One of his attorneys was on TV news last night distancing herself from his latest antics. I cannot figure out if he really is this delusional or if he may be trying to lay ground for an insanity verdict.

I am unsure & curious what others think. To what degree is Garcia mentally disturbed or just mean & revengeful? Is he irritable because he is incarcerated or acting to appear crazier? This will be an interesting trial... when & if it ever gets to court.

I'd say he's acting but it won't work. Not to say he doesn't have emotional problems and is vengeful, but certainly not criminally insane. After all those years he took to plot out his murders, I don't believe he was insane. Have the lawyers had him evaluated yet?

Believe it or not Dr. Garcia is not the most discussed murderer here in Omaha.

That would belong to Nikko Jenkins - who was released under our early release program and went on to kill 4 people in a few weeks.

He may be one of the scariest looking killers I've ever seen.

I believe they will probably end up sharing a cell on death row soon.

I find Dr. Garcia so odd because I don't think I've ever heard of a serial killer who did it only for revenge and waiting so many years to start and then wait for several more years to do it again.

I know there are thoughts he might have killed other people, but I haven't seen any evidence that he has.

I agree- I doubt he was involved in other killings, he seems to have been very focused on people he felt were associated with his being 'wronged' in medical school.

I really think the best thing in his case is life in prison. He has medical training and could do some good there.

I don't think a man who waited years and then murdered an innocent child to get revenge would be welcome in prison to work on other prisoners. I don't care what kind of medical training he has, you'd always worry that you might have said or done something to upset him.

Medical equipment can be used as weapons, and I wouldn't want to be around him if he has access to weapons.

I think you can almost guarantee he'll get the death penalty here.

Garcia has lost weight and looks even more like the composite sketch from the Hunter/Sherman murders.

I realize he supposedly suffered from depression in the past but I don't think an insanity defense will fly with jurors. He went to great extremes to commit these murders. He wore black to the Hunter home so any blood was disguised on his clothing. He drove from Lousiana to Omaha in a car that was identified by witnesses. He then gifted the car to his dad in CA to disassociate himself from it. He bought a gun in Indiana before the Brumback murders and left a clip behind in the home. His movements were tracked to Omaha the day of those murders and the attempted break-in at Dr. Bewtra's home.

Then there's the forensics... any DNA left behind, looking up addresses of the victims on electronic devices, phone pings, etc. I know the gun is missing but a clip was left behind and the gun shop will have records of the sale and possible camera footage so hopefully it can be matched to the bullets left behind somehow. And there is no telling how much other evidence, circumstantial or physical, OPD has collected that we don't know about.

IMHO, Garcia is a diabolical, calculating sociopath who premeditated these crimes. That's why I think he is acting out in jail. He is smart enough to know that insanity will keep him off death row. He IS a Dr. after all! And most likely more clearheaded since being jailed and off the booze. I suspect he will do everything to drag this case out for as long as possible. His attys are attempting to separate the trial into 3 and he is already showing dissatisfaction with them according to the link Myvice posted above. (Thanks Myvice!) I hope the judge sees thru it and denies separating into 3 trials.

I don't fault his attys for requesting the mental evaluation though as they were hired to defend their client and it may be their only hope in keeping him from the DP. Personally, I prefer he gets life if proven guilty. (which I think he is IMO)

Haven't been following this case, just popped in to see what it is about.

As far as defense requesting a mental eval. That is required in a murder trial if the defendant is acting off the wall, be it fake or not. It covers defense counsel later on if defendant is convicted and files any claims, it covers defense counsel if defendant really has gone bonkers, it covers any kind of Court action/case if defendant is really bonkers, or if defendant is faking.

So, if his attorneys know he is faking, they still have to request an evaluation. The prosecution can also request one.

Doesn't mean they think he is bonkers, sometimes it is just a CYA move. Sometimes it is a necessary move. I think you get the drift.

Anthony Garcia wants out of jail- and I am sure lots of people in Hell want ice water. He cannot seriously think he's going to get to go to a halfway house. He IMO is being confined alone more for his own safety than anything else, I doubt he would last long in the general population. Something about guys who knife little kids.

I will be glad when his trial is over and we don't see his face constantly on the news.

Calgary police spokesman Kevin Brookwell said a “harmless” procedural term sparked the question to provincial officials. Police had asked the pathologist about the word while the doctor was still with the province, but didn’t receive a satisfactory explanation.

“Had they had a satisfactory explanation of that file, this may not have happened, but as it turned out it did raise the alarm,” Mr. Brookwell said.

Well, it's probably some medical word we're not familiar with, but could it be the word "homicide"?

I have the feeling that Garcia's lawyers are aware of this discussion and in fact are using it to help them with their defense in playing the 'Belenky' card. Much good may it do them.

AG looks to be on course for trial sometime late this Winter or early Spring. There will be a LOT of things come out in the courtroom, some of them probably unsettling. I expect this discussion to heat up again then. This isn't over yet..

Anthony Garcia’s attorneys want personal journals and files from one of the victims he’s accused of killing.

Alison Motta filed a motion for the state to turn over personal journal entries and files from Dr. Roger Brumback, as well as records from Creighton. The Mottas also want any handwritten notes Omaha Police officers may have taken in relation to the cases. Alison Motta called the items “extremely important” to the case.

Attorney Bob Motta, Senior, also referenced an Omaha Police document from a neighbor of the Brumbacks. The document says that person called OPD to report that Mary Brumback said her husband, Dr. Roger Brumback, believed his life was in danger.

The 5 PM news on KMTV here in Omaha quoted a defense attorney as alluding to some mysterious hidden motive behind the killings, saying that Dr Brumbach was keeping track of the activities of his colleague, Dr Hunter. The quote about his life being endangered seemed related to that.

I think his attorneys are going to play the Belenky card in their defense. The request for AG's transfer to a halfway house is just silly. He'd be dead in a week if transferred into general population. Trial will probably be coming up by Spring, can't be too soon for me..

Illinois LE has recovered the possible gun used by Garcia in the Brumback murders:

If they can match this to the clip found at the site of the second murders and recover DNA from it (either his, or Mrs Brumbacks- the killer beat her with it) then I would say this guy needs to start thinking about copping a plea and saving his sorry butt.

The judge is still considering a number of defense motions, including whether authorities had probable cause to stop and arrest Garcia in Illinois in July 2013.
