. Bothuell. Officer can't remember asking Ms. B. a question when they came downstairs. Dillard asked several questions. Lawyer asks if she was read Miranda Rights -- No

Ms. B did go through the events of her day. Officer asked questions.

Asked her if Mr. B. physically hit the child, Ms. B. said he did.

Still no Miranda Rights

Ms. B called instrument a switch, then a pipe.

Asked how father disciplined son. Miranda Rights never read during this conversation. Pipe taken into evidence.

All events took place June 19.

Exhibit #3: Photograph of living room. Nothing dirty or disheveled. She doesn't know what day it was taken and she didn't take it.

Exhibit #2: Photo of kitchen. 6 or 7 pizza boxes on counter.

There was a prayer vigil outside. Those people arrived while she was there. They were family members.

Too many irrelevant questions being overruled! This is going to take all morning!

The kitchen is cluttered, can't see the dirt. Can't tell from photo if floor was dirty.

#5: Photo of Charlie's bedroom. Clothing on bed, computer, clothes hanging on door. Room messy and can't see any dirt in photo. She saw dirt on the floor (carpet) and walls. Stains all over the carpet.

Charlie had been missing for about 5 days at this point.

The parents were searching the neighborhood in the past. Dillon doesn't remember when she learned this.

Dillard: Was cleaning a priority?
Dillon: It wouldn't be for her.
