Clay County eyed as potential venue for George Floyd trial, sheriff says it would be a 'nightmare'
A nearby school would suffer from national "media circus," according to the Clay County sheriff and Moorhead police chief.

MOORHEAD — Clay County Sheriff Mark Empting has this advice for court officials eyeing Moorhead and the Clay County Courthouse as a possible venue for a trial involving defendants in the killing of George Floyd: Keep looking.

Local high-profile lawyer does not think George Floyd trial will be moved to Clay County

"It's pretty rare that a trial will be moved," said local longtime defense attorney Blake Hankey of Hankey Law in Grand Forks.

In his 16 years as a defense attorney, including a number of high-profile cases in small towns, only once has he seen a trial moved.

He says the issue boils down to finding fair and impartial jurors.

He thinks that may be easier to find in Hennepin County, where there are more than a million people to select from compared to 60,000 in Clay County. Hankey also points out the judge will take into consideration the trial could last months.

Hankey also points out no matter where the trial ends up, the community is already familiar with the name of George Floyd.

George Floyd murder trial to be broadcast on UK TV channel

The forthcoming trial is one of the highlights promoted by the production company behind Court TV, which launched on Wednesday on Sky.

“We anticipate viewers in the UK will embrace having a front-row seat to American criminal justice.”

Trial coverage will air at primetime in the UK to allow for the time difference between the UK and US.

Court TV is planning content for the UK to explain the differences between the two countries’ justice systems, including why cameras are allowed in courtrooms in the US, but not in the UK.

The state notified Chauvin’s attorney Eric Nelson that it intends introduce evidence of prior incidents involving restraint to prove Chauvin’s “knowledge; intent; common scene or plan; absence of a justifiable mistake, accident, misunderstanding; and state of mind at the time of the crime [against Floyd].”

And yet any prior criminal history not in Minnesota of Floyd has been deemed "inadmissible".

Well, use it for the appeal.

Only items should be allowed is if Chauvin had received corrective action, and it looks like he did not for any of the incidents.

Court weighs allowing courtroom cameras in George Floyd case

The trial of four former Minneapolis police officers charged in George Floyd's death will generate massive public interest when it begins in March, but as it stands, most people who want to watch the proceedings will be out of luck.

The judge overseeing the case has yet to decide whether cameras will be allowed. Supporters of audio and visual coverage say the high-profile nature of Floyd's death, the outrage that led to worldwide protests, and courtroom restrictions caused by the coronavirus pandemic make this the right time and case to allow cameras in court. But the state attorney general's office, which is prosecuting the case, opposes them, saying cameras would only create more problems.

In June, Judge Peter Cahill decided against allowing audio and visual coverage of pretrial proceedings because he said it would risk tainting the possible jury pool and the state opposed it. But Cahill, who is still weighing requests to try the defendants separately, said he would rule on trial audio and video coverage at a later date. It's unclear when that ruling will come.

Minneapolis city officials are facing backlash for allowing a street to be named after George Floyd. A stretch of a street in the city that includes the place where Floyd was killed will soon be named in his honor.

Although the street will still be called Chicago Avenue, the city will refer to the blocks between 37th and 39th streets as George Perry Floyd Jr Place.

The City Council approved the naming and the Mayor's office said he would likely sign off on it as well.

Following the announcement, several people took to social media to criticize the move.

Just so that you know - there hasn't been any updates on the court site for the next hearings....

Chauvin does have one for his tax evasion problems on 10/30/20

Chauvin has a lot more problems than tax evasion...that is for sure.

Justice in Policing Act of 2020

This bill addresses a wide range of policies and issues regarding policing practices and law enforcement accountability. It includes measures to increase accountability for law enforcement misconduct, to enhance transparency and data collection, and to eliminate discriminatory policing practices.

The bill facilitates federal enforcement of constitutional violations (e.g., excessive use of force) by state and local law enforcement. Among other things, it does the following:
  • lowers the criminal intent standard—from willful to knowing or reckless—to convict a law enforcement officer for misconduct in a federal prosecution,
  • limits qualified immunity as a defense to liability in a private civil action against a law enforcement officer or state correctional officer, and
  • authorizes the Department of Justice to issue subpoenas in investigations of police departments for a pattern or practice of discrimination.
The bill also creates a national registry—the National Police Misconduct Registry—to compile data on complaints and records of police misconduct.

It establishes a framework to prohibit racial profiling at the federal, state, and local levels.

The bill establishes new requirements for law enforcement officers and agencies, including to report data on use-of-force incidents, to obtain training on implicit bias and racial profiling, and to wear body cameras.

For all:

A trial date in this case has been set for March 8, 2021. In the event the motion for change of venue is denied, the trial location will be designated as the Hennepin County Government Center. No additional information regarding seating, courtroom capacity, or other such details, is available at this time.

At this time, motions for change of venue, to dismiss for lack of probable cause, and joinder are still under advisement, and the Court has not made decisions on those motions.

If the trial for the four former Minneapolis police officers remains in Hennepin County, the trial will be held at the Hennepin County Government Center. The most recent hearing in the case was held at the Family Justice Center.

For now, the trial date for Derek Chauvin, Tou Thao, Thomas Lane, and J. Alexander Kueng has been set for March 8.

I still think it’s ridiculous that they pulled Cops, Live PD, PD Cam etc.

I liked that show! Laughing at the stupid criminals....
