*Thomas Kiernan Lane (37/now 39) plead guilty (5/18/22) to a State charge of aiding & abetting 2nd degree manslaughter. As part of Wednesday’s plea deal, Thomas Lane will have a count of aiding & abetting 2nd degree unintentional murder dismissed. Per plea will only serve 3 years in Federal prison currently with his federal sentence of violating Floyd’s civil rights. Sentencing on 9/21/22. Sentenced to 3 years in Federal prison.
Trial has been changed to begin on 10/24/22 with jury selection. Opening statements will begin on 11/7/22. The jury won't be sequestered except for deliberations, but with security restrictions. (No trial on 11/11 & 11/23-25/22). Trial will be finished & deliberations will begin on or before 12/16/22.

8/11/22 Update: Hennepin County Judge Peter Cahill scheduled a hearing for Monday, 8/15/22 on the “status of plea negotiations” for the two remaining officers awaiting trial on State charges in the killing of George Floyd, with the hearing coming after the judge’s window for accepting any deal appears to have closed. Judge Cahill said in previous orders that he would not accept plea agreements unless they came within a 15-day window after former Officers Thao & Kueng were sentenced in Federal court on separate civil rights charges. Those sentences came down 7/27/22. His orders did not specify business days or calendar days. Court spokesman Matt Lehman said only that Monday’s scheduled 9am hearing was “to discuss the status of plea negotiations.” Motions in Limine hearings on 10/6/22 & 10/7/22.
8/15/22 Update: Thao & Kueng rejected a final plea deal of 36 months from the State. The deal would drop the highest offense of aiding & abetting 2nd degree murder & then require both defendants to admit to aiding abetting 2nd degree manslaughter. The deal would have run concurrently with a federal sentence they received earlier this year. Kueng was sentenced to 3 years in prison, while Thao was sentenced to 3 1/2 years. 8/18/22 Update: Morries Lester Hall, who was with Floyd before he was killed on May 25, 2020, has indicated that he intends to invoke his Fifth Amendment right against self-incrimination again if called to testify in the upcoming trial of former officers, Thao & Kueng. His public defender, Adrienne Cousins, wrote of Hall’s plan in a motion filed on Tuesday, 8/16/22 in Hennepin County District Court. Hall previously decided to plead the Fifth in the trial of former Minneapolis police Officer Chauvin.

MINNEAPOLIS (AP) — Prosecutors and defense attorneys for two former Minneapolis police officers charged in the killing of George Floyd have filed more than 100 motions to limit testimony or evidence at trial — with many requests relying heavily on what happened at the previous two trials in Floyd’s death.

J. . Alexander Kueng and Tou Thao are charged with aiding and abetting second-degree murder and second-degree manslaughter. With jury selection to begin Oct. 24, both sides are using what they learned in the prior trials to try to shape the proceeding in their favor. Hearings on the motions are scheduled for Thursday and Friday [10/7/22].

10/6/22 Update: Hennepin County Judge Peter Cahill overseeing the trial expressed skepticism Thursday about the concept of “excited delirium” at a hearing Thursday. It’s a controversial concept that is widely taught to first responders, including police officers. They’re instructed that people suffering from excited delirium are incoherent, strong & sweat profusely. Defense attorneys had argued Floyd’s “excited delirium” justified the force officers used to subdue Floyd. However, during the pretrial hearing Judge Peter Cahill told attorneys that he believes the concept of excited delirium has been “debunked” & that it’s not a “medical term.” He said he will allow defense expert witnesses to talk about the general law enforcement standing of what excited delirium is, but that they can’t testify about how it applies to Floyd. Neither Thao nor Kueng were in court or remotely attending Thursday’s hearing. They're both in federal prison in other states serving federal sentences tied to Floyd’s death. The two men declined to accept plea deals on the state charges. Judge Cahill tentatively granted a prosecution motion to prevent defense attorneys from introducing evidence on what happened during the civil unrest after Floyd's murder, saying it's not relevant to the aiding & abetting case. The judge also ruled that defense expert witness Shawn Pruchnicki can testify about "duty to intervene" & the effectiveness of the training Thao & Kueng received from the Minneapolis Police Dept. Judge Cahill also ruled that no electronics will be allowed in the courtroom but that journalists covering the trial in the overflow room will be allowed to use them to take notes & post to social media. Chauvin has a plea hearing on 12/16/22. So guessing he is going to plead guilty to the tax evasion. Do not know about his wife though.

10/7/22 Update: Hearing held. Thao: #612 Order. Kueng: #621 Order. Thao & Kueng lawyers argued over 170 motions. Both defendants waived their appearance. Friday, lawyers & Judge Cahill finished discussing motions for the upcoming state trial. Attorneys & Judge Cahill made it through about 100 motions Thursday & quickly moved through the remaining 70 in two hours Friday morning. Among the topics discussed Friday were witnesses’ outfits & Darnella Frazier, the teenage bystander who recorded George Floyd’s murder. The judge admitted Friday that he didn’t notice the lettering on Williams’ shirt during the Chauvin trial but said he’ll keep a close eye on witnesses to ensure something similar doesn’t happen in this case. Additionally, Cahill ruled that the lawyers can ask about Frazier’s GoFundMe related to the case. The defense said it may show bias in her testimony. Judge will deliver a verdict - does that mean he "sort of" plead guilty? Or??
