Can something like this incident be taken to Minnesota State Supreme Court?

I posted yesterday the thoughts of a former federal prosecutor. The matter will have to go to federal court, as he is a federal employee involved in a federal incident.

Minnesota can prosecute, in a federal court.

imo

Okay, thank you for that information!
I wonder how they choose and approach a federal level court.

He's an excellent man ....

As is AG Ellison. He is willing to prosecute. He is willing to sue.

imo

"Minnesota's non-citizen immigrant population is just 1.5%, which is half the national average," Ellison said at the press conference. "Our state's percentage is lower than Utah, Texas, and Florida's, but none of those states have thousands of federal agents swarming their streets or harming their people."

Ellison previously asked residents to submit any evidence tied to the ICE shooting .....

The impression I got (from the article I posted) is that it starts in Minnesota courts, then the accused requests the shift to federal court, and that is allowed by law.

It wasn't clear which federal court. Just that it "wouldn't be in the area".

imo

I heard LIVE the original presser with the Mayor and Ellison, of who I knew nothing of them. I was so impressed and so hopeful to have such people among us and THERE. It IS an 'occupation' of ice being there. IMO

I don't think it matters whether the partner's cries of drive baby drive can be a factor in the agent's perception. This case will never see a court of law. He's already been cleared as far as those in control have determined. And the Feds have already seized control of the "investigation" such that it is.

I think that is why so many, myself included, are angry. I don't like being told nothing to see here when I saw plenty that concerns me.

all MOO
thank you. I agree that this case will never go to court. I would be surprised if there would even be an investigation. Maybe a couple of years ago this might have happened. He is already been cleared by the top 3 in power over this. And to many he is even considered both a victim and a hero.

I'm fortunate I was home and had News on that day to hear his anger and very clear rage and perfectly said. No blurbing out his words then. IMO

Mayor of St. Paul was at the presser too, an immigrant herself.

I hope you are wrong.

You're not, probably.

But I hope you are wrong. I hope somehow the voices of the protesters reaches somebody's ear and justice is done. The shooter deserves a jury trial. But he shouldn't just be free and uncharged. It looks to me like there is evidence to book him now and slap a bracelet on him, at least.

Imo he wouldn't have had sufficient reaction time unless he already had his weapon out. Had she hit the accelerator first, presuming he was in front of the vehicle, the vehicle would have hit him in maybe a second. Google tells me it takes 1.7, seconds to go 5 feet at 2mph, and he was much closer than 5 feet.
The video shows his hand on the firearm. He doesn’t draw until she’s in drive and starts forward momentum. I watched the video in slo-mo. That’s what I see. imo

I just want to reference this article I posted yesterday again. The FBI case won't make it to court. (imo) But I think the state will try their best to bring it to court.

Why state charges for Minneapolis ICE shooting are possible but tricky

Here it is. 2:08 crystal clear from ABC.

The same video starts at 2:08 into this ABC clip

Very clear.

This video absolutely proves that she did not drive her car at him, as it moves forward it is moving away from him and he very clearly steps into its path, leans in, points his gun and fires through the windscreen, the only contact made is when he has already shot her and then he puts his hand on the bonnet of the car and straightens himself up.
I honestly dont know what you believe you see here, but I promise you it isnt what you want us to believe it is!.
Not jmo, seen with my own eyes, which are very reliable as I have just had them tested!.

Then you saw his choice to stay in front of the car - to the left - and shoot. While Renee's hands were turning the steering wheel to the right.

I hope you are right and they do, I just don't hold out much hope of it getting there.
