I wonder if Thao, Kueng and Lane will even go to trial or if they'll take a plea deal if offered??

Attorneys for J. Kueng and Tou Thao said in court filings Tuesday that their clients would be unfairly prejudiced if they went to trial alongside Chauvin. An attorney for Thomas Lane filed a motion asking to join in his co-defendants' request.

Keung's attorney, Tom Plunkett, said evidence against Chauvin would confuse the jury and deprive Kueng of his right to a fair trial. He also said there is a conflict of interest due to Chauvin's level of culpability in Floyd's death, saying "the jurors will not be able to follow the Court’s instructions and compartmentalize the evidence as it related to Mr. Kueng."

Former Minneapolis officers request separate federal trial from Derek Chauvin

In a separate state court trial, jurors convicted Chauvin on April 20 of second-degree unintentional murder, third-degree murder and second-degree manslaughter. Kueng, Lane and Thao are scheduled to be tried in state court next year for aiding and abetting second-degree murder and manslaughter.

Kueng, Lane and Thao had unsuccessfully sought separate state trials, citing similar concerns outlined in their federal court cases.

In all countries, the dark job is reserved to the police .
Kueng, Lane and Thao don't deserve a trial. They made what they thank better for them.
It's too easy to condemn after the facts . GF was a very big man , don't forget.

Prosecutors are fighting Derek Chauvin and his ex-cop buddies' request for a witness list in the upcoming federal trial over George Floyd's death.

In documents obtained by Radar, Anders Folk — Acting United States Attorney for the District of Minnesota — is fighting back against Chauvin, Alexander Kueng, and Tou Thao's demands.

According to the docs, the three ex-cops want the prosecution to "produce a list of all individuals it intends to call as a witness at trial," including the "name and address of each potential witness."

On the first pdf - it says Sept. 9 at 9am or as soon thereafter - but in the court site they have evidentiary hearing set for 9/2. Or is this the date the attorney wants a decision by the Judge?

Second attorney asks to ban livestream for trial in George Floyd killing

A second attorney representing one of three former Minneapolis police officers charged in George Floyd's death is asking a judge to prohibit livestreaming his trial next year.

Some witnesses are reluctant to testify after seeing other witnesses treated poorly following the recent livestream of a co-defendant's trial, the attorney argued in a motion filed Wednesday.

Earl Gray, who represents Thomas Lane, is asking Hennepin County District Judge Peter Cahill to ban a public livestream in order to protect Lane's constitutional right to a fair trial.

Cahill had issued an order last November ordering that the trials of all four former officers charged in George Floyd's death be publicly livestreamed because the COVID-19 pandemic severely limited in-person courtroom attendance due to social distancing protocol.

*Evidentiary Hearing for all (@ 9am CT) - MN – George Perry Floyd, Jr. (46) (May 25, 2020, Minneapolis, arrested for forgery & killed in police custody) – Tou Thao (34/now 35), Thomas Kiernan Lane (37/now 38), & J. Alexander Kueng (26/now 27) were fired (5/26/20), arrested (6/3/20) & charged (6/4/20) with aiding & abetting 2nd degree murder-unintentional-while committing a felony & aiding & abetting 2nd degree manslaughter-culpable negligence creating unreasonable risk. Bond set at $1M for all or bond conditions @ $750K. Lane released (6/10/20) on $750K bond with conditions. Kueng released (6/19/20) on $750K bond with conditions. Thao released (7/4/20) on $750K bond with conditions.
Trial was set to begin on 8/23/21 continued to 3/7/22 with jury selection & trial begins on 3/28/22 (@ 9am). Federal case will be tried first.

5/13/21 Update: Court will hold hearing in August to determine who was source of leak to NYT about Chauvin plea negotiations. NYT reporter can be subpoenaed by defense attorney Robert Paule to testify. Judge says he won't order NYT to reveal source. Judge was upset prosecutors did not file affidavits to avoid the "circus" of holding a hearing where they would be questioned. Judge says if prosecutors don't file affidavits they can be subpoenaed. Matt Frank & assistant Hennepin 7ounty attorney Joshua Larson said they will get affidavits from their staff. Frank said judge was shifting the burden onto prosecutors when it's defense's job to prove its allegations. Thao's attorney Bob Paule had filed the accusations. "We didn't authorize that leak. We didn't give that leak," Frank said. Frank said defense's allegations are motivated by desire for change of venue. Judge said today defense's request for change of venue is denied. Lane's attorney Earl Gray wants State to produce 30 years of police use of force reports in internal affairs files to show that there cops did not follow duty to intervene, a policy state will hold against Lane. Judge Cahill explains the federal charges are “much greater…higher” against ex-police officers so he will continue State case against Lane, Thao & Kueng. New trial date from Kueng, Lane & Thao is on 3/7/22 with jury selection. 5/5/21: Notice of visual or audio coverage filed by New York Times & George Floyd News. 5/11/21: State's response to Defendant Lane's 2/10/21 Discovery Motion. 5/12/21: Order denying Media requests for video & audio recording/coverage of pretrial hearings. Thao: Motion for sanctions for Prosecutorial misconduct stemming from witness coercion. Lett to Judge Cahill re sanctions.
5/20/21 Update: Attorneys for the state & for three former Minneapolis police officers charged in the death of George Floyd made oral arguments Thursday before the Minnesota Court of Appeals. At the center of Thursday's hearing was whether Lane, Kueng & Thao could soon face an additional aiding & abetting third-degree murder charge. In his argument Thursday, attorney Neal Katyal argued that the Court of Appeals must allow issues to properly ventilate in lower courts in order to get those courts' views & argued that arguments made by attorney Deborah Ellis, representing the respondents in this case, must first be decided by the district court. Defense attorneys argue that third-degree murder is an unintentional act & relies on a defendant's reckless state of mind, but aiding & abetting must be intentional. On Thursday, Ellis reiterated this statement, arguing that although an accomplice could act recklessly, it takes more to aid someone with a depraved mind. Ellis argued that in this case, the principal person & accessories must have acted with the same mindset. The three-judge panel now has 90 days to make a decision following Thursday's hearing.
6/9/21 Update: According to the new scheduling order, the court will be in session on March 7 to deal with any evidentiary motions or administrative issues. Jury selection in the case will begin March 8. The trial itself will begin with opening statements on March 28. The order from Judge Peter Cahill also outlines deadlines for attorneys to file documents in the case.
6/24/21 Update: Evidentiary hearing for all on 9/2/21. 6/30/21 Update: The Minnesota Court of Appeals issued an order Wednesday reversing a District Court judge's order denying a request from prosecutors to add third-degree murder charges against Kueng, Lane & Thao. The Court of Appeals ruling sends the prosecution's request back to Hennepin County District Judge Peter Cahill for reconsideration & allows him to hear more arguments from both sides before deciding whether to add the count in the three cases.
8/24/21: Defendant's Motion to exclude video & audio recording of proceedings filed by Kueng & Lane. For upcoming hearing on 9/2/21-order to prohibit live video or audio coverage of trial. And Attorney's affidavit in support of motion-exclude video & audio recording filed by Kueng & Lane. Reason: attorney Thomas Plunkett assets: has been informed by potential defense & expert witnesses that they will not testify because this matter is televised.

*Federal Grand Jury indicted & charged (5/7/21) Tou Thao (34/now 35) & J. Alexander Kueng (26/now 27) for violated Floyd’s civil rights. Charged (5/7/21) & arraigned (7/14/21) with violating Floyd's right to be free from unreasonable seizure, alleging they willfully failed to intervene to stop Chauvin’s unreasonable force, resulting in bodily injury to & the death of Mr. Floyd & failure to provide Floyd with medical care. Thomas Kiernan Lane (37/now 38) is charged with failure to provide Floyd with medical care. All released on $25K unsecured bond.
Trial was set to begin on 8/2/21 continued with no further dates.

5/15/21 Update: Lane, Kueng & Thao will be arraigned on civil rights violations on July 14 in U.S. District Court in Minneapolis. Their trial date has yet to be determined. All were released on $25K unsecured bond. Trial is set to begin on 8/2/21.
5/21/21 Update: U.S. District Judge Patrick Schiltz ordered the U.S. attorney's office & the Minnesota attorney general to provide a list of every person to whom they disclosed grand jury activity. He also ordered the U.S. Attorney's office to explain why he shouldn't appoint an independent prosecutor to investigate & file criminal contempt of court charges for the disclosures. Schiltz wants the responses filed under seal no later than June 4.
6/4/21 Update: Magistrate Judge Tony Leung said the four men would be arraigned Sept. 14, subject to any further orders from the court. A date for trial has not been set. 7/30/21 Update: First appearance for all 3 via video conference on 7/30/21. Chauvin was not part of the video conference.
8/2/21 Update: Attorneys for Kueng, Lane & Thao filed motions this week requesting that their trials be severed from Chauvin's trial because his case could potentially prejudice jurors against their clients. No date has been set for the trial. Co-defendants are typically tried in one trial in federal court.

*Derek Michael Chauvin (44) – Murder: Trial began on 3/8/21 with jury selection. Trial started on 3/29/21 & ended 4/15/21. Guilty on all charges. Sentenced on 6/25/21 to 22½ years in prison. 7/14/21: Hennepin County Judge Peter Cahill said Tuesday he will not amend his sentencing order for Chauvin in regards to children at the scene of Floyd's murder.
