It APPEars... that the gloves are off. These two will not be dimming the black light, and smiling to ONE another, ever... EVER again. So sad. (kidding).

Attys and Investigator did an excellent job at getting Kat to spill the beans during this reading of her report. In the pretense of correcting typos and "accuracy", they found areas they wanted her to elaborate on, and because she loves talking about this encounter, she fell for it. Superb strategy!!!!

I am developing huge respect for Barth! Never thought I'd say that about a defense attorney. Never say never!

Googled Shibari in Wiki. Couldn't help myself. I have an entire new vocabulary as the result of this trial that I can add to my JA vocabulary from last year's trial.

Still never wore a thong, doubt I ever will................ Oh who knows, maybe next year when I turn 70.:floorlaugh::floorlaugh::floorlaugh::

She saw "At Worlds End" one time too many...

Who am I kidding, you can never watch the Pirate movies too many times!!:loveyou:
My son tells me different though
Can't help it, love some of the actors ...Geoffrey Rush, Bill Nighy, Stellan Skarsgard, and of course Mr. Depp (Plus Hans Zimmer music, heaven!)

From the article I linked earlier-

"McDonough was ordered to serve three consecutive jail terms, each up to 7 years, or 21 years in all.
But, with her agreement to testify against Mazzaglia, the deal significantly reduced that sentence.
Based on that pretrial agreement, if she is caught lying, the deal is revoked and she does the full time."

"Could the state revoke the plea deal after the trial is over if it was discovered McDonough had lied?
Strafford County Attorney Tom Velardi explained that if it was thought McDonough had lied, the prosecution could go back to court to make the case to a judge to undo the plea deal approval.
“They (the prosecution) would have to prove perjury in the testimony in a material way that breached the agreement,” he said."

:giggle: It has been driving me nuts too Pops!

Barth's Greatest Hits

"What did you just say?" in place of "can you repeat that..." or "what was that?"

And what does BDSM stand for anyway>? Enlighten me...

Wow, so she did all the dirty work... now I know what you guys have been talking about w/ re: to "disposal."

I thought KM seemed like she was trying really hard to "normalize" her sexual practices with SM. I don't think she was exactly comfortable or enjoying talking about her sex life as much as she was duped into thinking she had a sympathetic ear who she could make understand her relationship with Seth. She was treating the detective/investigator as if they were allies and on the same team. She seemed nervous and was laughing a lot and trying to make it sound like everything was totally normal and fun until something horrible happened to Lizzi. My 2 cents.

Davey Jones' Locker? Really?

I think I would've rather read here today than be there especially in the AM...then the video was played.

I sat across from her family and I have never been so heartbroken for anyone as I was for them. Especially when the "Davey Jones Locker" was mentioned. The horror/sadness on their faces was too much to see.

I think the jury is pretty tired of Kat. I actually saw a woman roll her eyes a few times at Kat's answers. They were very attentive especially during the video, which BTW I think buried the State's star witness. I have no idea what they can do to dig themselves out of this hole.

We sat with a bunch of law students and ate lunch with a couple of them. They have been following this case from the beginning. Most of them feel that at this point with no evidence besides Kat's testimony, Seth will walk free.

I have seen Barth in action before and I have to say that he is on his game in this trial. The jury likes him. I usually don't like defense lawyers but Barth is likeable and he is on the stage of his career. I really enjoyed watching him today!

About Seth~ He appears nervous but I also feel that he is upset, angry about what Kat is doing to him. There were more than a few times that he muttered under his breath when she said something. He is shaking all the time but someone said he was tapping his foot. A couple of times he looked very tired. I don't think there is any love between the 2 of them.

Kat~ Well you have all seen her but to see it in person, when she leaves and comes in is something. It's almost like she is a different person. She has had some coaching. When we got there this AM the Sheriff Department took her out of the holding cell (it's like a locked closet) and she was taken to a conference room just outside of the court where the State lawyers were. I think they have told her to wear what she does because it makes her look young, small and innocent. She looks nothing like she did at her court appearances during the deal. This girl is evil!

I am not sure if I am going tomorrow~ it was like watching paint dry for 6 hours

The state in this is case is too polite... too tolerant... its as if they had Professors in college who reamed them out for not being able to make objections without talking (talking objections). A far cry from the belligerent Juan Martinez, who will object dozens of time during an opening and closing, using argument, and pandering, as reasons. When do you think Martinez will get his judgeship - he seems so out of place, getting b-slapped, back-handedly by a judge.

Remember, this Hulsey case is ALL for Marty - to earn LE's confidence post Chrisman. Recall, Martinez has been around for a looong time. Remember the case of the wife falling off a cliff, and leaving a note, supporting the male's affair?

So I think Arias will be his last case - and he should get the judgeship - bt that's just me - am I wrong? What do you guys think?

I am laughing now every time Barth says BD S +M ! HahA!

Luv ya,

The G

Thanks so much! I hear it is an extremely small crowd. Is there even anyone behind the defendant?

Luv ya,
G

The AM crowd was small but the afternoon was fairly large. We were able to sit 2 rows behind Seth. (I wanted to sit there to get a feeling what his lawyers were doing, acting towards him and to watch him).

There are some reporters but I have a feeling that WMUR is representing ABC, there was someone there from either 48 hours or one of those shows but he said the topic was a bit risky for even primetime TV :floorlaugh: and the rest of them didn't have anything to identify them.

Behind the Pro's were family members and friends of the family.

What I found interesting is the way she is acting when not on the stand. The jury doesn't see this because they are brought in from behind the court. We saw it every time she came in from breaks.

There is no doubt in my mind, she was the controlling one in that relationship. When I first started this thread I explained that I had met Seth a few times over the years. I also have a very good friend who was in a romantic role with him for a local play. She won't talk about it however she finds it hard to believe that Seth could harm anyone. She was probably in 4 or 5 plays with him either directly interacting with him, having a role in the same play or directing him in one. He was also in the UNH Theater program with 2 of my former employees. The live in Seattle now but they also find it hard to see him harming anyone. They hung out with him often. I have often found that artist are quirky and odd (in a good way) and Seth was no different than those that he hung out with.

I just want to say that no matter what role he played in Lizzie's death, he needs to pay for it....I am afraid that he will get nothing....

I am very angry about Kat's deal as are many other people..I hope that the State pulls the rug out from under her. This woman is very dangerous and evil.

There was an older woman sitting behind him that appeared out of place with the news people but there was only one interaction between her and Seth. When breaks happen Seth always stands up, never says a word and looks toward the Sheriff that is guarding him for instruction. The law students said that both his dad/?mom and a younger woman have attended. LOL I wish the seating was like a wedding, that way I would know who was there to support who. The victims usually always sit behind the Pro's with the victim advocate, this case is no different.

He doesn't have much interaction with his lawyers either. Barth always looked like he was deep in thought. This team came in prepared unlike the State IMO

Had to run to do some things and I'm getting caught up with the trial again. In watching the video my children and I both feel that who you see on the video is the real Kat. The person on the stand is not the person we know, the mannerisms, the whiney scared little girl voice is not Kat. The person in the video is the way Kat acts and talks. Watching the video of Kat at the atty's office makes me so very very sad.
In no way does this mean I believe Seth isn't equally responsible. While to some he may have seemed quiet and harmless I do know my child told me before this all happened that he gave people the creeps, he would make rape jokes and odd sexually explicit jokes with the teens and it made people uncomfortable. The kids thought it was just social awkwardness kind of like he was stuck at being a 13 year old boy, but I had told my kids to keep away from him. They didn't know him well, only met him a few times, but he was awkward and immature. I don't believe Kat would have had the strength to kill Lizzi on her own, so I'm sure Seth killed her but I believe Kat's role was far more than simply whimpering in the corner with her knees drawn up to her chest.
