you know your thinking above is exactly what Barth wants the jury to think. I do not agree with that at all...this is a trial about Seth and she got a deal. Simple...I think most will believe as we do that both are responsible but their charge is not Kat ...it is Seth and he is guilty...just because he had help does not make him any less guilty. I seriously wonder if anyone on earth believes Kat? I doubt it.

The only way it could be M1 is if all the witnesses (Kat, Ramos, the other inmate, the addict) are disbelieved, no one testified that it was a planned murder.

Seth Mazzaglia is back in the courtroom, his mother is in the front row behind him. Normally he looks straight ahead when he comes and goes, but now he glances her way. His leg is bouncing wildly as he sits leaning in his chair, facing the front of the court. The Marriott family members are chatting, Mr. Marriott leaning with his back to the bench in front of him conversing with Lizzi's Mom and Grandmother. Can't imagine how families cope with this.

This may lead to confusion for the jury. I can see that happening.

I forgot Roberta and Paul as well. lol

M2 is what I think, and yes, the jury may have difficulty.

Out of all days for it to happen, I just can't for the life of me get a watchable live feed grrrrrrrrr. There's been lot's of storms here over the past few days so I think our internet speed has been affected by it.

Good Morning Everybody!!

I like that Judge's definition of indirect evidence. The snow evidence...

Unless you have some nutty friends who had snow blown on your lawn while you slept I'd agree with his honor.

Was the Holly/Hulsey murder planned?

Was the Holly/Hulsey murder planned?

OT: When Hulsey brought his gun with him out of the vehicle, shows premeditation to me. However the murder was not "planned" in advance if that is what you are asking.

Immunized...that be Kat.

Premeditation can happen in an instant. The prosecution outlined, sm took 15-20 minutes to consider his actions and that qualifies as premeditation.

Premeditation can happen in a moment. When he grabbed that gun, got out of the car, he had the intention of shooting. That qualifies as premeditation. imo

I'm trying to remember what the State has that is not dependent on kat's testimony.

The 'painting' text with no painting being done. The nefarious meaning of the tarp. The defendant's live in girlfriend texting she is nervous. Who gets nervous to paint a wall or two?

Besides the testimony of a former drug addict (who I believed) and a sex offender the only other witness I thought was truthful was Paul.

Because of the painting text I think an assault was planned and the tarp for disposal of the body shows premeditation of murder.
