I am not a legal eagle, but I am pretty sure the defense will use her past to it's full advantage. I think if the crime was premeditated and carried out as planned it should be charged as an adult. Thats just my opinion. She knew right from wrong and from the charges this more then likely wasn't a accident.
Thank you, Dani_md, but think my questions weren't clear.....was wondering if the decision re charge as an adult was a debatable one or if the State petitions the court and a Judge renders a decision based solely on the circumstances of the crime.

sometimes kids go through phases and it's better to just let them express themselves and hope it passes. There are too many kids who obssess over the abercrombie and Hollister. Maybe these kids just want to be different and have their own style. I dress my daughter now because she is a baby, but when she gets older I will let her dress as she pleases (as long as it's not revealing and over the top). That way she can be herself instead of how someone else thinks she should be. Here there are a lot of EMO kids, but it doesn't mean they live up to the name. All the skater kids dress like that because it's their style. Black shirts, black hoodies, black skinny jeans, and black Vans shoes. Some have long hair and some have short.
I have an 11 (will be twelve in a few weeks), and she refuses to wear aeropostale, Hollister, Abercrombie. She likes blue and wants all her clothes in varying shades of blue.... but she won't wear blue jeans (says uncomfortable). Kids are weird with their clothes, sometimes I'm just happy if she has something she will wear at all!

JMO, it almost sounds like the girls grandparents had their hands full with this girl just by reading her twitter updates. It's been 15 years since I was 15 but I don't remember ever being in such a dark place.
This post caught my eye, because I recently when through something similar. My preteen son wanted to start growing his hair long and started wearing hoodies all the time (with the hood up). I looked at it as a phase, because he is a good kid. But then, he got in some trouble at school and starting getting really mouthy at home.
I told him if he 'looked' like a punk, but was really a good kid that was one thing. However when you start acting like a punk, that is another. His 'civil rights' meant nothing to me at that point. Off with the hair and no hoodies. Allowing him to grow his hair and wear the hoodies was a PRIVILEGE extended to him by his parents. The privilege was was taken away because of bad behavior, just like any other privilege.

Having been grounded from her cell phone is exactly what my theory was. I didn't see that post on her MySpace.
How sad is it that Elizabeth died over such a stupid thing? And the Murder 1 charge? It could me as simple as AB saying "Let me use your cell phone or I'll kill you".
Agree.....in urban areas this "simple" motive has been the cause for a number of kid-killing-kid crimes with varied items i.e. Ipod, a piece of clothing, sneaker being the cause.
Sad but this motive seems abnormally understandable (?) for a urban area yet not for a rural area......
