Yes, but at least the scene was still taped off and there was a LE officer there, so defense couldn't use that to get out of a conviction. (Thank goodness in that case!)this same investigative pattern of repeat visits to the crime scene by LE happened during the idaho 4 investigation, from what I recall, MOO.

If the sheriff was just pulling a bumbling, "yeah we probably shouldn't have released it so early, that's Monday morning quarterbacking, I make mistakes, I'll probably make some more" act, he pulled that off well!If they are doing it for a strategic purpose and they still retained control somewhat of the scene after “officially” releasing it (for example if they planted cameras), I think they/prosecutors could probably effectively defend it. I mean a defense attorney absolutely will still pounce on it, but if they can lay out the logic behind doing what they’re doing, it might be salvageable for a jury.
If they can’t, then yeah, absolute win for the defense
