UPDATE: The mother suspected of taking five of her children, despite a court order to keep her away from them, is now facing several charges.

According to court documents, charges were filed on Monday against 39-year-old Izetta Cooley, of Moorhead.

Cooley is facing two counts of kidnapping and two counts of violating a court order, all felony charges related to the disappearance of five of her children.

The criminal complaint states that at 10:11 p.m. on Saturday Mower County Sheriff's Deputies responded to a home on the 200 block of Elm Street NE in Rose Creek for a reported kidnapping.

Ok, this is a bit confusing to me. So the mother shows up at 10: 00 pm or so and then what? Did she take the kids at gun point? Did the kids miss their mother and want to go with her? Why did the Mom show up that late at night, especially where she was court ordered to stay away?
These kids are all older, and a couple of them look like they would be strong enough to over power her, if they had the chance. That's why I am wondering if she had a gun and hel them at gun point, or if they wanted to go with her?

IMO they probably wanted to go with her. They are going through so much right now and I am sure they want the comfort of their mom. One of the sons posted on Facebook a day or so after the dads arrest “I miss you dad, I can’t and won’t live my life without you”. Those poor kids must be hurting so bad right now.

On Sept. 23, a man was killed at a Fargo McDonalds.

The missing children's father, Miguel Cooley Sr., was arrested the next day in Mower County and charged with the crime.

Authorities say Izetta Cooley and her children may be in Minnesota but also may be traveling in South Dakota or North Dakota.

Ok, now I am really confused, and I know none of us have any answers to this, but why did the mother have a court order not to see her children? Especially since it was their father who was arrested for shooting another person?

It is strange. I think the situation was so fragile and unknown after the murder, that it was determined to be in the best interests of the children to remove them from the mother.

I think the court order was in response to the murder and the mother being possibly involved in a relationship with the murder victim so perhaps was under investigation? Someone reported the mother felt suicidal so perhaps the kids were removed for their own safety because of that?? IDK, but it's not as if the mom had a previous court order not to see the children that I know of - I think all of this happened rather quickly.

I could be wrong. It's a odd situation that seemed to spiral fast.

Maybe since she was threatening suicide, LE felt it was unsafe for the kids to be in her care.

Like you say none of that is clear at the moment. I could find no court cases in Minnesota nor North Dakota (where the father, and perhaps the kids lived) covering custody, protection orders, etc.

Hopefully, now that she has been arrested, we might get whatever it is that law enforcement has left out of the stories as something had to be left out.

A day after she spoke with The Forum, a Clay County judge gave county social workers the authority to place two of the youngest children with their aunt and uncle in Mower County. On Saturday, the uncle told police Izetta entered his home with some of her older children and took the two youngest with them.

The Forum attempted to learn why Izetta Cooley lost custody of the children, but didn’t immediately hear back from Clay County Social Services or the county attorney’s office.

I realize this doesn't answer our question, but this article has a lot of info on the murder, the victim, the kidnapping, etc. Sorry if it's already been posted.

Wanted for kidnapping her own kids, Moorhead woman says jealousy...
