Are you getting dizzy yet? I know I am!:okay: I suspect on friday we will be seeing some pretty lively discussions - and I hope the DT side is presented by Ann Finnell because I want to have a look at her "in action". :bigfight:

I always like to size up the competition even if it isn't me in the ring, heh heh. :slapfight:[/QUOTE]

Oh goody goody! I do so hope that we are treated to another powerful Power Point presentation on Friday.

Dear Judge:

1. The uniqueness of this case precludes us from following rules of discovery, or any rules at all!
2. Quite frankly Judge, my client has made statements that are half-truths. By our calculations that's 50% in our favor.
3. The reports from our mental health experts can be absolutely positively verified by my client.
4. Dont forget Judge, "death is different."
5. We only want to try this case once.

Sincerely,
The Defense Team

My dear Lambchop, that is most kind of you. No, I'm in the corporate world where i've sold my soul to the highest bidder. My boss doesn't think I'm that funny, but then I don't think he's that smart.

I haven't been here long, but I too find myself wondering who my fellow WS are and what they do. The brain power here is unreal....I am in awe.

They really, really want her don't they? :great:

I can only imagine just how much money charity would receive while she is on the stand. :floorlaugh:

Hold on to your hats, another motion has been filed. WFTV just did a story on the 5 pm news about a new motion, filed today by the defense. Basically it says that if the judge decided to let the State examine KC, the defense is going to withdraw their doctor's reports. so rather than let someone from the state examine KC, the defense has decided they don't want their doctors testifying in the guilt phase of the trial.:banghead::banghead:

I just checked the WFTV web site and the segment about the new motion is not up yet. I will post it as soon as it shows up. It just keeps getting stranger and stranger, doesn't it?

ETA: I have not found another media outlet that is reporting this. I wonder if WFTV got it wrong? did anyone else who happens to watch WFTV see this segment? If you did, am I repeating what I heard wrong or right? I hope someone else can verify this or I shall feel like a 'right ejeet"

Yes, there are some pretty awesome people here. You know I didn't think my boss was very smart either. Do you think the big bosses promote them just to keep them out of trouble? Just kidding. I've had some really good bosses, oh and some really awful ones, too. lol jmo

Quoted from this article:

"Orlando criminal defense attorney Richard Hornsby, who is not affiliated with the case, said Ashton is concerned the information is powerful enough to taint prospective jurors."

and

"Prosecutors call the information that Anthony revealed "remote in time" to the issue at hand."

So, something that happened to KC a long time ago (or whatever she revealed that's "remote in time") will be used by the psychologists with a hypothetical person and a hypothetical situation and they will testify that this could cause them to act the same way KC did during the 31 days? I wonder what she told them that the prosecution thinks could be powerful enough to taint a jury pool and the defense thinks would explain her consciousness of guilt actions.

If this is true, I suspect this decision to withdraw has KC's prints all over it. NO WAY NO HOW was she going to subject herself to a mental evaluation by the state expert. I have a lovely picture in my mind of her throwing a big ole hissy fit over it. I hope she was so frushtrated she couldn't schwallow.

Is that mean?

IMO the State is NOT concerned this is powerful testimony, they KNOW it's coming from a LIAR,only channeled through these drs.
Powerful testimony would come from someone CREDIBLE .

I like pondering what these two witnesses want to testify about...the defense is so funny...they want to come up with great reasons for KC's ugly coping, they want to blame George, they want us all to understand how truly lovely KC is. HA HA HA.

I love thinking back on Judge Strickland saying something along the lines of KC's psych evaluation being "indescribable" (or similar words). I would love to read that one.

7/22/08 Bond Hearing
Judge Strickland order a psychological evaluation (with Baker Act criteria) to be performed on Casey. Dr. Danziger is one of two Psychiatrists who will conduct the evaluation

the bond hearing when HHSS ordered the psych evaluation.
[ame]http://www.youtube.com/watch?v=ESjK7FSZV38[/ame]

He also stated., "her mental condition which I can't begin to describe"..........

0:40 ... nature and circumstances of the offense absolutely bizarre....

0:58 ...basically includes a confession from her that she lying about the investigation...

1:26...employment history is beyond spotty...I'm not sure she has worked as an adult...

1:33...her mental condition, which I can't begin to describe, and I'm gonna order a psychological evaluation ... of course charges haven't been filed, I think I can still order a psych eval, anybody want to be heard on that?

Baez - not at this time Judge
Judge - order a psych eval by Dr. Jeffrey Danziger and Dr. Alan Berns to determine competence, whether or not they can shed any light on her thoughts

2:20 ... her past conduct regarding her daughter, is strange and her treatment, I don't know much about her treatment of her daughter, but her past conduct is difficult to describe, and I guess my problem is the conduct is continuing, up to and including this trial .... I have a problem with her continuing conduct

3:14... the facts that are real, real troubling are the deputies testimony about the canine cadaver alerted on the car and then again on the backyard - that will keep me up tonight, I have a real problem with that ...

3:50...I have a problem with her conduct hasn't changed per se and she hasn't been a help in this investigation, not a bit of helpful information has been provided by Ms. Anthony as to the whereabouts of her daughter,

4:00... I would point out that the truth and Ms. Anthony are strangers

4:37...willingness to hinder the investigation

Sure, most likely all lies but still, the prosecution does not want it out there. After it's said and done and out in the public, it would be like unringing a bell as far as the prosecution is concerned. That's what is meant by "powerful" not that there's any credibility to her statements.

From the motion:

"The potential prejudice that would result from the premature discussion of these opinions could not be overcome by any instruction by this court, should the opinions ultimately found to be inadmissable."

Kathi is incorrect in this video report when she says the Defense experts have NOT examined the Defendant...they HAVE examined her.

Kathi is confusing Ashton's statements in the Motion in Limine with the Motion for Examination by Mental Health Expert (which was filed first)

- 04/12/2011 Motion In Limine as to Testimony of Mental Health Experts

http://www.cfnews13.com/static/articles/images/documents/casey-mental-health-0412.pdf
4. The reports indicate that the opinions of the experts are based entirely upon statements made to them by the Defendant.[implied - when they examined her]

- 04/08/2011 Motion for Examination by Mental Health Expert
http://www.docstoc.com/docs/75720807/20110408-SA-Motion-for-Exam-by-Mental-Health-Expert
2. "The reports of those experts, and their partial depositions, reveal that their opinions will be based upon their examination of the Defendant.

My guess and always has been to blame her parents for why she was afraid to tell the truth. She has been brought up not to show emotion it is a sign of weakness, yada, yada, blah, blah. Afraid of her mean ole daddy ex-cop.

The defense has always known her behavior, lies, bs in general are detrimental to how the jurors will see her guilt. Given the testimony of these health experts it won't help imo. The jury is still going to see the phone calls to home, jail visits, etc. that show Casey for the kind of person she really is.

I'd love to see Casey on the stand questioned by JA or LDB explain why she wasn't afraid of robbing them blind, with holding Caylee from them over arguments, cussing her mother out, etc. Just what did she mean when she say she was a spiteful biotch to Lee?
