I don’t think the state can get a unanimous verdict. moo
No!With her statements, IMO , she was implicitly advocating social unrest... rioting.
That's exactly what I'm thinking. If they obeyed instructions, the jury members don't know about her comments. And if they don't know about the comments, then the comments cannot be used for appeal, I would assume. Can't the judge poll the jury on whether or not they heard the Maxine Waters statement?
Not unless we have solid proof that a jury member knew about it.I think that this is going to be overturned on appeal. Nelson made some good points about this case making it's way into non-news programs that the jury could have watched. The judges admonition to "stay away from the news" doesn't cover that.
And what about news previews that may have had Maxine Waters statements,or other trial comments, during commercial breaks? Jurors could have avoided the "news" but still could have been exposed to prejudicial statements. JMO
They weren't, but now that they are in deliberations they are.Are they sequestered?
I wonder if they could be questioned after the verdict, in the event defense files an appeal.I would say it can be requested but it wouldn't be granted, you're basically feeding them information they may truly not have heard and they're presumed to have not heard (almost verbatim reasoning for not granting the mistrial)
A Congresswoman from California who is injecting herself into this trial in Minnesota.Who is Maxine Waters? Sorry for my ignorance.
I do think jury members could avoid media, if they put even a little effort into it. Three days without being online or listening to radio/reading paper....yes, I think they could manage that. Not sure they did, but it's not impossible.the Water's statement basically said go riot unless first degree murder. I think it is naive to think that all of these jurors could avoid all media for three days in this town. Sorry but not that they are looking for it but it is everywhere.
Thank you!A Congresswoman from California who is injecting herself into this trial in Minnesota.
The entire country is... She in no way was inciting a riot. We have to confront injustice and being out on the street is one way to do it.A Congresswoman from California who is injecting herself into this trial in Minnesota.
The defense asked the judge last week to sequester the jury after riots broke out but he refused the request. Are they sequestered?
How about social media? Are they allowed to access social media? Maxine Waters’ statements are all over social media. MOOI think that this is going to be overturned on appeal. In my opinion she threatened the jury to vote guilty or else. JMOThe entire country is... She in no way was inciting a riot. We have to confront injustice and being out on the street is one way to do it.
Exactly...Defense attys do this all the time - they basically argue jurors are biased and emotional and they don’t follow instructions! Every trial a defense attys alludes to this perspective in one way or another. Jurors are members of the community. No system can expect a completely isolated jury. If the news is bad right now with respect to police brutality, you don’t get to demand a jury that has been living under a rock! It’s simply not reasonable.
Judge Cahill has allowed his contempt for public officials speaking out about the case to influence his on the record comments. First he said Waters’ comments could give grounds for a reversal than he backtracked on that and said the jury hasn’t been prejudiced. What is he doing? Setting Chauvin up for an appeal? Wtf!?
He only said to avoid the news. A pretty vague instruction. JMOHow about social media? Are they allowed to access social media? Maxine Waters’ statements are all over social media. MOO
Totally unfair comment IMO.Because the jury isn't even supposed to be listening. In my opinion she threatened the jury to vote guilty or else. JMO
