Nothing against the law in requesting a new GJ.

They are not like a jury. They get to ask questions and act as investigators so I don't know just how restricted they are in their conversations. Also they do not meet every day so keeping them away from the media is impossible.

Attorneys IMHO need to know the law & the application of such law before they spout trash or Tweet, yes Tweet!

Is this dude even licensed to practice in MO?! And about the change of venue to the more compassionate areas of St Clair/Madison Counties of IL - will never happen in a State case. Feds will have to prosecute themselves if the State/County doesn't

Yeah, I probably would have advised him to hold a press conference about it and call for a new GJ. Not a fan of twitter.

I'm sure if he has to appear before a court in this state he will be admitted pro hac vice. That's why he has local counsel. Don't know what you mean by more compassionate areas of Madison/St. Clair County. Would love to hear though if ya get a chance.

It was NOT good 'lawyering' because there were legal errors. One thing you hope from your lawyer is that he gives you accurate legal information.

It was good 'race-baiting' however. I am sure it has been retweeted a zillion times and his minions will be outraged if the 'prosecutor' does not immediately impound a new panel. Even though that is not what is legally required.

Well, I would hope that he uses better language in his legal briefs. Having said that, the message of the tweet is what any good lawyer would do. Let's reverse it and say the tweet was someone claiming they knew someone on the GJ and that there was already enough evidence to indict. You don't think that OW's attorney should be demanding a new GJ? I would suggest he should be.

As far as I know, OW hasn't had any of his civil rights violated.

I think some concepts are getting mixed up here. IF the tweet is legitimate and IF the grand juror spoke to someone outside the jury, that juror would have broken the secrecy rule. This GJ is not sequestered. There's no way, even IF all those things are true, for that to "taint" other grand jurors.

The tainting part comes from apparently having already formed an opinion before all of the evidence has been presented.

True. It is more accurate to say that, after the Jennings PD was shut down amidst controvery, OW was not one of about 7 Jennings officers that were hired by the County PD, some continuing to work the Jennings area.
