#DerekChauvinTrial week 2 about to get underway with a motions hearing. Let's see whether the $27M #Mpls settlement w/ #GeorgeFloyd family is up 1st. Had a city hall official tell me this wknd that Henn Co chief Judge was, at very least contacted before the announcement.

Both sides discussing forensic psychiatrist expert testimony. What doctor can talk about in watching #GeorgeFloyd behavior during video. Anxiety? Claustrophobia? PTSD? What was going thru Floyd's mind? Judge rules expert can use language to efx the behavior was "consistent w/ .."

This civil settlement is a major situation here...major. I was right on with Nelson this morning asking for remedies but not sure any are really possible. The Minneapolis City Council is anti police and Keith Ellison's son was a leader on the council to arrange this settlement. Believe me this is not going down well in the city and I could see Judge Cahill is NOT HAPPY AT ALL.

Juror #51 is up first. Woman immediately tells court, she flipped on radio on Friday & inadvertently heard about the $27M #GeorgeFloyd settlement in a news headline. She works in HR & tells Judge, she understands the difference between civil & criminal court. #DerekChauvinTrial

Juror #51 says she works in HR where there are minimal settlements, but nothing like $27M. She lives in #Mpls & does not believe she can be a fair/impartial juror. Told Judge she drove past burned out 3rd Precinct on way to court this AM. DISMISSED FOR CAUSE #DerekChauvinTrial

Judge Cahill asked Juror #52, whether he heard anything about the #GeorgeFloyd civil case. He says, no. He explained hearing some basic info about trial dates, etc from the news in recent months, but nothing that would keep him from serving as impartial juror. #ChauvinTrial

Prosecutor Steve Schleicher makes sure Juror #52 can set aside his initial opinion that Chauvin may not have meant to kill anyone (or hurt anyone)

"Intent will be contested in this case."

Schleicher passed for cause.

Juror #52 is seated as the 8th juror.

local talk shows here in Minneapolis are universal in saying that impossible for pj or seated jurors not to hear this news... and change of venue out of 7 county area is required at this point. I think the judge cannot ignore this one very long.

Cahill asks JUROR #54, "Can you be impartial?" 54 says, "I wish I could say for sure that I could. I think I would be tainted."

Jurors will be recalled, questioned about settlement news

The defense in the Derek Chauvin trial asked for a continuance, that jurors seated before Monday be recalled, and for extra strikes during voir dire due to the announcement Friday that the family of George Floyd had settled with Minneapolis for $27 million — a record in the area.

Judge Peter Cahill said he would consider delaying the proceedings but denied that Chauvin's attorneys would be given additional strikes. He also ruled the seven jurors seated before Monday should be recalled to ask about their exposure to the news.

8th juror seated in Chauvin's trial

An eighth juror, a Black man in his 30s who works in banking, was seated Monday.

The man, who said he also coaches youth sports, said he has seen what appeared to be police violence in the past — a kid being body slammed by police, as well as someone being maced "for not following orders quick enough." But that would not weigh on his attitude toward the trial, or swing him for or against Chauvin, he said.

He didn't have strong views on Black Lives Matter or Blue Lives Matter, saying only that he believed Blue Lives Matter was crafted mostly to counter against Black Lives Matter.

Derek Chauvin’s lawyer asks for a change of the trial venue, citing potential bias in the jury pool after the city’s recent $27 million civil settlement with George Floyd's family.

Cahill agreed he would have to call back the seated jurors in the case, but suggested he would do so closer to the date of opening arguments, currently scheduled for March 29. He said he would take the other defense motions into consideration and proceed forward with jury selection in the case.
