Court resumes with testimony from MPD's Katie Blackwell, who has been on the witness stand for all of today and most of yesterday.

Blackwell says the officers should have rendered aid to #GeorgeFloyd when he went unconscious/rolled him on his side. Their actions were inconsistent with MPD policy, she said.

On duty to intervene policy, Blackwell says the actions of Thao, Lane and Kueng were “inconsistent” with MPD policy/training. She didn't see any of the 3 ex-officers intervening

Blackwell says Thomas Lane's question if they should roll over #GeorgeFloyd did not count as intervening. She says duty to intervene would require the officer doing something.

Defense atty Thomas Plunkett (represents J Alexander Kueng) now up for cross examination.

Plunkett asks Blackwell if recruits should reflect what they learn in training out on the street. She agrees to that.

Plunkett asks if the US Attorney General brought out a patterns and practice investigation into the training department she ran previously before becoming the 5th Precinct inspector, she agrees.

Plunkett brings up that a hired private investigator from the defense attempted to call Blackwell several times but she didn’t return the call. She said she receives a lot of calls that she doesn’t return.

Plunkett mentions that Blackwell and #DerekChauvin have known each other for a long time, they were community service officers at the same time. They had interactions from “time to time.”

Plunkett asks Blackwell if pre-hire psychological evaluation of #DerekChauvin was looked at before he was made a field training officer, she said it wasn’t looked at due to dept practices.

Plunkett asks Blackwell if police are trained for two hours on standing at attention and standing at ease. She agrees and said it's important. He asks if it’s like the military. She says it’s similar.

On “orders given by staff members” policy, Blackwell asks if recruits should show immediate/unquestioned obedience, to which Blackwell agrees.

With this line of questioning, Plunkett appears to be comparing the Mpls Police Department to the military: questions about uniform, recruits standing at attention, being ordered to their feet, not to argue with instructor, etc.

Plunkett asks Blackwell if “old habits die hard” when it comes to training changes/updates, she agrees.

Defense atty Thomas Plunkett notes that a duty to intervene training has a link to video that’s no longer available. Another video had Al Pacino’s speech from “Any Given Sunday.”

Following sidebar, Plunkett is now back up for cross-examination of Blackwell. Discussing FTO (field training officer) program, which Blackwell previously supervised.

Plunkett asks if the FTO is the closest thing to a supervisor that a young recruit has. Blackwell agrees.

Blackwell developed a 40-hour development program for FTOs. Plunkett notes there is one test for the program.

Going over MPD FTO handbook… Plunkett notes that “nothing in the handbook addresses the duty to intervene.” Blackwell agrees.

Plunkett is apparently demonstrating the hobble position, but is out of view of court cameras.

Plunkett shows body camera footage, noting that Kueng had his knee on #GeorgeFloyd’s buttocks, not his back.

Plunkett ends questioning. Judge notes that "everyone is tired" so court will be wrapping up. Court to resume with MPD 5th Precinct Inspector Katie Blackwell on Monday morning.

POLICE TRIAL: Week 2 of testimony begins in the federal trial of the 3 ex-officers charged in #GeorgeFloyd’s death.

MPD 5th Precinct Inspector Katie Blackwell is back on the stand with defense atty Robert Paule cross-examining.

Jury in trial of 3 former officers accused in George Floyd, is being shown real videos of arrests where suspect exhibits “excited delirium”.Videos used in training show officers (from other departments) using their knees and multiple officers being on top of suspect for restraint

As part of training, MPD officers told to not rely on information EXD patients are giving, since it might not be accurate. Says EXD patients are often incoherent.

Defense atty Paule continues to note officer behavior during these training videos, saying that the patient wasn't put in a side recovery position. Blackwell says it's about identifying symptoms of excited delirium, not about restraining/techniques to get a patient into custody.

As noted earlier in the thread.. EXD is the acronym used during MPD training for excited delirium.

In one of the slides on excited delirium, an officer appears to have his knee on a subject's neck as they lay on their chest. Paule asks if that appears to be the case. Blackwell agrees.

MPD training on EXD patients: "Law enforcement control measures should be combined with immediate sedative medical intervention to attempt to reduce the risk of death." Control measures could mean restraining the patient.

Defense atty Paule asks if Blackwell signed off on the excited delirium training, and that MPD Chief Medaria Arradondo also signed off on it. She agrees. Paule asks again if one of the pictures showed an officer’s knee on a person’s neck. She agrees.

Court resumes with defense atty Robert Paule cross-examining Katie Blackwell, which he has been doing since the day began. One other defense atty, Earl Gray, has yet to cross-examine Blackwell. Blackwell has been on the stand for three days now.

Paule notes that an MPD scenario training where Taser is deployed by an officer doesn't mention a side recovery position. Blackwell agrees with that observation.

When asked by defense atty Paule, Blackwell agrees that she was trying to move away from the “military mindset” with her MPD training. Blackwell agrees that she chose #DerekChauvin as a field training officer, but mentions that she chose many FTOs.

Defense atty ends questioning by asking Blackwell if officers are suppose to protect the person in their custody from others who may wish them harm. She says yes.

Defense atty Earl Gray now up. He represents ex-officer Thomas Lane.

Gray now running through MPD police academy's manual on use of force. Talking about the duty to intervene. Gray notes the manual says to "stop, or attempt to stop," inappropriate force. Blackwell agrees with the observation.

Gray talking about Lane’s initial interaction with #GeorgeFloyd inside the SUV. Lane took out firearm when Floyd wouldn’t show hands, put it back in holster when Floyd put hands on steering wheel. Gray notes the firearm being shown is threat of force in order to gain compliance.

Gray asks if Lane putting gun back into his holster was a deescalating technique. Blackwell agrees.

Gray asks if Lane had a duty to intervene as #GeorgeFloyd was “actively resisting” on the ground. She says, at that time, he didn’t have a duty to intervene.

Gray brings up Lane later asking if they should roll Floyd on his side, to which #DerekChauvin refused. Lane said he was worried about excited delirium. Chauvin then said “that’s why we have the ambulance coming.”

Gray asks if Blackwell noticed that Lane made the initial call for the ambulance due to Floyd's mouth injury. He later requested that Thao upgrade the EMS call. Blackwell says she agrees with the observation.

Gray asks if Lane appeared to grab #GeorgeFloyd’s legs and attempt to flip him over after paramedics arrived. Blackwell said she wasn’t sure.

Gray now noting the assistance that Lane provided for paramedics.

Gray asks if Lane went above “in your custody in your care” by requesting to help paramedics in the ambulance. Blackwell says yes.

Gray asks if #DerekChauvin had numerous complaints against him in his file. She says that she got a brief synopsis of the Internal Affairs file, but she didn’t see any “red flags.”

Gray asks if field training officers were selected based on being role models. Blackwell agrees. Gray says that it’s been learned that #DerekChauvin wasn’t a role model. Prosecution objects as Gray ends questioning. Court goes into sidebar.

Court is now in recess until 2 p.m. Expect more testimony from MPD 5th Precinct Inspector Katie Blackwell.

Court resumes with Dr. Andrew Baker — the Hennepin Co. Medical Examiner who performed the initial autopsy of George Floyd, taking the stand for the prosecution.

He also testified in #DerekChauvin's state trial.

In the state trial, Dr. Baker said #GeorgeFloyd's cause of death: “cardiopulmonary arrest complicating law enforcement subdual, restraint, and neck compression.”

Dr. Baker said at the time that the "law enforcement subdual, restrain and neck compression" was too much for #GeorgeFloyd's heart to take, considering his heart conditions.

Dr. Baker is now taking the court through his determination of Floyd's cause of death as he did in state trial. He "top lined" law enforcement subdual because he considered it a primary cause. For manner of death, he listed #GeorgeFloyd's death as homicide.

Notes: US atty Samantha Trepel is questioning Dr. Baker.

Dr. Baker says sometimes video can be helpful in the autopsy. He says reviewing video of this incident was very important because, among many things, Baker could see Floyd’s interactions with police, how he was restrained, and when he started to lose consciousness.

Dr. Baker says he found injuries on #GeorgeFloyd’s face, but not his back. Prosecution shows pictures of autopsy showing Floyd’s face. There are bruising/scrapes/lacerations on the left side of his face.

Baker said those injuries happened due to that side being on the pavement.

Prosecution shows more autopsy pics of #GeorgeFloyd, showing injuries to his shoulders, with his left shoulder having a larger injury. Abrasions and contusions. Baker said it's likely due to pavement.

Floyd had injuries to his wrists consistent with the use of handcuffs.

Baker's report noted that Floyd had hypertensive heart disease, fentanyl intoxication, and recent use of methamphetamine and cannabis. Additionally, the report said that Floyd tested positive for COVID-19 the month before the incident.

Dr. Baker says he determined that Floyd’s heart disease was not an “immediate” cause of death.

Prosecution running Dr. Baker through #GeorgeFloyd's death certificate, shows Baker's determinations of manner/cause of death.

Dr. Baker says Floyd’s death was multifactorial, the stress of being pinned to the ground for 9 ½ minutes put too much pressure on his heart. He confirmed he classified Floyd’s manner of death as homicide.

Trepel ends questioning.

POLICE TRIAL: Testimony continues Tuesday in the federal trial of 3 ex-officers charged in #GeorgeFloyd’s death. Defense atty Robert Paule is cross examining Dr. Andrew Baker, who did Floyd’s autopsy.
Defense atty Paule is asking Dr. Baker about calls received from his colleague Dr. Roger Mitchell, a prominent medical examiner from Washington, D.C.

Defense attorneys last year filed a motion that Mitchell influenced Baker to include neck compression to Floyd’s cause of death.

In this line of questioning, defense atty Paule appears to be implying that Dr. Baker encountered threats, criticism from colleagues, pressure from public/media, etc. that may have influenced his findings in #GeorgeFloyd’s death, particularly the “neck compression” part.

Court is back in session, presumably with Juror #15 who had to be helped from jury box. According earlier pool notes, Judge gave her 15 minutes (during break) to make sure she was OK.

With the juror presumably feeling better, court resumes with defense atty Robert Paule's cross-examination of Dr. Baker.

Dr. Baker, during a grand jury proceeding, said he took a quick break for counsel after being asked if he’d been pressured to say anything but the truth in Floyd’s death. After 9 minutes, he came back to say “no.”

Paule asks him the same question, and he said "no."

Paule done.

Defense atty Thomas Plunkett, who represents J Alexander Kueng, is now up for cross-examination of Dr. Baker. Says he has "very few questions."

Notably, excited delirium was brought up several times during defense's cross examination of Dr. Baker. Baker said he's used the term in several cases in the past, but not in regards to #GeorgeFloyd.

Before jury is brought in, prosecution tells judge that the next witness they planned to have up is ill, so they are replacing that person with another.

Judge Paul Magnuson is clearly not pleased with prosecution, says the prosecution has 40 witnesses, with many living in the Twin Cities area, and should be better prepared for situations like this.


Jury brought back into court. Judge says court will likely be out early today due to 1 of 2 planned witnesses for the afternoon being unavailable.

Jury advised that the next witness is only applicable to ex-officer Thomas Lane.

Next witness up is Christopher Douglas, who works for the Hennepin County Dept. Of Community Corrections. He trained ex-officer Thomas Lane in techniques used to gain control of suspects.

Prosecution again being chastised by Judge, he is sustaining many objections of defense attny Earl Gray to testimony by an Officer who trained Thomas Lane in 2017 when he was a Henn Juvenile Detention Officer - all in front of jury

Douglas provided a 4-hour refresher course on restrictive training

Notably, before jury was brought in, prosecution said the witness was going to show that Thomas Lane should have known the dangers of positional asphyxia and intervened to help Floyd.

Christopher Douglas says it's best to keep people "vertical" to avoid injury and transport them easier.

Douglas says if handcuffs are applied in a prone position, the goal should be to roll the person on their side or seated position, so they can breathe.

Douglas says once an officer restrains another person, they are responsible for their safety.

Douglas says officers were trained to avoid using their body weight to control suspects on the ground in a prone position, and to instead use arm bars. Again, once restraint applied, they should be put in a recovery position.

US atty Samantha Trepel ends her direct questioning.

Lane's attorney, Earl Gray, now up for questioning.

After less than an hour of testifying, Christopher Douglas is off the stand and court is in recess until Wednesday morning.
