We're getting closer to some real testimony -- I understand & respect chain-of-custody testimony, but it is really boring testy-mony.

I know and chain of custody is very important and must be done in a trial.

It is so boring for Trial Watchers. imo :waiting:

Can't help it if I love NC trials!!!

So much more better than another state...I didn't think this started till Monday.

Welcome, zoey -- it's great to have you with us!! You really haven't missed much. Opening stmts are pretty brief; the 911 call is nearly impossible to understand due to hysterics and the caller is, IINM, Indian and his English isn't very good since he has just walked in on poor dead Mahato. There was a showing of crime scene pics most of which we couldn't see of course; testimony from a verrrrry borrrring crime scene analyst who did not want to be there (retired); and endless chain-of-custody testy-mony.

So you're really in pretty good shape.

What's worrying me about this case:

We've heard, in the PT opening, that there is not a lot of fingerprint or DNA evidence. And some jurors (and I've even seen it here from a few Sleuthers) live & die (not literally, of course) on DNA. No DNA, no conviction -- I want DNA, they say... Almost as bad as, "All we've got here is circumstantial evidence." Well, as many of us know, criminal cases would never get to court without circumstantial evidence. But that's for another day... Another but: I don't know how much circumstantial they've got, either...

Well, we know that Shanita Love (she was the GF of co-convicted Carson murderer Mario Atwater at the time of the crime) will be a big witness in this trial -- although some testimony may be precluded. She was a good witness in the Carson trial, IMO, but she has been in a little trouble with the law -- "Wanton Inj Per/Prop GT $200 (Principal) 10/08/2005 Misd."

Anyway, this bothers me. The DT can't go after her record too hard, IMO, but they might be able to shake her up. She was strong on the stand, IMO; received no reward of any kind at the time, although I thought she deserved a hunk of the $25,000; and she led them to where they dumped the weapons, etc., etc.

But is she all they've got? No DNA, no fingerprints, and the sky is falling, the sky is falling -- it only takes one Chicken Little, er, um, juror.

But: Lovette was found in possession of some of Mahato's property -- and that is BIG.

So, I need some re-assurance.

Watching Shanita's direct testimony during the Mario Atwater now. She appears to be a good witness. Looking forward to seeing how she holds up under cross. My knowledge is vague on this trial so hope I find find the archives to catch up. Thanks for the link Borndem.

I remember the big "C," and I remember wondering what the heck it was -- never found out what -- I figured it was from some brand name (like the Gap "G" or whatever), but I never knew what it was.

Everytime I start listening to testimony in this case and I start thinking about the terror that Eve Carson must have felt knowing they were not going to let her live, it becomes so real and chilling, I actually have to stop.

Almost the same for me, Justice -:hug:- and my DH still gets very angry & upset about it when I even mention the name Lovette. The Carson case affected him 'way more than any other -- he doesn't really watch the trials, but he knows when I'm watching one that has occurred in this area -- and he'll ask how one is going from time to time. I was watching the Carson trial again two weeks ago, and he listened to a bit of it.

Similar to what you said, JF, I often wondered during her ordeal with those less-than-humans when -- how quickly -- she realized that she wouldn't survive. I am glad her faith was strong, but it's unimaginable to me. The DP, which each avoided in his own way, wouldn't have come close to matching what.... I can't say anymore.

Now we need to add more years to his LWOP -- there can never be too many for someone as cruel as he.
