I wouldn't say he was suicidal but what does the bullet to the top of his head tell you?

That he was shot while falling forward.

Rather like....when one robs a store, the natural reaction is to take off with the booty as fast as you can, not reenter the store, to re-assault the clerk? Clearly, MB didn't operate in "natural" reactions.

I would have to watch the video again, because that is not my recollection of events. IIRC, MB had not actually left the store when the store clerk attempted to stop him, at which point he pushed the clerk away. Which seems like a natural reaction a thief would have, if someone was trying to prevent him from leaving the store after a robbery. Especially if the clerk was half his size, is unarmed, and he thought he could easily overpower him.

Not saying the stealing was right, nor the assault, but pushing away the store clerk seems logical under the circumstances. Running towards a hail of bullets directed at you does not. I believe military service members need to be trained to overcome the natural flight response when under fire.

(ETA: I just went back and re-watched the surveillance video, and MB did not leave the store and come back in to assault the clerk.)

Because they do not judge the defendant. Their duty is to decide whether or not the State has enough evidence to go forward to trial. Not the same as a trial.

And IMO, a lawsuit to release a non-existent record, based on a FOIA request that was denied for non-existence of the record, would be dismissed pretty promptly.

Iirc from the lawyers post here that ain't gonna happen. IIRC, I think it boils down to a family member would have to request it.

I guess b/c they look at many cases and the whole jury selection process and a jurors possible bias is relevant to a particular case?

Agree...also, when a GJ is seated there is no idea what cases will come up.

RSBM - In fairness, an open-minded and non-biased person isn't going to tend to side with either side until all the facts are known. I mean, saying one is non-biased and saying they are already siding with the officer kind of conflict.
Wish I could thank and like this post one million times. It is what I have been saying for days now. Wish I would have said it this way.

May have been...I'm not buying Brady's story much more than the others. Eyewitness testimony should be clean...so far, none has passed the smell test for me.

This isn't directed at you, just a general observation of those who believe the cop used excessive force. They built their belief based on eyewitnesses that have been largely discredited. Few have adjusted their belief for the lies, embellishments, and impossibilities of the first three, they just pick up the one that fits in the moment. Why didn't the other three see what Brady did and vice versa?

When I've been asked questions the other way, I've tried to respond. I've just been asked very few questions. Wonder why no one wants to discuss the tough questions...it's a phenomenon I've seen in the PP...as if acknowledging some part of the story is flawed means the whole thing is shot so they just ignore it.

I should have acknowledged your post when I said that. Your post is exactly where I was getting that from. What I was referencing is if McCulloch is truthful when he says it goes to a GJ every single time, then I have no issues with it. This case should be treated no differently than any other case that comes into his office.

This picture right here drives home the fact that anyone, including a toddler playing in their front lawn, could have caught one of these bullets. Does the environment you are in not play a role in whether to discharge your weapon?

I would be willing to bet that happened during the struggle. jmo

Ok, I understand.

I guess I was trying to say that this latest "relevation" is adding yet another version of the story to the list we already have.

Prior to this, all the versions said that OW backed up. Even the police chief stated this as fact.

Now all of a sudden, someone is saying, well no he never backed up. That actually the boys were blocking his path.

It just seems like lies are circling all around.

I dont think we should assume that he never backed up. Even if they were blocking his path at first, they could have had a verbal exchange, he moved on, then saw in his rear view mirror that they didnt move out of the street, AND maybe that they looked like the BOLO...so he backs up,and is getting out of his car, when he is shoved back inside...
