Dr. Systrom says that insufficient breathing also results in a buildup of carbon dioxide. Patients experiencing this often complain of shortness of breath. Can lose consciousness/stop breathing.

In regards to J Alexander Kueng’s position on #GeorgeFloyd, Dr. Systrom says “he was holding (Floyd’s) wrist and leaning down onto his chest.” Says Kueng’s position further prevented Floyd from being able to adjust his body to breathe better.

Dr. Systrom says based on video/pictures of #DerekChauvin’s knee on side of #GeorgeFloyd’s neck, that Floyd’s upper airway was partially blocked.

Dr. Systrom says Thomas Lane’s intermittent restraint on #GeorgeFloyd’s legs also prevented Floyd from adjusting his body to assist his breathing.

An illustration shows four points of pressure on #GeorgeFloyd when he was in the prone position. His neck, his left elbow/torso, his wrist against his lower back and the fourth on his buttocks. First two pressure areas are from Derek Chauvin, second two from Kueng.

Dr. Systrom says #GeorgeFloyd said that he couldn’t breathe about 25 times while in the prone position.

Harvard pulmonologist Dr. David Systrom says #GeorgeFloyd died from “asphyxia” this is notable because Medical Examiner Dr. Baker did not list asphyxia as cause. Systrom also testifying that pressure on Floyd’s abdomen contributed to the fatal asphyxia.

Defense continues to object during questioning about repetitive nature of the questioning. Judge sustains most of these, agreeing that the questioning is repetitive, echoing moments from earlier in the trial between judge, prosecution.

When asked if #GeorgeFloyd would have died from his heart issues without the police restraint, Dr. Systrom said “a definitive no.”

Dr. Systrom said in his medical opinion, #GeorgeFloyd’s death was not sudden.

Dr. Systrom said someone overdosing on fentanyl would not complain of shortness of breath. In fact, patients near the end of their life who complain of shortness of breath are given fentanyl or morphine to counteract that feeling.

Dr. Systrom asked what could have been done to aid #GeorgeFloyd before he lost consciousness, says it would have been to relieve him from pressure from the top, letting him assume seated position.

Dr. Systrom says #GeorgeFloyd’s chances of revival would have “doubled or tripled” if CPR had been performed right after Floyd had cardiac arrest.

Defense during the court break: Dr. Systrom was at a #GeorgeFloyd vigil organized by Brigham & Women's Hospital on June 5, 2020… a vigil for those killed by police, including George Floyd. All employees were encouraged to attend. Will be asked about this.

Defense attorney Robert Paule (Tou Thao's attorney) is now up for cross-examination of Dr. David Systrom. Starts out by asking how long he's been a doctor, Systrom says close to 40 years.

Dr. Systrom charges $600 an hour for his expert witness testimony preparation. Defense asks how many hours he worked. Systrom is not sure, but guesses about 20 hours. That would equal $12,000.

Defense Attorneys have pictures of the expert witness who has been on the stand all day at a June 2020 Boston rally showing solidarity for George Floyd. Defense attorneys expected to cross examine Dr David Systrom about this

Dr. Systrom disclosed a picture on social media that showed him at a #GeorgeFloyd vigil organized by Brigham & Women's Hospital in Boston, Mass. on June 5, 2020. About two weeks after Floyd's death.

Paule shows a picture of the event at the hospital, showing medical staff kneeling during the vigil, including Systrom. A picture was published in the hospital's newspaper. Everyone took a knee for 8 mins and 46 seconds, Systrom said.

Defense's Thomas Plunkett (J Alexander Kueng's attorney) now up for cross-examination. Running through Kueng's positioning on #GeorgeFloyd's body during the prone position.

Plunkett contends that Kueng's knee was further down on Floyd, in the area of his upper thigh, whereas Dr. Systrom's diagram showed it was on the buttocks. Systrom says either spot would still factor in Floyd being obstructed from adjusting to a better position for breathing.

Plunkett's line of questioning is now going through the videos/evidence that Dr. Systrom reviewed that Kueng didn't have access to during the incident.

Dr. Systrom said J Alexander Kueng had a "front row" seat to the events that happened, but agreed it is a high stress environment.

Defense atty Earl Gray (Thomas Lane's attorney) now up.

Systrom says he didn't review any evidence of the incident prior to the June 5, 2020 vigil for #GeorgeFloyd outside his hospital. Said his attendance didn't affect his medical opinion in the case.

Part of Officer MacKenzie's testimony from the state trial focused on medical training. She trains in medical support, including CPR.

In the state trial, she said part of the training is, if the subject doesn’t have a pulse, that CPR should begin immediately.

In defense cross examination during the #DerekChauvin trial, Mackenzie said rendering aid to a person can be distracting/difficult if there are environmental concerns. “If you don’t feel safe… it’s very difficult to focus.”

Officer MacKenzie knows Kueng and Lane from training at the police academy.

Officer MacKenzie said in excited delirium cases, it's important to get the patient on their side (recovery position) after being handcuffed, and get EMS to the scene.

MacKenzie said the recovery position is a common theme throughout medical training classes.

On excited delirium, MacKenzie said it's not seen often -- she's seen it maybe once in her career -- but says it's trained because cops need to know the potential signs and that it will likely lead to a medical situation.

MPD Officer Nicole Mackenzie on stand in trial of 3 former officers accused in #GeogeFloyd death. She is head of medical training for MPD. She says Kueng & Lane were both trained “if you cant detect a pulse in ten seconds you should begin CPR”.Training included “excited delirium”

Notably, the defense objected several times during the direct, saying that the prosecution's showing of segments of the #GeorgeFloyd video was cumulative and repetitious. It's something that has been a theme throughout the trial.

Defense atty Robert Paule (Tou Thao's attorney) now up for a "lengthy" cross-examination of Officer MacKenzie, he said.

MPD Officer Nicole Mackenzie, who is head of MPD medical training says the actions of former Officers , Thao, Lane and Kueng and their failure to aid George Floyd were “inconsistent” with the police medical training they had received

Judge Paul Magnuson sustained some of these objections and overruled others. Judge also gave prosecution warning of leading questions.

Paule points out that one of the pictures in an excited delirium training powerpoint shows an officer kneeling on the upper shoulder/neck of a person in a prone position. Paule is asking MacKenzie about what she said about the position during a past interview.

Court resumes. Officer MacKenzie couldn’t tell if there was any force used in the presentation photo of the officer kneeling on a subject’s shoulders/neck.

She says she wasn’t trained to put her knee on someone’s neck.

Paule asks for a lunch break for Officer MacKenzie to review the interview transcript. Judge agrees.

Gray is noting Thomas Lane call EMS, asking to “hobble” #GeorgeFloyd, upgrading the EMS call, asking to roll Floyd on his side – to attend to Floyd’s medical needs. Officer MacKenzie agrees Chauvin refused rolling Floyd over.

Gray’s line of questioning is clearly meant to show Lane’s concern for Floyd during the incident, and Lane's attempts to aid Floyd.

Asst. U.S. Attorney Allen Slaughter back up for redirect.

MacKenzie said that Lane was making the “right suggestions” during the incident, but it wasn’t enough because suggesting and actually rendering aid are two different things.

Paule asks if Thao went to grab the hobble for #GeorgeFloyd but was refused by #DerekChauvin, MacKenzie agrees.

POLICE TRIAL: Week 3 testimony continues Wednesday in the federal trial of 3 ex-officers charged with violating #GeorgeFloyd’s constitutional rights.

Notably, before the first witness was brought up, the judge says one of the jurors, Juror No. 47, has been excused. The juror's son has a medical situation that needs attention. The judge wishes both the best.

The first witness on the stand is Dr. Vik Bebarta, will be discussing emergency medicine and toxicology in relation to this case. Prosecution running through his background. He's a professor at the University of Colorado and an Air Force colonel.

Prosecution asks Dr. Bebarta if he's ever had to refuse an order in the military. Before any answer was given, the defense objects. Judge sustains.

When asked about his expert opinion on #GeorgeFloyd’s cause of death, Dr. Bebarta says he died from a lack of oxygen to his brain. Bebarta says Floyd suffocated, because his airway was closed and he couldn’t breathe.

Dr. Bebarta said #GeorgeFloyd had an increased tolerance of opioids and the level of fentanyl was low in his system.

Furthermore, Dr. Bebarta said that #GeorgeFloyd did not die of a drug overdose.

Dr. Bebarta says the officers did not provide any medical aid before #GeorgeFloyd was loaded into the ambulance.

Before a morning break, Dr. Bebarta said that Floyd did not die of a heart attack.

After the morning break on 2/9/2022

Dr. Bebarta running through possible symptoms of excited delirium, including pain tolerance. Bebarta says #GeorgeFloyd demonstrated he had pain. Other symptoms include rapid breathing, sweating, agitation, unusual strength.

Dr. Bebarta said it appears #GeorgeFloyd did not show signs of excited delirium. Later, Bebarta said Floyd did not suffer a sudden death, but gradual.

Dr. Bebarta says #GeorgeFloyd would have lived if he was placed in a recovery position before he stopped breathing.

Dr. Bebarta says in his professional opinion, #GeorgeFloyd could have survived if he was given CPR when he had cardiac arrest, and the officers were in the best position to do that. Defense atty Robert Paule (Tou Thao's atty) now up for cross-examination.

On cross, Dr. Bebarta says he's spoken with the government about 10 times and started working on the case in July of 2020. The gov't reached out to him.

Defense atty Robert Paule asks Dr. Bebarta how many times he's seen people in agitated states similar to excited delirium. He says a thousand times.

Defense’s Paule is asking Dr. Bebarta about a White Paper Report on Excited Delirium Syndrome, which is from the American College of Emergency Physicians, published in 2009. Bebarta is a member of ACEP, but wasn’t involved in the report.

Dr. Vik Bebarta is excused from the stand.

Prosecution's next witness is McKenzie Anderson, forensic scientist for the Minnesota Bureau of Criminal Apprehension.

She testified in the #DerekChauvin trial. Here's the report from that day.

Prosecution is running McKenzie Anderson through multiple pictures she took of evidence at the scene, including the SUV Floyd was inside prior to his arrest and the squad vehicle they attempted to put him inside.

Anderson said she initially missed seeing a white pill in the back seat, which is seen in photos from the first processing. She said she didn’t give it any forensic significance and the focus was on the blood in the back seat.

The pill, and other pill fragments, were recovered in January only after the defense asked for re-examination of the squad car.

Prosecution ends direct.

2/8/22 Wednesday, Trial Day 10: Before the first witness was brought up, the judge says one of the jurors, Juror No. 47, has been excused. The juror's son has a medical situation that needs attention. The judge wishes both the best.
Government witnesses: Dr. Vik Bebarta, will be discussing emergency medicine and toxicology in relation to this case.
