I've wondered how much education Clay had and noticed today that he only went to school through 10th grade. Personally, I think DC will have a better life in prison than he's had in the real world. :moo:

I agree. I thought I did recall reading that he dropped out of school. But, he clearly doesn't know enough to stay out of trouble. I wish they would provide an update on the other case with him for the assault this past summer. I'm assuming they're waiting until this trial is done? I don't really know.

ETA: Not much of a report. Clips of wrap-ups by Prosecutor and Defense attorneys. "Jury might get case this afternoon".

Monroe police have charged that Mr. Clay broke into a home in the city June 9 and assaulted a woman there, according to court records. If convicted, he could face life in prison for the sexual contact and 20 years for the home invasion.

I said the same thing the other day here .... prison life may be more than he has ever had. I wish we knew why he has no family to support him. No friends, parents, cousins, aunt or uncle .... no one. That part may be from his own making, but I find it tremendously disheartening.

Squirrel, thanks for your last post. very well stated and I do agree with your opinion. It seems to me that 1st degree is very possible.

I have been meaning to check to see if I remembered correctly.... I did. Our dear los2188 is the one who started our first thread here, way back in the beginning. May he RIP and remembered fondly. :heartluv:

Just checking in. Prosecutor did a pretty good job for our girl. Fingers crossed jury checks off all top charges. Send a big message to other men who feel entitled to steal, harm and discard any woman they happen upon. 🌹Chelsea.

I hope not :) Sadly, DC doesn't seem to have a support system. No family, friends, etc. for him to reach out to in times of need. He seems very isolated, and that's not good for anyone.

No worries, Xara .... you at the very least learned common sense and how to interact/communicate well with others. And you applied yourself to keep learning ... you learned well!

:waiting: Do you think they have come back, instructed the jurors, and sent them on to deliberate without anyone tweeting? Someone posted on MonroeNews FB that "it is up to the jury now" .

Attorneys probably met in Chambers with Judge to put finishing touches on jury instructions. I wouldn't be surprised if we have a verdict by day's end.

And we're back in Court. The Jury is read their instructions, Judge White defines evidence.

Judge tells jury they have 3 choices:
1st degree murder(premeditation or murder while committing felony), 2nd degree murder & manslaughter.

Judge White beginning instructions of law for jury after presentation of testimony, evidence completed.

Judge: Jury to consider only evidence presented in trial through testimony of sworn witnesses, exhibits admitted by the court.

Judge to jury: “It’s your job to decide what the facts of the case are.”

Judge: Verdict in a criminal case must be unanimous.

Judge: Jury must first consider 1st deg. murder, then 2nd deg. murder, then involuntary manslaughter in process of deciding which to select.

Judge describing difference between direct and circumstantial evidence, both can be used in determining verdict.

Judge: Do not decide case on which side presented more witnesses. (Prosecution called 31 by my count, defense called 2 - incl. Daniel Clay).

Judge: "Voluntary intoxication is not a defense" to any of the crimes Daniel Clay is charged with.

Judge now explaining all elements that must be proven with various types of murder.

Judge: “The prosecutor need not prove a motive for killing.” Motive does not prove premeditation and/or deliberation.

Judge now drawing alternates. Alternates will not participate in deliberations, but won't be excused until verdict is rendered by other 12.

Two women drawn as alternates. 12 members are 11 women, 1 man. Jury has exited to begin their deliberations.
