NH NH - Elizabeth Marriott, 19, Durham, 9 Oct 2012 - #10 *S. Mazzaglia guilty*

YUP, And as an aside, I am getting tired of perps claiming they "blacked out" and have no memory of committing a crime. That exact defense was used last week at a trial I sat through in my city. Defendant was convicted of M2.

I'd give Seth M2 along with guilty on the other charges as well. You?

I would give him M1 because he decided to put on gloves and grab a rope before putting it around her neck and choking her. If I believed that he was just trying to convince her that being strangled was fun and lost control of his senses and killed her, then I'd give him M2.

That was my point though, it takes only seconds or fore thought and it can be classified as premeditated murder. or M1

Absolutely, Jewels - you're so right. We often hear the words "however short" used when premeditation is mentioned. You don't have to write it down on a list or announce it or give it a] "5 minute test." Seconds, as you say, will do it. Strangulation takes more than seconds.

It still makes me so angry. What a waste of skin. Grrrrrr.

Sorry, I'm not familiar with the rules around tweets. Are we allowed to say that there was a tweet and let others look for themselves, or are we not allowed to mention the tweets if they are not from main stream media?

I got mixed up there for a minute myself. Coldpizza just defined the rules.

You can certainly mention, in a short period of time it's going to be tweeted by the main sources anyway!

Thanks for asking!

I guess sethsvest isn't main stream, even if it is very close to him :)

Agree. The two story versions complicates deciding on degree of murder.

I've watched about 75% of the trial (some of which I just had to walk away), but I watched 100% of Kat's testimony. Here is my prediction:

1ST DEGREE MURDER ... that Seth Mazzaglia killed Elizabeth Marriott by strangling her: NOT GUILTY.

1ST DEGREE MURDER, an alternative charge... that he strangled her and committed felonious sexual assault before, during or after: GUILTY

2ND DEGREE MURDER... that Seth Mazzaglia recklessly caused the death of Elizabeth Marriott. NOT GUILTY

CONSPIRACY TO COMMIT TAMPERING WITH WITNESSES OR INFORMANTS: GUILTY

CONSPIRACY TO COMMIT FALSIFYING PHYSICAL EVIDENCE: GUILTY

Oh... I thought she was granted immunity before she testified to the GJ. Wow, she really took a risk!

No she wasn't granted immunity before. I guess I didn't read your post very well.

No, you read it correctly; I was mistaken about the order of events.

That's a good, solid and sensible verdict, IMO. Agree.

A little off-topic, but I am afraid that if I had ever believed that Tarot cards were a good decision support tool, my belief would have been blown out of the water by this trial.

Someone hand me the jury form - I'll have it filled out in 5 seconds! And also send Kat a huge can of whoopa$$.
