Don't worry about it. Prior sworn statements can be admitted, but only if the witness is not present to testify -- can't be subpoenaed or something -- like somebody died or disappeared. LE's statements are good too. If that happens, usually the lawyers will stipulate to expected testimony and draw up a document on what they agree the witness would have testified to -- that can be read to the jury.
You know that the prosecution will want Tony on the stand at trial, won't they? And why does the defense get to interview them when the State has already done that.
I don't understand this really. This isn't done here in NC.

It didn't seem strange to me at all. Maybe it has something to do with this being a capital murder case?

Kobi needs to pull his head out of Baez's butt!

He must have not read the same document that I read because I could have sworn that they did rule out animal decomp (i.e no dead squirrels) as well as rotten pizza.

and he knows danged well that mtDNA nails the hair with the deathband as coming from a relative with the same maternal DNA and since no one else happens to be missing from the As immediate or extended family that could have possibly been dead in KCs trunk, you do the math. 2 + 2 = 4.

Are we the only people in the entire world that have any common sense?

Both prosecution and defense have to prepare for trial. Therefore, both of them have to interview all of the witnesses they expect to call and that the other side expects to call. If it is a very important witness or an unwilling witness they will use a deposition, given under oath, in addition to a regular interview.

Lawers are taught: "Never ask a question in court that you don't already know the answer." Otherwise, you might get a nasty surprise in the answer!

Are these people deposed in court?
Usually the deposition is in the lawyer's office or in a local court reporting firm's office. If they are using the courthouse building, then they must have a lawyer support services room there and court reporters to take the testimony. Yes, it is under oath. Depositions are just trial preparation and they are under oath. The deposing counsel is the one who sets up the deposition for their use. The opposing counsel gets to be present. The judge is not present. A deposition is not done in a court session.

I hope and pray that the 12 people on that jury all have some sense, and are not easily bamfoozled by Kobe's crap!

Being on the defense side now has turned Kobe into a complete idiot!

Yes those scientist even did their own testing on pizza. Kobi lost his common sense when he got hired by the defense. He reminds me of Geragos after the Peterson's hired him to defend Scott, he also got very annoying.

Hope they do, but my complaint about TRU TV is that since they switched from Court TV, they quit trials so early, at two pm where I live which is annoying, but it would be interesting to see this on TV, we shall see.

3pm here & it is annoying cause than u get recaps of what was missed. I'm going to check if there site has a live stream that dosen't cut off. If I have time tomorrow I will check that out after 3pm to see if it continues the case they r on now. :waitasec: KC'c case will be very interesting for us WS's who have researched this case every which way!! :woohoo:

During the previous hearings, Fox News Network started with it for a few minutes, but it could be streamed live also. I streamed all the hearings, which is nice because you have them for later use.

I like Balfour's mom. She has chutzpah!

But she lies. Her son had cocaaine in his vehicle and she claims that doesn't equal possession. She says he stole a car. He CARJACKED it - BIG difference.

Kobe is out and out lying. He said the FBI report said it COULD be human decomp. That is true, bu8t then Kobe says it could also be animal decomp. I thought the FBI ruled out animal decomp.

Also he disses the cadaver dogs when he lauded them early in the case before he was hired. He specifically said that cadaver dogs are trained to alert on two decomp chemicals, putricene and cadaverene (sic) and ONY human flesh decomps to those chemicals. So Kobe is now an officdial liar along with the rest of the defense team.

They did rule out animal.............He is either TOO STUPID to read the report or he is deliberately lying. Either way he is a fool, because both will come back to bite him in the butt in court.
