Concerning Kat, according to her plea agreement, nothing she says at this trial can be used against her. Based on new evidence, can she at some point be charged with murder?

I hope that can and does happen, I don't buy her story at all, after seeing her for these many days on the stand, I just don't believe she loved Seth so much she'd make up that story to tell the defense and try to save his butt by throwing her own under the bus. And it didn't last long before she started cooperating with the DA's office and threw him under a Mack truck. So much for love everlasting.

Anyways, that's what I think the defense's strategy is, prove to the jury that she's the liar they believe her to be and convince them that she was the 'main' killer of Lizzie and Seth is convicted of a lessor charge, or not at all. I still haven't decided on one scenario of how Lizzie died, guess I'll have to see what the defense puts on and see if they can make a cogent picture of what happened.

Hysterical... he was actually a talented Canadian actor - all the roles he played. What a show... the good ole days.

I was going to comment that DEF counsel is holding up fairly well. He needs to tighten up, though, this is one of those cases - those rare cases, where the attorney can make the difference if she plans well , and can be creative.

How much more of this do you think we have?

True story~ Years ago we had a DA Lincoln Soldati who was trying a case with Barth and in closing arguments he made a comment equating Attorney Barth's closing arguments to a Bag full of Barf or something along those lines~ Well Barth took exception to this and brought Soldati to the ethics board~ Soldati was punished...

Interesting fact~ One of Nancy Grace's guest Peter Odom has tried many cases with Barth as he was Assistant DA under Soldati.

IDK---he never ever chats with his atty's while in court. I have yet to see anyone say anything--not even acknowledge him (ok I remember one moment-:blushing:)--to me its really weird

Also find it weird about LE never wearing a uniform in court

Excellent observation- its like he has no tongue. Obvi, we know this is not the case - the jail call - a personality that elucidates each word to the point of potentially driving people mad... reminds me of a really, really, sub-par, cheap TV preacher, oh, with the vest and all... but the two, you'd think would synergize,,, not the case as he sits blankly...

Wow - BArth comes out of the gate firing today with argument, state tolerant, and Kat playing Bambi to start, looking for the Emmy.

Just watched part 4 and wow just wow! The witness is a piece of work. Just as guilty IMO.

What exactly did he confess to, does anyone know? Just him, as in Kat's version? Or closer to what Kat told his defense team, breathing play that went all wrong, but with both he and Kat?

From what I understood reading/watching this, SM's statement to police was made a few days after LM's death when he was interviewed for 11 hours. Not sure how this could happen, but apparently portions of his statement, (confession,) have been suppressed because he was not read his rights. (In this day and age?!)

It appears as though the defense will bring up portions of the statement, which they can do to confront KM on her story. Earlier there was controversy about the state wanting the defense to disclose their strategy as it pertains to SM's statement.

I think they have to find evidence that proves something different happened beyond her actual testimony. Like if Lizzie's body comes home (which would be a wonderful miracle for her family to lay her to rest properly) and they found that she had been stabbed or something like that.

But I think anything that would shift the scales and cause Kat to be re-sentenced would also be cause for appeal and perhaps release of Seth.

Perhaps a legal expert or someone more knowledgeable than myself could confirm or deny this.

Would love to hear a legal expert here as well. My understanding is she is pretty untouchable at this point and reversing immunity while it can be done is very very rare...any expertise?

It was commented earlier how no one talks to him...he wears that same outdated vest each and every day..probably does not have a suit coat to fit his newly enhanced body (he is fat). So creep and then the hands on hips stand each and every time he is asked to stand...and he acts like he can barely get up. Sad to say I don't think I can ever look at a sales guy from Best Buy in the same way again.
