I would give him M1 because he decided to put on gloves and grab a rope before putting it around her neck and choking her. If I believed that he was just trying to convince her that being strangled was fun and lost control of his senses and killed her, then I'd give him M2.

Absolutely, Jewels - you're so right. We often hear the words "however short" used when premeditation is mentioned. You don't have to write it down on a list or announce it or give it a] "5 minute test." Seconds, as you say, will do it. Strangulation takes more than seconds.

It still makes me so angry. What a waste of skin. Grrrrrr.

Agree. The two story versions complicates deciding on degree of murder.

1ST DEGREE MURDER ... that Seth Mazzaglia killed Elizabeth Marriott by strangling her: NOT GUILTY.

1ST DEGREE MURDER, an alternative charge... that he strangled her and committed felonious sexual assault before, during or after: GUILTY

2ND DEGREE MURDER... that Seth Mazzaglia recklessly caused the death of Elizabeth Marriott. NOT GUILTY
