The threating suicide in winter of 08, I would think, is hearsay - unless he sought counseling, I guess. After reading the petition, I was under the impression that he had no choice. I wonder if they had a will that stated anything about custody.
Hearsay, in good faith, collectively with the other facts in the petition, is admissable for this proceeding.

I don't really know what "organizing" could entail especially since Nancy was a SAHM - the house couldn't be that far out of whack do you think ? haing just returned from a vacation with her folks though it is possible Brad was just a slob and the house was a mess when she returned.
That could very well be true ~ I can imagine what it would look like if he was a slob. But what I can't quite see is her having someone over to do it over the weekend while he was at home. Not that I don't believe her friend though. :)

Yes, law was originally to be in place Jan 2008, extended to Jan 2009.
I believe the children would be dual citizens-American by birth (if indeed born there) and Canadian by parent's nationality.
Minor children, if not traveling with both parents (passport and birth certificate shown) to most countries would need permission from the parent not traveling with them. Notarized form given permission for minors going to Canada with only one canadian parent.

I have traveled with our minor children to many a country, as well as my hubby(dad) taking them abroad alone...and it is an absolute nightmare with the paperwork especially when all in our family have multi-citizenships from different countries!

Wow...I bet it is a "nightmare". Thanks for taking the time and trouble to find and post this info Petra. One small point that I didn't know - it appears to have been extended to June 09.:)

Yes, maybe the clothes were nearby, or not quite what he described. After Scott Peterson, I just can't imagine anyone else being so stupid to give a description of clothing and have it turn out to be something so entirely different. :eek: I too am beginning to think this was more premeditated instead of a heat of passion/argument killing with these details coming out. He might have been sitting at home while she was out at the party getting angrier by the minute and just waiting for her to get home. At least the little girls are now with Nancy's family ~ a very nice surprise that the judge ruled in their favor. It really seems to me that he is the #1 suspect for the judge to make this ruling.

ITA and if any staging was done to make it look like a random act it would seem the clothes would be somewhere where LE / the searchers would have found them (or will find them if they've not already). The more I'm reading partially clothed the more I'm thinking it indicates exactly what it says (with the media being aware of what she was supposed to have been wearing, it wouldn't make sense for them to phrase it this way otherwise). This is something I most likely opted *not* to realize because it is so degrading :mad:

If this is a man was attempting to control every aspect of his wife's life, I'd say it's safe to bet that he was hugely angry that she was out enjoying herself with other people. While he was forced to stay home and watch the children. And if speculation is accurate that she may have been getting ready to make a move, that anger would be even stronger and it's possible that all logic and reason went out the window. The fact that the most dangerous time for an abused spouse/partner is when they're leaving says a lot...

Omgosh, me too! :D I don't understand still with all the recent upgrades etc why the board can't handle a larger load. I think someone mentioned email notifications to subscribed threads, but there must be a fix for all of us that want to stay up to date on these crime threads!!!

I've been finding it very slooooow today. Thought it was my computer. Posting has been frustrating.

OMGosh!

This happens more than you know. Many of us are always yelling at our tv screens when some of these TH's come on. We DO KNOW more than them, LOL.

You shoulda' seen us when the SP case was in full swing. We had access to the actual transcripts, albeit a day or so late, but true testimony none the less. We'd sit here and listen night after night the TH pundits putting down the pros and how stupid they were, yadda, yadda, yadda. A day or so later we'd get the transcripts and we wondered if they were attending the same trial we were getting the transcripts of. They couldn't read into the pros purpose of many of their witnesses but we could!

Thinking about it - he could have been getting angry. Jessica Adam said that Nancy was going to help her paint and then they were going to go "organize" Nancy's house. Wonder what that means exactly ? The house in Lochmere or had Nancy found a new place to be I wonder ?

That is a very strange word isn't it? I don't know if she would have found another place. Wasn't she planning on going back to Canada?
Just out of curiosity, since they are both living in NC because of Brad's job. If they separated or divorced, would she be forced to leave or could she stay because of her American born children. Do you know RC?

I really don't know but I have heard that NC requires a one year separation prior to granting a divorce. Don't know if this means she could move away to Canada or not. But I am wondering - did they marry in Canada ? If so how could NC impose it's will on foreign persons who were married outside the US ?

Yep it's true. Been there done that.

I don't know about divorce when a spouse is out of the country though.

I wonder about that comment too. Assuming he was going to be home all weekend, how could they be talking about the house Nancy shared with Brad? That doesn't make sense given the information we now have about his disposition and not even giving her enough spending money.

I posted earlier I think the painting was a ruse and they were either going to retain Nancy's lawyer or find her a new place or both. Regarding the organizing, Im sure that was for her new pad.

As a legal resident of NC, the marriage is recognized under NC law after 6 months.

It would depend on her "citizenship status" whether it was on Visa or if she had applied for citizenship, I feel like she was resolved for at least the interim, she was going to have to be in NC long enough to get the legalities over with.

I think so too. I also believe the friend knows more, even though she has practically denied it to the media, that alerted her to call LE so soon. It would make a lot more sense for her to be so alarmed that Nancy didn't show up if the plans were indeed to do something other than painting, imo.

That's correct, legally, you must file in the state of residence of one or both parents that has been a resident for 6 months, and the preceedings and jurisdiction is maintained there. That only changes when both parents move and then the jurisdiction goes to the parent who has primary custody or what's called the "home state" of the children.

I heard from my friend who lives 1 mile from where Nancy lived in Cary. She said she has spoken to friends of Nancy's friends (so still heresay) and they have pretty much confirmed Brad was definitely having an affair, that her friends knew about it. She says everyone in their community thinks the husband killed her. She did say police there are being very careful about info they let out and everyone feels it's because they are building a case against BC.

Not anything earth-shattering or new info, but just interesting to hear someone's take on it that is right there.

Oh and too, if BC did go to the store to buy bleach at 2-4am as speculated, that means he would've left 2 children under age 5 at home alone if Nancy was already dead, which she probably was.

I wonder if the police do have confirmation BC did do this and that helped in getting the family temporary custody of the children because if that is not child endangerment, then I dunno what is.

I suspect this is true - LE building a case against Brad. The reason I say that is there is no plea from LE for information posted with the media outlets. They have a firm idea of who they believe did this - not random, isolated they call it. The only problem is I hope Cary LE does not fall into the trap Wake County did with Michelle Youngs murder. They created their own trap by demanding silence - silence in the press, silence from witnesses. As a result - people who may have had information concerning the where abouts of her husband never even realized they may have had pertinent information.

I pray this does not happen in this case because honestly - it is a total injustice that Michelle Young's murderer is free as a bird and moving on with his life and still has custody of the child and refuses to allow Michelle's family contact with the child. LE messed up taking the silent route IMO.
