"Wilson is compromised as a witness," said defense attorney Nick Zotos, who opposed the request by Prosecuting Attorney Robert McCulloch's office to shift the drug case to a panel that meets behind closed doors.

The assistant prosecutor, who did not publicly identify himself in court, did not indicate during Brooks' hearing why the county wants to shift the case to the grand jury. A McCulloch spokesman said later that he was not familiar with the case.

Ed Magee, spokesman for St. Louis County Prosecuting Attorney Robert P. McCulloch, said that that cases are sometimes scheduled for the grand jury when a witness is unavailable. He said that no decision had yet been made in the case, but said that prosecutors would "take a look at it." Magee also said that the case could not proceed if Wilson did not testify.

Magee said that there are about half a dozen pending cases involving Wilson, and prosecutors would be making decisions on a "case-by-case" basis.

Wilson then ordered Brooks to get on the ground. Brooks refused and was pulling away, Wilson claimed, until Wilson pushed or pulled him down and called for help via his radio from other officers. Wilson reported that Brooks was yelling for his cousin to “get” Wilson.

A detective filed an addendum to the report saying that Brooks admitted that he had six or seven ounces of marijuana in the PT Cruiser, and that he sells it at $5 to $10 a bag to support his family. He also admitted that he thought the pills were Xanax, and he was also planning to sell them, the report says.

Wilson requested seven charges, including three drug charges, as well as resisting arrest and assaulting an officer.

Johnson has also been charged but has not arrested.

IMO, if anything, the way Officer Wilson responded during the arrest of Brooks helps his case re: Michael. The suspect resisted arrest and was charged with assault on LE. Wilson stayed calm, called for back up, and secured the suspects with only the force that fit the situation, in my read of the police reports.

Yes, I can see why the prosecutor wants the GJ to review it. What is so stunning about that report is that it clearly shows the anger and hostility toward police exhibited not just by Brooks, who weighed 300 lbs, but by some woman named Williams who blocked his way and yelled at him.

Also, Brooks' accomplice was Erik Johnson. I have to wonder if he is related to Dorian Johnson.

Ok, I was following this as it developed today. First, AP did a blip of an article stating the grand jury would get a second case involving Wilson today. Then, there was an update with the Zotos comment, and the info about the assistant prosecutor. Then, a separate AP blip was released about Towey being Wilson's attorney, and a little about his background. That article also contained the news that Wilson might speak publicly.

[James P. Towey Jr] is general counsel for the Missouri Fraternal Order of Police and a former general counsel for the St. Louis Police Officers Association...Wilson may be willing to publicly discuss the case in the future.

Good point. The hostility to police in that area is amazing. Now that you mention it, hmmm.

Also, there's a picture of Brooks where he looks pretty unhappy to me. I can't seem to grab and post it, but to me, it indicates they didn't see the switch to GJ coming, and he and his attorney aren't happy about it.

Yeah, I'm thinking Brooks could actually end up with dropped charges renewed or additional charges by appearing before the grand jury!

Exactly. In Brooks' case, Wilson is the arresting officer and would testify before the GJ as a witness for the state. The attorney thought he wouldn't risk surfacing to testify, so charges would be dropped at the preliminary hearing, but prosecutors outsmarted him and instead moved the case into the Grand Jury.

I saw the same pic on twitter. Brooks with his hand up on his forehead.

I know the judge gave the maximum possible time extension to this GJ for Michael's case, but given that McCulloch has said they think it'll wrap up around Nov, I wonder if some of the additional time could be for the GJ to examine these outstanding Wilson cases?

Brooks won't appear before the GJ, just his case will and ODW... unless he is called of course. jmo

Oh, and grand jury is definitely still meeting, so that shoots down some rumors otherwise.

True, but they do determine what, if any charges apply to Brooks.
