She said in the police report that she had stabbed Mr. Daye 3 times and she thought he was dead.


Sounds like, ummm, errr, something-or-other in the 1st Degree to me...

One of the alternate jurors told the judge that a gentleman on the jury had mentioned that the city of Durham's reputation was on the line.

I did a short transcript of the judge speaking to the alternate juror as she explained her issue to him:

At about the 4:05 minute mark:
Well, yesterday when I went in—I was the last juror picked—uhm, we were sitting down; and this one gentleman kind of took charge and said, you know, “here is what we should do”. And, uhm—you know—as a team; and, uhm; just looking; he rambled a bit; but, ah, what I got out of it was that we should, umh, be concerned about Durham’s image. You know, we are representing Durham; and, uhm, there was reference to another trial. It wasn’t specifically said what it was, but another juror didn’t know what it was and then somebody else said, “Well, we took a survey.” You know, you know. And I don’t know if it’s this—uhm--if felt a little bit uncomfortable about it. He just mentioned something about politics and how we are representing Durham; and—you know—what is going to happen afterwards; and I got out of it, we need to really do a good job for Durham. For Durham’s image.

I am surprised that the judge left this juror on. He obviously, to me at least, has admitted that he is not objective. Could be an appeal issue, imo.

She is denying being drunk but I suppose in her world even medical test results are lies.

Is it that she doesn't know the difference or that she doesn't care?? JMHO

Yes indeed, Chelly. I worry about the jury's take on this -- especially if they don't know much or anything about her past beyond what they've heard on the stand. And this group shouldn't have or they wouldn't be up there.

CM no longer knows the difference between yes or no, do not know if I can say this, but I found it painful to watch her testimony towards the end. Did you see how confused she was when she was standing by her atty and the judge was asking if she understood the reason for the proffer of the door expert ? If testifying was her last ditch effort to get out of jail on the free card....all is lost, thank heavens.
As for the juror that is hoping for Durham to "look good". Well, good luck with that, buddy.

I need this lunch break to fix my glasses, sat on them.....didn't feel a thing!

I missed yesterday, for the most part and viewed it on the WRAL site. I can't believe the amount of FF I had to do, to keep from falling asleep myself.

Bond, the LE testified yesterday that Ms. Magnum's lips were very dry and there was a scabbed-over yellow something on the lower left? lip which was a bit swollen. Other than that, there was a teensy, scabbed-over scratch below her eye. Zero injuries from being punched 10 or 5 times, depending on whether she was talking to the EMT's or the jury today.

She sure had a lot of hogwash going on this morning and everything she said flew in the face of prosecution testimony! Now, the defense wants their DV expert to explain why battered women don't remember things correctly. Oy vey!

I would love to see that little bit come in if I were the prosecutor. Then, on cross, I could ask her if that was why Ms. M. conveniently testified to pure and blatant baloney on the stand, ie: she is not a credible witness.

Oh, and HI! Good to see peeps following this little 'ole trial. JA, Jr.

No mention, so I'm assuming they never got a blood sample. She was very uncooperative and she refused to speak with Bond a second time.

Great job, Ms. Prosecutor! Goes right to the heart of the situation. Men can be abused as well. At least SHE admits it, unlike some other DV expert we have seen.

Expert didn't verify any of what Crystal said about being sexually abused as a kid with any other family members. How the heck is that being thorough and investigating to come to any informed decision?

Yes, she met him in January of 2011, and moved in with him in February of 2011.

She stabbed him on April 3, 2011.

(She was living with him about two weeks after meeting him while he was doing some painting at her girlfriend's residence. In another part of her testimony, she states that she knew him previously while he was dating a friend.)
