"You have to understand that obviously the defense attorneys would probably prefer to try the case against somebody who is less experienced than I am, or get somebody who is less committed to the case than I am, and you can certainly understand that. I mean, if I were one of those attorneys, I wouldn't really want to try a case against me either."

Excellent find Wudge and well worth the read. The case against Nifong is laid out perfectly while not assuming guilt nor innocence fo the players.

Thanks but I can't take credit for it. It's someone else's words but I haven't been able to find out who originally stated them so I can give them credit :(

DURHAM, N.C. (AP) -- The district attorney prosecuting three Duke lacrosse players charged with rape acknowledged Friday that he erred by openly discussing some aspects of the investigation, but he urged voters not to judge him by one case alone.

"My handling of the media coverage of this case has occasioned substantial criticism, some of which is undoubtedly justified," District Attorney Mike Nifong said during a half-hour news conference.

"I both underestimated the level of media attention this case would draw and misjudged the effect that my words would have. That having been said, this case remains a Durham problem and it demands a Durham solution," he said.

Nifong beat two challengers in May's Democratic primary, and he has no GOP challenger. But a petition drive that drew well over the required 6,303 signatures put another Democrat's name on the November ballot, Durham lawyer Lewis Cheek.

Cheek, who said he was approached by people dissatisfied with Nifong's handling of the rape investigation, sees his presence on the ballot essentially as a way for voters to reject Nifong. He said Thursday that he wouldn't serve if elected, meaning Gov. Mike Easley would have to appoint a new district attorney if Cheek won.

Nifong addressed that effort Friday.

It is if that case points to a DA who is using his elected position to incite race & class division in order to garner votes for himself. And it IS just about one case if he has lied about that case and proceeded with a prosecution when he knows that the AV lied and the three men charged are innocent.

His behavior in this case, in most people's minds, will be indicative of his personal code of ethics and cast a pall of suspicion over how he has handled other cases in the past. It doesn't reflect well on him. He is running on his experience yet he admits that he was wrong in his statements to the press. So in other words, he is saying that he knew better.

I find it humorous that he bemoans the fact that if he loses, the governor will choose a replacement. However he sees nothing wrong in using brainwashing, race baiting, class envy, and manipulation with lies and half truths of the voting public to win. Is this what he thinks is "letting the people decide?"

People of sound mind who have a good moral compass will see thru what he is doing and not vote for him. Others know what he is doing but don't care. The end justifies the means.

"In examining the files Nifong has produced in the case, The News & Observer found that the accuser gave at least five different versions of the alleged assault to different police and medical interviewers and made shaky identifications of suspects. To get warrants, police made statements that weren't supported by information in their files."

Is the News & Observer first figuring this out?

Another interesting thing in the article was her original descriptions of the rapists. They seemed to be all chubby guys. Finnerty if you recall is tall and thin. Her physical descriptions do not match the 3 guys she picked out.

You won't find a chubby lacrosse player. Most, if not all, of these guys are lean and muscular.

The N & O printed this correction to the story I posted earlier:

"CORRECTION


This report on the Durham lacrosse case Sunday contained an error involving the timing of a discussion between District Attorney Mike Nifong and Investigator Michelle Soucie.

On April 4, Nifong instructed Soucie to nail down what the accuser in the case had done on the day prior to the alleged rape. That was nearly two weeks before the first two indictments in the case.

This error changes the implication of the first five paragraphs of the story: that the conversation between Nifong and Soucie was an example of the words and actions of police and prosecutors outpacing the facts in the file.

The error does not affect the accuracy of the remainder of the story, which reported gaps between the prosecution's words and its evidence. We regret this error."

"The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.

Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations."

You've got to check out the photo of Elmostafa in court with the two officers who are working on the LaCrosse case looking on. Look at the expression of the officer on the right as he looks at Elmostafa. I'm trying to think of a better caption for it. Elmostafa looks like he just heard something humorous but the officer doesn't agree.

Two more DNA's were matched to Duke LaCrosse players who lived in the house where an alleged rape took place.

"One of the DNA samples, semen recovered from a bathroom where the woman said she was raped, belonged to Matt Zash, a team captain, his attorney said Tuesday.


Zash, who has been eliminated as a suspect, apparently was watching television in his room while the March party went on. Nifong has said that none of the state's evidence implicates any player other than the three who were indicted earlier this year.

"The fact that Mr. Zash's DNA in any form was found in his own bathroom is evidence of nothing related to his case," said Kerry Sutton, Zash's attorney.

Another specimen matched to Evans was recovered from a towel found in a hallway near Evans' room and the second bathroom in the house. The towel also contained DNA from another person, and SBI testing has conclusively determined that the second specimen did not match the accuser or the 46 members of the lacrosse team who submitted DNA samples, Sutton said. "It seems to me that the state of North Carolina has spent thousands of dollars to prove that a young college man's DNA is in his house," said Brad Bannon, one of Evans' attorneys."

Excellent article/opinion piece that focuses heavily on one of the police officers in this case and his inconsistencies with his notes in this case. Ran across this statement in the article:

"A toxicology report that the defense was informed of last week was negative for any date rape drug in the accuser's system," Chesire tells me.

Didn't Nifong say that there was no toxicology report? Now the defense is notified just a week ago? Where was it? Stuck in someone's "IN' box? Good grief!!

After my relentless search for records, and reports from the Durham County Sheriff's Department concerning my brothers death, a year later, and ONE report later, I have witnessed their abject disregard for seeking truth and justice!!!!!!!!!!!!!!!
IMO, the ENTIRE system is so corrupt and inept, that I have lost faith with LE :(

To make world news over an "alleged rape," while disregarding unsolved murders!!!!!!!!!!
It is hard for me to have sympathy for the alleged victim, a prostitute, and the players, rich punks!!!
Nifong has put so much time into this one case, while murderers walks free!!!!!!!!!!!!!!!!!!

Too bad Andy Griffith wasn't the Sheriff, and Goober the DA!!!! And Aunt Bea, the judge, to sweep out the corrupt officials, so Opie could grow up in a town of justice, instead of these twits running amuck!!!!

One thing is for sure, they will ALL have to answer to God, and I don't think they will be so smug once the stench of death has filled their nostrils.......

Can't say I blame you Justice. I'd probably feel the same way. All this attention for this circus act and you can't get them excited when someone has been murdered.

I believe the media drives most of these cases. They saw something that had entertainment value I suppose. The whole black vs. white thing. Seems that type of story gets them going.
