Judge Cahill doesn't seem to agree that basic testimony about observations from the car would incriminate him.

Hall's attorney firmly says it could.

Now prosecutor Matthew Frank says the jury can't hear Hall invoke his 5th A right in front of them.

Frank says other questioning that would occur during that testimony would lead to Hall having to invoke his 5th -- verbally -- in front of the jury.

Because he doesn't want to incriminate himself. Floyd's girlfriend has already said she believed some of the pills she and Floyd had in the past came from him.

BREAKING: Morries Hall's attorney, Adrienne Cousins, just said in open court that her client could possibly be charged with 3rd degree murder in the death of #GeorgeFloyd if he testifies about the events May 25, 2020

Attorney Eric Nelson said he would ask Hall about something he tossed out of his backpack, possibly giving #GeorgeFloyd a counterfeit $20 bill, possible use of drugs by Hall and GF and him fleeing to Texas and being apprehended by Texas Rangers

Adrienne Cousins, Morries Hall's lawyer, says Hall even answering the question about whether he was in Floyd's SUV says that would expose him to potential incrimination

Judge Cahill asks Cousins: You think Hall even answering a question about how Floyd appeared would incriminate him. She says yes. Cahill doesn't agree

Matthew Frank: Mr. Hall would be faced with question by question about what happened so blanket invocation is appropriate, he says. Judge Cahill says there isn't clear case law on this

Judge Cahill says the invocation of the 5th should be on a question by question basis. Frank says there is a legitimate link in the chain with Hall in Floyd's actions that day - basically Frank doesn't want Hall to testify

Cahill says "we aren't going to be done with this today." He's going to ask Nelson to draft questions and what he expects the answers to be. Then they can have another hearing on the matter after Hall reviews Q's with his lawyer.

The prosecution doesn't want Hall to testify because this potentially gives the defense a 3rd party to point the finger at in #GeorgeFloyd's death.

If it's determined that drugs played a role in GF's death and Hall supplied drugs to GF he could be looking at a serious crime. I'm not saying this is what happened, but at this point who knows what's going to happen.

Hearing outside the presence of the jury this morning - Maurice Hall - Floyd’s car passenger & drug dealer and supplier of drugs Floyd ingested that day. Doesn’t want to testify. Doesn’t want to plead the 5th repeatedly in front of the jury and the prosecution doesn’t want him to either. He fears a murder conviction for supplying

The cop can’t get a fair trial without Hall.

Hall previously described Floyd as nodded off and they were unable to rouse him before police arrived.
He said the drugs he gave Floyd were not meant to be taken at once and said Floyd claimed he would take them later

Car was searched twice & drugs found

Hall was seen on video removing items from backpack and tossing them

I just love that defense needs this witness to establish drugs caused GF’s death but the person they need to help them with that is the person who would be held responsible. Why should he help them? I think no matter what the judge rules, Hall will plead the 5th and take the contempt charge.

The pool (courtroom) reporter says before today's hearing began, Judge Cahill said hello to him from the bench and said "in at most a semi-joking way" he is well and will remain so so long as the media does not piss him off

Minneapolis police inspector Katie Blackwell will resume her testimony shortly.

She was the commander of police training in the city until the end of January this year. She now runs a city precinct.

She has contradicted the idea that Derek Chauvin, who was fired then arrested after George Floyd was killed last May, was following policy when he held Floyd down with a knee to the neck for more than nine minutes.

Insert ( imagine ) what they think the answer might have been? Make note of the fact that the defense has asked legitimate and possibly pertinent questions with a non responsive answer? What is the jury instructed to do with that type of witness?

Exactly. And if he is granted immunity, that doesn't mean the jury can't still "judge" his actions and words. That is what they are there for - to weigh the testimony.

Judge Cahill says Eric Nelson needs to draft his questions in written form -- so Hall can meet with his lawyer to see if he can answer those questions -- then there will be another motion hearing like this without jury to determine if he can be called as witness.

Judge Cahill isn't willing to say that the witness simply cannot be called at all and avoid any testimony by invoking 5th Amendment rights.

Testimony in Derek Chauvin's trial will resume at 9:15, but first, at 8:30, there is a hearing regarding the witness Morries Hall, who was in the car with George Floyd when approached by officers. 4/6/21 thread

Well, it is up to their imagination, isn't it? And a trial should not be about a juror's imagination. It should be about the known facts. Not speculation. Not innuendo. Not whatever their minds think it could be.
