A North Dakota woman has been charged with attempted murder and aggravated assault after allegedly striking her sleeping boyfriend in the head with a hatchet.

Another man at the scene, who was staying in the garage with the couple, later identified Deoliveira as the alleged assailant. He claimed Deoliveira is homeless, but she often stayed in the garage or at various homes in the neighborhood, where she would sleep on a couch or the floor.

He told police that when he woke up to the screaming, he saw Deoliveira swing down with the hatchet. According to court documents, the man said he couldn’t see what she hit but heard a sound “like splitting wood”.

The man told police he suspected that Deoliveira was “out of it”, but came to after hearing the click from the couch’s footrest and seeing the blood. He said she then fled the scene.

Deoliveira appeared in Cass County court on Sept. 12. She is charged with attempted murder and aggravated assault. Her next court date is set for Oct. 16.

Y'all, I'm so sad. This young woman has a thread here from 2017 when she was 14 and a frequent runaway. clearly her life did not improve with adulthood. Homeless, sleeping on couches and in garages And now graduated to attempted murder :(

Court documents show Lena Deoliveira was found incompetent to proceed following a fitness examination conducted on Jan. 14.

A report filed Jan. 21 concluded Deoliveira is not competent to proceed at this time but may be restored to competency within the timeframe required under North Dakota law.

Judge Ryan Younggren ordered proceedings in the case suspended. Deoliveira will be committed to the North Dakota State Hospital for up to 180 days for restoration treatment.

The court found it unlikely Deoliveira has the resources to pay for treatment and authorized public expenditure to provide it.

The North Dakota State Hospital must file restoration status reports with the court within 45 days of the order and every 30 days thereafter until a review hearing.

Deoliveira was charged in September after police say she struck her boyfriend in the head with a hatchet while he slept at a home in the 700 block of 14th Street North on Sept. 5.

The victim required surgery on his fingers and sustained a large laceration to his head.

Deoliveira was arrested in Moorhead two days later. She is charged with attempted murder and aggravated assault.

The Cass County Sheriff’s Department will transport Deoliveira to the state hospital within 24 hours of notification that a bed is available.
