Thanks katy. So I understand...people are never arrested for felonies before a grand jury hands down an indictment. Many thanks.

Incorrect. It is not that they are NEVER arrested first. That only happens if it is OBVIOUSLY without a doubt, going to be charged.

I found this info about a NC police officer who was arrested before he was indicted for voluntary manslaughter of an unarmed man.

There's also a recent high profile case involving a private citizen who was arrested prior to being indicted - Justin Ross Harris (WS has a sub-forum dedicated to this case).

Apparently, it's not unheard of for a police officer or a private citizen to be arrested before an indictment is handed down.

The above two cases notwithstanding, I think Gray needs to remember that in order to arrest someone prior to an indictment, probable cause must exist.

Gray may believe personally that probable cause does exist, but probable cause must be supported by evidence, not just the shaky testimony of a few alleged eye-witnesses whose accounts may differ dramatically from other eye-witness accounts.

Looked to me like people were discussing the family's attorney calling for an arrest prior to an indictment or true bill of Wilson, meaning this case not theoreticals. McCulloch's office has laid out the process for officer involved shootings, including this one.

I wasn't discussing theoretical cases - I posted about 2 recent cases (one involving a police officer and another involving a private citizen) wherein someone was arrested prior to an indictment. Actual cases - not theoretical cases.

Personally, I have no problem with waiting for the decision of the St. Louis County Grand Jury. You won't see or hear me calling for Officer Wilson's head on a pike unless evidence shows that he acted unlawfully.

I was merely reporting the facts of due process, to wit: an indictment isn't necessary in order to arrest someone. Probable cause is all that's necessary in order to make an arrest.

Folks can decide for themselves whether or not they believe probable cause exists or whether or not they agree with the Brown family attorney. I haven't made any statement whatsoever about Mr. Gray's assertions.

PROBABLE CAUSE

The requirement, found in the Fourth Amendment to the Constitution, that must usually be met before police make an arrest, conduct a search or recieve a warrant. Courts usually find probable cause when there is a reasonable basis for believing that a crime may have been committed (for arrest) and that evidence of the crime is present in the place to be searched (for search).

In this case, for a crime to have been committed by the officer, the district attorney would have to KNOW that the officer was not afraid for his life. I don't see how he could know that, without doing a more thorough investigation. Especially if there was corroborating evidence, such as facial injuries, forensics in the vehicle, and witness who saw the struggle in the car.

But does not confirm what those records may contain.

Unless MB committed violent felonies as a juvenile, the records have no bearing (to me personally) on the events of August 9.

I have no idea why this is confusing. My post that you quoted was a response to your general information post. And, I and others were pointing out why we felt it made no sense for the family's attorney to call for an arrest now. Shrug

Police need to go on strike in Ferguson.

Unfortunately, I think then they might be sued and activists would shout that they're leaving the public in danger, see it just proves they never cared about this community, blah, blah
