MINNEAPOLIS (WCCO) — A judge has denied motions for acquittals and a mistrial from the three former Minneapolis police officers convicted of federal civil rights charges in George Floyd’s killing.

After the federal trial, Thao, Kueng and Lane all moved for acquittals, and asked for a mistrial based on “prosecutorial misconduct.” Those motions were denied by Judge Paul Magnuson, according to a ruling filed Tuesday.

“Although the Court has grave concerns about the possibility that the jury’s verdicts were based on their fear of repercussions — social, political, and personal — from a different outcome, the evidence brought forth at trial supports the jury’s determinations,” Magnuson wrote of the motions for acquittal. “Because there was sufficient evidence from which the jury could have determined that Defendants acted willfully and that their actions were not reasonable, the Motions must be denied.”

Magnuson also wrote that “cases finding prosecutorial misconduct sufficient to warrant a mistrial are rare.”

“None of the instances of alleged misconduct to which Defendants point, taken individually or cumulatively, meets the high bar necessary for a mistrial on the basis of prosecutorial misconduct,” the court ruled.

Magnuson’s ruling does note that “the Court views the Government’s conduct in this case — not the least of which was assigning no fewer than seven prosecutors to try the case — as frighteningly close to that line of overzealous prosecution.”

“The Government’s prosecution here raises significant questions,” Magnuson wrote, “but those questions are for the executive branch, not the judiciary, to resolve.”

Thoa, Kueng and Lane will stand trial on state charges in June [6/13/22]. They have yet to be sentenced for their federal convictions.

As the second anniversary of George Floyd's murder approaches, prosecutors and defense attorneys are preparing for the state criminal trial next month of the three former officers charged in his death.

Former officers J. Alexander Kueng, Tou Thao and Thomas Lane are charged in Hennepin County District Court with aiding and abetting murder and manslaughter in Floyd’s killing. They were each previously convicted in federal court last winter for violating Floyd's constitutional rights, but remain free on bond because they haven't been sentenced yet by the federal judge.

Prosecutors filed a prospective witness list Monday that includes more than 350 names, although it’s likely only a fraction of those people will testify at the state trial of the former officers next month.

A document filed by Kueng’s lawyers lists 65 potential defense witnesses. That includes Minneapolis first responders, medical personnel and prosecutors including Hennepin County Attorney Mike Freeman.

One of the possible expert witnesses on the defense list is former Maryland medical examiner David Fowler, who was extensively criticized for his testimony during the trial of former officer Derek Chauvin, who was convicted of Floyd’s murder last year and sentenced to 22.5 years in prison.

Alexander Kueng (26/now 28) were fired (5/26/20), arrested (6/3/20) & charged (6/4/20) with aiding & abetting 2nd degree murder-unintentional-while committing a felony & aiding & abetting 2nd degree manslaughter-culpable negligence creating unreasonable risk. Bond set at $1M for all or bond conditions @ $750K. Lane released (6/10/20) on $750K bond with conditions. Kueng released (6/19/20) on $750K bond with conditions. 4/7/22 Update: Hennepin County Judge Peter Cahill cited coronavirus concerns & the case’s high public interest when allowing televised coverage for that trial. State prosecutors are seeking the exact same trial conditions for Kueng, Lane & Thao, the other three ex-officers charged in George Floyd’s death. The defense has previously asked Judge Cahill to deny the use of cameras during the trial & so far he has struck down those requests. However, Cahill’s last ruling on televising the trial came before he delayed proceedings to accommodate the ex-officers’ federal civil rights trial. Judge Cahill is expected to decide on the trial parameters Monday evening. In addition to its support for allowing live camera coverage, the prosecution team wants to only partially sequester the jury, as was done in the Chauvin trial, to “avoid creating unnecessary burdens for Minnesotans who seek to perform their civic duty.” The memo also asks Cahill not to extend the trial’s expert disclosure deadline & to limit the defense’s expert medical testimony. Jury selection for the trial of Kueng, Lane & Thao is scheduled to begin 6/13/22. Next hearing on 4/11/22 @ 5pm.
4/11/22 Update: Hearing held on record. #520 & #530 Taken under advisement. Prosecutors revealed Monday evening that they offered plea deals (3/22/22) to three former Minneapolis police officers charged with aiding & abetting the murder of Floyd, but said at a hearing that the defendants rejected them. Hennepin County Judge Peter Cahill held the hearing mostly to consider whether he has the authority to allow live video coverage of the upcoming trial set to begin in June. Lane’s attorney, Earl Gray, said it was hard for the defense to negotiate when the three still don’t know what their federal sentences will be. The judge in that case has not set a sentencing date & all three remain free on bail. Judge Cahill told Frank to file the offers for the record after the jury is seated for the upcoming trial, which is expected to take around eight weeks, including three for jury selection. He did not rule during their pretrial hearing & said he won't until after the Minnesota Judicial Council — a panel of leading judges & court administrators — meets Thursday to discuss the issue. Judge Cahill noted that while he has publicly said he now believes the legal presumption should be to allow televised trials, he pointed out that that’s not the rule yet. “I’m still sworn to uphold the law,” he said. Defense attorneys said they still oppose audiovisual coverage of the upcoming trial & renewed concerns about the willingness of witnesses to testify. Granting motion (not sure “what” motion).

Prosecutors also may call former Minneapolis police chief Medaria Arradondo & other high-ranking officials in the department, as well as state & federal law enforcement agents. They’ve also included the defendants in their witness list, although the three can’t be forced to testify against themselves. All three defendants chose to testify in their federal trial this winter. Lane entered the plea in front of Judge Peter Cahill in the same courtroom where Derek Chauvin was convicted of Floyd's murder a year ago. A count of aiding and abetting second-degree murder was dismissed. In exchange for the plea, Lane agreed to a sentence of three years. The sentence will be served in a federal prison concurrently with his federal sentence for violating Floyd's civil rights. He has yet to be sentenced for either conviction.

Two hours after Lane changed his plea in the brief court session, Lane's attorney, Earl Gray, issued a written statement, saying his client weighed the prospect of a mandatory 12-year sentence for a conviction of aiding and abetting murder.
"My client did not want to risk losing the murder case so he decided to plead guilty to manslaughter with a three-year sentence, to be released in 2 years," Gray said. "He has a newborn baby and did not want to risk not being part of the child's life."

Sentencing for Lane's manslaughter count is scheduled for Sept. 21 in Cahill's courtroom.

*Hearing (State) (@ 8:30am CT) - MN – George Perry Floyd, Jr. (46) (May 25, 2020, Minneapolis, arrested for forgery & killed in police custody) – only for *Tou Thao (34/now 36) & *J. *Thomas Kiernan Lane (37/now 39) plead guilty (5/18/22) to a State charge of aiding & abetting 2nd degree manslaughter. As part of Wednesday’s plea deal, Thomas Lane will have a count of aiding & abetting 2nd degree unintentional murder dismissed. Per plea will only serve 3 years in Federal prison currently with his federal sentence of violating Floyd’s civil rights. Sentencing on 9/21/22.
Trial set to begin on 6/13/22 with motions hearing & with jury selection starting on 6/14/22. Opening statements begin 7/5/22. @9am The jury won't be sequestered except for deliberations, but with security restrictions.

Charged (5/7/21) & arraigned (7/14/21) with violating Floyd's right to be free from unreasonable seizure, alleging they willfully failed to intervene to stop Chauvin’s unreasonable force, resulting in bodily injury to & the death of Mr. Floyd & failure to provide Floyd with medical care. Thomas Kiernan Lane (37/now 39) is charged with failure to provide Floyd with medical care. All released on $25K unsecured bond. All plead not guilty on 9/14/21.

Former Minneapolis police officer Tou Thao was convicted of violating Floyd's constitutional right to be free from unreasonable seizure by failing to stop Chauvin's unreasonable force. Also find Thao guilty of failing to render aid. Former Minneapolis police officer Thomas Lane convicted of failing to render aid to Floyd. Former Minneapolis police officer J. Alexander Kueng convicted of failing to intervene. Kueng also convicted of failing to render aid. All three former Minneapolis police officers convicted of violating George Floyd's constitutional rights. The three men remain free on bond & are expected to start pre-sentencing proceedings next week. Will take a few months for hearing date.
5/11/22 Update: Judge Paul Magnuson has denied motions for acquittals and a mistrial from the three former Minneapolis police officers convicted of federal civil rights charges in George Floyd’s killing. All moved for acquittals & asked for a mistrial based on “prosecutorial misconduct.

*Derek Michael Chauvin (44) - Federal grand jury indicts (5/7/21) for violating Floyd’s civil rights & 14 yr, old boy. Plead guilty to all charges on 12/15/21. Sentenced to 25 years in prison.

A teenager who was pinned under Derek Chauvin's knee three years before George Floyd's murder filed a federal civil rights lawsuit Tuesday, saying in an interview that Minneapolis Police Department should have fired or disciplined the ex-officer for the earlier incident.

"George Floyd would be standing here today," John Pope said last week.

In a federal lawsuit seeking unspecified damages, Pope and his attorney Bob Bennett say Chauvin and six other officers violated his constitutional right to be free from excessive force. The lawsuit says a culture of racism and violence permeated the MPD for decades and that rather than discipline Chauvin for his treatment of Pope, the officer was "left free to prowl for more Black persons to subjugate and torture."

Pope's was one of two federal lawsuits filed against Chauvin and the city by Bennett on Tuesday that accused the ex-officer of using the same dangerous restraint. The teenager's lawsuit calls Chauvin a "serial predator" with a "signature move" of placing his knee on the neck of prone, handcuffed arrestees.

Bennett's second lawsuit was filed on behalf of Zoya Code. The 39-year-old mother of five said in an interview that Chauvin's acts traumatized her since he kneeled on her neck in 2017.

In a statement, Minneapolis City Attorney Peter Ginder called the Pope and Code incidents "disturbing."

"We intend to move forward in negotiations with the Plaintiff on these two matters and hope we can reach a reasonable settlement," Ginder said. "If a settlement cannot be reached on one or both lawsuits, the disputes will have to be resolved through the normal course of litigation."

The latest lawsuits fault not just Chauvin but the culture of the MPD, saying it "encourages and enables racist, predatory police officers and unconstitutional force practices."

In addition to Chauvin and Walls, Pope's lawsuit names five other officers and the city as defendants. The officers are: Joshua Domek, David Nerling, Graham Plys, David Robins and Sgt. Lucas Peterson. Walls, Domek and Nerling remain with the department. Plys, Robins and Peterson all left within the past two years.
