Yup. TG's filing. Please note that

Yes, it was filed by her attorney and sounds to me like it's a provable case for police misconduct.

IMO, Noor is and was a loose cannon. If it was such a jumpy situation why didn't Harrity have his weapon at the ready to shoot as well? He was lucky he wasn't another dead person that night.

In the US, anyone can sue for any reason. And the person's lawyer will say things for the person. Noor's lawyer will state something different. Whatever lawyers file does not make it true.

Yes. Very strange to shoot across your partner

Yes of course they can, and if there is a case to be had it will be tried in court, and a jury will decide the outcome. The case will still have to have evidence if it is to be successful.
From TG's side and the court filing it sounds as if it will probably go to a civil court because it states she is after monetary compensation for her loss of liberty as a citizen, and constitutional rights were violated by LE.

Downright crazy & dangerous IMO.

Downright crazy, and dangerous is right. This guy is either a nutjob, or he had an agenda that didn't matter if he might accidentally kill his partner. Hmmm.

Would an Australian have constitutional rights? Does that come with a green card or permanent residency?

ETA. Answering my own question. I have just remembered that she had dual citizenship.

Her father being American gave her dual citizenship, so yes, she had constitutional rights as a U.S. citizen

Agenda? He conveniently planned this scenario?

I would think he knew what he was exactly doing to have his gun at the ready to shoot, because that's exactly what he did. I do not think it was accidental.

How many shots did Noor actually fire from his gun? Is that known. I have read more than one but don't know if that has been validated?

I know zero but maybe those who know more can explain. My hubby says it was probably an accidental shooting, He said police weapons have triggers that go off easily, He feels that Noor was too hyper and did not mean to shoot but he had no gun control.

Anyone know anything about police guns?

I know zero about police guns but I tend to agree with your husband. It was accidental. I think he was hyper sensitive and/or too twitchy. I don't think he purposefully shot her. It sucks all away around and he should be held accountable. I just don't see this as nefarious other than a trigger happy scared cop. This is just my opinion and doesn't reflect on anything other than what we know.

BBM, If he's that scared and twitchy he needs to find a different career path IMO. He should never have been given a badge & gun.

I don't think that he had any agenda. I do think that he had an attitude that police's main function is to protect themselves, not the people that they are supposed to protect.

I wonder if his partner knew that he had his gun in his lap? Wouldn't he have had to have to known that?

But no one was threatening him.

Why was his gun in his lap and not holstered? Did Harrity have his gun in his lap too?
