The cause of death testimony seemed to captivate jurors. A pool report note said eight jurors took notes as Fowler repeatedly dismissed the significance of Chauvin’s knee on Floyd’s neck.

I found that guy to be just as boring as some of the prosecution witnesses. Eight captivated jurors taking notes but one nodding off, interesting...this verdict seems like it could be a real wild card. I'm expecting the unexpected because it seems so far from clear cut. Guess not many are but this one is muddied up good. Hung jury seems very possible. I hope not.

Court TV just replayed Fowler cross where state asked if there was a time after cardiac arrest where he potentially could have been been resuscitated and Fowler agreed...to me that was really an example of State using the witness to bring home their case....I hope he uses that in closing. What an admission by Fowler and to his credit he did not try to "confuse the jury" with any long explanation. There is none.

Judge Cahill says the state plans to call rebuttal witnesses and that the defense will rest before the jurors.

Judge Cahill also just made mention of “newly discovered evidence.”

Jerry Blackwell is now at the lectern.

Judge Cahill: I was told in chambers that there was newly discovered evidence…

Blackwell: Your Honor, we have blood gas evidence from Hennepin County, that would contain blood gas reading for the carbon monoxide content in Mr. Floyd's blood on May 25 2020.

Blackwell says the state was just notified of this evidence on Carbon Monoxide yesterday. He says Hennepin Co. Medical Examiner Dr. Andrew Baker discovered it.

Why was it not disclosed yesterday?

Discovered yesterday after testimony of Dr. Fowler. Baker discovered it in one of the slides.

because Dr. Fowler raised the carbon monoxide things referenced carboxyhemoglobin content in GF's blood.

Keep in mind that a hung jury will ONLY be done if allllll the charges are hung. If the bottom one is 100% guilty, it doesn't matter if the rest didn't agree.

Interesting that they have "new" info.

But I'm confused that if they had it, why wasn't it handed over to either the State or Defense in the first place :eek:

Blackwell says the test was run the night of May 25, 2020, but they didn’t receive this as part of their request.

Judge Cahill asks if Dr. Baker “spontaneously” reached out to the state.

Blackwell says Dr. Baker heard Dr. David Fowler’s testimony on CO poisoning yesterday.

JB says Dr. Baker “...thought that this record might exist because...he was aware that there's a panel of the tests that are run by the machine.”

on page 15 at top of Fowler's report judge mentions that the state should have caught this when receiving Fowler's report in discovery.

Why do I feel like the judge will deny letting this come in?
