I'm curious if the jury will start deliberating this afternoon/evening or will prefer to start tomorrow. Do they have a choice or does the judge tell them?

oh thanks for that! I'm trying to mulittask and get things done before they come back so haven't seen anything about the jurors yet.

maybe the juror's were still being attentive but the judge needed to pee? lol
They probably got hungry. I am.

The elements pertaining to each charge don't include anything about a Defendant having knowledge about being video-taped.

This is a big fat red herring the Defense is deploying in order to distract the jurors from the facts of the case and from the elements pertaining to each charge.
He's given them points to discuss/debate in the jury room, imo.

Yes - and the State has proven that the intentional unlawful use of force was not accidental. Derek Chauvin did not press his knees to George Floyd's neck and back unintentionally for 9 minutes 29 seconds.
Therefore, DC intentionally applied unlawful use of force (assault) against George Floyd, resulting in George Floyd's death.

IMO, Derek Chauvin is guilty of Murder in the 2nd degree.
Yeah. Kinda reminds me of the guy who said he slipped in the shower and that's how his cell phone ended up in his rectum when he presented at ER. Reasonable? I think not.

This is what makes Nelson likable IMO. Typically lawyers who defend cops come off very authoritarian and almost aggressive. Nelson is the most likable. But I agree apologizing makes him look like he has no right but jury knows and everyone knows he has every right!

Getting back to “intent” here is Nelson’s argument...it can’t be an intentional use of force because Chauvin knew he was being videotaped. Huh?

Nelson asked the jury to consider the question of “intent” — and whether they could say, beyond a reasonable doubt, that Chauvin intended to do what he did.

“The defendant must have knowledge of those facts that are necessary to make his conduct criminal,” Nelson said.

“Did Officer Chauvin intentionally apply unlawful force? That’s what you’re being asked to decide. Did he purposefully, purposefully apply unlawful force to another person?”

“Did he intentionally perform an act that was eminently dangerous?” he continued.

Nelson said that Chauvin is unlikely to have done these things intentionally because he was being videotaped.

“Officers know that they are being videotaped. Do you do something purposefully that you know is an unlawful use of force when you have four body-worn cameras immediately in the area? Where you have multiple civilians videotaping you?
Where you know your actions are being reviewed through a city-owned camera? Where there are surveillance cameras?” he said.

The defendant having knowledge of being video-taped is not included in the jury instructions provided by Judge Cahill.

Nelson “quoting” the state by repeatedly saying “not relevant” with regard to other physical issues is not a good idea. It inadvertently emphasizes the state’s case IMO before going into his detailed rebuttal.

Interesting how he failed to mention that his client's body cam was under the squad car during the entire incident and not on his body, recording his actions.
