No. 2 jail house informants who didn't know each other said that TS told them he hit MHJ first. Smith knew she would die if he kept attacking and he continued, along with Anthony, 18+ times. That proves premeditation.

1 hit & she died could be argued 2nd degree, but not at least 18 separate strikes. Even if he didn't do any of them he would still be guilty.

That's kinda weird...Isn't it usually the opposite? Prosecution, defense, prosecution? I guess it varies...

Snipped me bolded by me. Madeleine, did Ms. Dee say that? If so, I missed it, am having trouble paying attention to her. But if the informants said that, that's very damning, along with all the rest.

No, Dee didn't say that. State will argue it. They said it during their opening statements.

Defense didn't put anyone on in their case in chief and so they get a tactical advantage by doing so, specifically be able to argue last to the jury.

So, this defense attorney, Phoebe Dee, did the following:

- admitted her client lied to police in his statements
- admitted her client was there that night, breaking into cars with the others
- had blood drops on his shirt after the murder
- washed his hands with the stolen bottled water, along with Anthony
- made the statement, "what the hell just happened here," which proves Smith knew something really bad had happened and he knew it because he was there! Testimony is that everyone was quiet, no one was talking after the crime even up to the point they got into the motel room, so why would Smith think something bad had happened?
