Motion In Limine To Exclude Mental Health Experts

Hold on to your hats, another motion has been filed. WFTV just did a story on the 5 pm news about a new motion, filed today by the defense. Basically it says that if the judge decided to let the State examine KC, the defense is going to withdraw their doctor's reports. so rather than let someone from the state examine KC, the defense has decided they don't want their doctors testifying in the guilt phase of the trial.:banghead::banghead:

Now that's cool with me! That is exactly what Bill Scheaffer said they would do if the SA's expert were allowed to examine her. The DT know she is a loaded shotgun and would just love to get her in front of their experts. Can't you just see it? Giggle, hair flip, blah blah giggle giggle, oh yeah and blah blah adjust blouse preferably to tuck in, flex shoulders and rotate shoulders back, pick lint of off pants and flip hair again blah blah blah giggle and an under the eyelashes peek up. :innocent:

You are right. Kathi never had the gloves on. She was the reporter you could hear asking KC "Did you kill your daughter?" on the day JB picked her up from jail and took her home after she was bailed out. Kathi takes no prisoners and never has! :rocker:

IMO the State is NOT concerned this is powerful testimony,they KNOW it's coming from a LIAR,only channeled through these drs.
Powerful testimony would come from someone CREDIBLE .

Asking for a general consensus here because I've always wondered if anyone else thought Casey looked a bit like a loon in those pics where she was first arrested wearing that blue hoodie? I can't help but wonder if she was on drugs because she looks like it to me. I've read a good deal of info regarding people with mental conditions abusing alcohol and/or drugs and it intensifies and worsens the mental condition. This may not have any bearing on what the health experts are going to discuss. I kind of thought of the black out or seizure excuse being a possibility for her to say she doesn't know what happened to Caylee.

I just checked the WFTV web site and the segment about the new motion is not up yet. I will post it as soon as it shows up. It just keeps getting stranger and stranger, doesn't it?


ETA: I have not found another media outlet that is reporting this. I wonder if WFTV got it wrong? did anyone else who happens to watch WFTV see this segment? If you did, am I repeating what I heard wrong or right? I hope someone else can verify this or I shall feel like a 'right ejeet"

I heard this earlier also... but dang... now I don't know what station I was watching. I'm guessing it is probably correct though...... and most likely was WFTV.

I don't think so, ZsaZsa. This one was filed yesterday. The one Macushla and I heard about was filed today right before closing, and was something about the defense would rather withdraw their request to add the doctors to the witness list rather than to allow the State to have their own expert examine ICA.

The defense must really be worried about what ICA might say.... Cause even they know she likes to talk.

ETA: Right, Macushla? That's what you heard, too?

I've always thought so, pills, Xanax or Hillbilly Heroin. She could have just started meth just prior, that would 'splain some things, too. There are several drugs that would be out of her system by the time she got her drug test. She even passed marijuana, which hangs up in you like a block of cheese and a pound of biscuits...takes at least a month to disappear yet she passed when we know she was toking.

There is a pic of KC as a child where I think she looks a little looney, too, like she can't go outside without a helmet, but it is a hyperactive craziness look, not psycho killer loony-face. And maybe she gets manic.

It sounds as if Ashton is asking that the information not even be discussed in court on Friday. Do you think he feels it is powerful enough to taint the potential jury pool? I am also confused as to why every other statement (including letters and videos) can be heard but not statements made to the MD's?? If the defense was shady enough (which I beleive they are) who is to say that can't have KC just write a letter stating the same facts to her parents or another inmate in order to get the statements into record? Perhaps that was the point of the molestation claim in her letters to Robin. She seemed quite chippy on the days the state filed new discovery of those letters and the defense never objected to them being admitted. They have objected to everything else so far, so that was a red flag for me back then.

Ladies and Gentlemen of the Jury. We have a tragic story of a young mother who was on the computer while her daughter was taking a nap. She then got up and went in to check on her and found her bed empty. She became hysterical running around the house frantically looking for her. Not finding her in the house, she ran into the backyard. To her horror she found her beloved daughter floating in the pool. She jumped in and pulled her out. She began CPR. To no avail. She lay her down in the backyard not knowing what to do. She began to call her mother over and over and she would not answer.

At this point, because Casey had been on computer surfing and not attending to her daughter her mind began to race. She was afraid, that once again her mother would blame her for being a bad mother. Like she always had done. Nothing was ever good enough for Cindy.

Ladies and Gentlemen, let me now explain to you what happened in the next month. Casey's mind snapped. She finally was the worst mother in the world as her mother always opined. She went into a fugue like state. Her next actions were completely dissociated from reality. She was in a dream. She covered the whole incident up. She wrapped her daughters body up in familiar clothes and cloths from home. She had no idea about decomposing bodies and was astounded at the rapid rate her beloved daughter's body changed. She frantically placed tape around her facial orifices to keep them from leaking and placed a final kiss goodbye on her mouth in the form of a heart-shaped sticker. Then she placed in the final resting place of her beloved pets from when she was a child.

Still in a state of shock, she reverted back to the age she was before she became pregnant and delivered a child. Back to the carefree days when she worked at Universal, becoming independent and earning her own money. Back when she was happy. But then she would meet a man, slightly older than herself, with a child already. She fell in love, he only to completely reject her. She found herself pregnant, dejected, and like many a young woman in this circumstance in denial of her pregnancy. Thus, began a terrible beginning of dissociation from reality and fantasy. Universal was her first found freedom. Universal is where she found severe pain. She would later return there, one day, terribly with the police.

The next month, she lived as that young 19 year pre-mother days. Like any normal 19 year old would. She lived as she had no memory of being pregnant, giving birth, being a mother and the tragic accident and what she did to cover it up.

Facts will show that in this month she went out to clubs, had dates with boyfriends and got a tattoo. Normal 19 yr old activities. However she found herself without money, and reverting to the dissociative state, used another's checkbook to buy normal everyday teenager items.

Even when all came to light and police were involved, she actually took them to the Universal studios as if she herself still believed she worked there, like when she was 19. As police continued to question her, she went in and out of this dissociative state, not able to admit the horrific events of that terrible afternoon, finally resorting to a telling herself and her mother and the police of a of a beautiful, capable nanny that she allowed to babysit her child to cover over what Cindy would surely accuse her of being a neglectful mother. She might have even believed this nanny was real to compensate for her own shortcomings as a mother.

What we have here is a young woman, so afraid of her own mother, so insecure of her own abilities at being a mom herself that when this horrible accident occurred she completely reverted back to the days before her precious baby girl was born. She literally blocked it out because reality was too horrible for her to face.

Fellow citizens, I will show you that much like the harried mother who unwittingly left her baby in a overheated car and was later found dead, Casey is in her own personal hell and will never forgive herself. What this suffering young mother needs from you is mercy and not condemnation.

I agree with what you are saying Capri - it looks like he does or same old same old - but my question for you is - I see Baez signed this motion - but do you think he wrote it? All those big words and supporting case law??

Why wouldn't Finnell sign it?

My post was confined to my initial opinion that if these Doctors are merely going to repeat statements told to them by ICA .....that would be hearsay.
It had nothing to do with the State's request to examine her. Im not finished reading that one yet .

Hell's Belle responded by posting an exception to the hearsay rule, i.e. "an admission against interest". That imho didnt fit here as surely ICA is offering these experts to testify on her behalf and essentially to rebut the State's assertion about her conciousness of guilt. :waitasec:

Okay krisskross - this is me acknowledging I was wr...mistaken in the first part of the defense response to the states motion, but I was right in the second paragraph, and I think we can agree that by the end of the third paragraph we have no idea what Baez is trying to say.....:waitasec:

Look HHJP - Mr. Baez is trying to ease your workload - by giving you a multiple choice document. He's done everything except put the little boxes beside each suggest and the comment that says only tick one box, sign and return to sender at your earliest convenience. :great:

The defense filed a motion late Tuesday, saying the state of Florida does not have the right to conduct a mental evaluation, since they are not using it as a defense.

She's drunk on attention and her inflated importance IMO and hasn't yet realized that the world isn't as gullible as her parents or that she's on tape stealing her chest enhancing blue hoodie. She's glowing with pride.
I don't believe the mental health experts will be called. They were added late, the state will get to use their own and the DT doesn't want to play that discovery game. Not to say she isn't a total thesis on abnormal psychology. She is. She just isn't unique that way. Jails are filled to capacity with deviants like ICA IMO.
