Thanks. JMO, it seems unusual that someone who was given access to this photo chose to go to the FBI with the information. Maybe the local police, or more likely they wouldn't report it to anyone.

It seems more likely it would have been given to the FBI by someone who trolls the internet or dark web or whatever. JMO, that sounds like someone who does that for a living, IOW an FBI or similar federal agent. Those agents identities aren't revealed, nor are details of the program they work for, hence attributing it to an anonymous person who came across the photo somehow.

But, as you say, it could also be a good citizen who found it and decided to share it with the Kansas City FBI.

Judges get stricken all the time, by attorneys familiar with their style and not liking it... By the way they handle certain case types or motions... This on its own doesn't mean anything. I'm not sure how much flexibility there is amongst jurisdictions, but most attorneys are allowed one strike. Any more than that and you get into judge shopping, but one is almost routine.

Judges need to recuse themselves when there is an actual or perceived conflict, but that's different. It's getting a new judge, but it's by recusal not motion for a new judge

Thanks for that information. It does seem to buy some more time. That helps as prosecutors get more time until they get results on the evidence submitted.

Maybe they should keep him in jail, for his own safety. Someone set fire to the crime scene hovel, so the same people might want to visit Norton if he's released.

I really hope investigators are trying to get more information from Norton about others involved.

It's standard procedure. His attorney has a right to request the hearing on his behalf. It doesn't mean the court is obligated to allow him to get out on bond, though. The state will probably ask the judge to refuse bond based on his flight risk and the serious nature of the crime.

ETA: Seriously, I think if they let him out on bond, he'll end up dead in less than 24 hrs.

It's been one month. The Sheriff said in the news articles (dated October 1st) that it would take a month, so I suspect it will be very soon.

And no article specified if it was more than one person's DNA.

I would not be surprised if it turns out to be more than one person.

Before I read your post here I was about to reply with, "would that really be such a bad thing?" But you have a good point - assuming that he'll talk. I wish LE (or other less visible resources) were allowed an opportunity to flat out offer him that option. (I.e. Give us info or be relegated to a less than enjoyable, immediate demise.)

Yes, thanks for the link! We should watch for any news that comes out of the Phelps hearing this Friday.

Court documents show a motion to compel and a motion for bond reduction were filed by Samuel Gearhart, a co-counsel for James Phelps. Now a bond has not been set for Phelps, but OzarksFirst anticipates these motions will be discussed on November 19 during a court appearance. Phelps was assigned a new judge on November 1.
