Wow, I just watched the last segment of KM's testimony and I think the only truthful part of anything she has said is that she and SM decided that only they two would ever know the truth. I think it still stands today.

ITA. Much of what she said I thought she lied

I'm so glad to have minor4th providing legal insight on this case. Thanks so much, minor4th. I always enjoy reading your posts.

What you say about this case makes perfect sense but it makes me sad. I get that the prosecution felt that they had no other choice but to give Kat a sweet deal so she would roll on Seth. But then I think about beautiful, vibrant Lizzi who would have been alive but for Kat. Kat led her to Seth like a lamb to the slaughter. And all because Kat wanted to keep Seth happy. That's it.

In Kat's mind, her relationship with Seth was more valuable than Lizzi's life. So she lured poor Lizzi to Seth, assisted Seth in killing her, and then threw Lizzi's body away like a piece of garbage. That's what makes this plea deal so sad to me.

Also, with respect to long probation...I wonder how closely monitored Kat will be over those 21 years. Probation officers usually have more cases than they can handle. Who knows what Kat might get into during those 21 years, especially if all it takes is for her to hook up with the wrong person?

In the future, perhaps States should require potential murder defendants in these types of cases to undergo psychological testing by forensic psychologists who specialize in personality disorders. Perhaps that would, at the very least, help prosecutors make more informed decisions when crafting plea deals. IMO, JMO

Skigirl you are not in the minority here. I know KM is guilty to what degree I am not sure. We will probably never know the real truth of what happened the night Lizzie died. I don't believe even if SM was on the stand it would be the truth.

I also think Barth didn't do a very good job at impeaching KM, there were no Ah ha moments for me. It also should not have taken so long to impeach KM if she were truly lying. imo

jmo

I have to disagree. I watched the jury closely while Kat was on the stand and most of the writing was being done while Barth was questioning her.

There are a few lawyers in the courtroom in between their cases and several of them feel that reasonable doubt has been established. Time will tell

The expert that they had on today was a mistake IMO. The jury was extremely bored even though it was after lunch. I think Barth saw that and that's why he used the tactics he did, it worked, the jury was paying attention.

This jury is pretty predictable in their reactions to some of the testimony.

OT what a great learning experience for all of the pre-law and law students that are attending.

I will be going to both sessions again tomorrow~ Hopefully it's a bit more exciting than this afternoon. I will not be sitting behind Seth this time because after a while I just want to go up and kick his foot so he stops shaking it! Annoying as heck

And a condom (found with the underwear and other items).
Sooooo.... Why was a condom in the evidence tossed? :waitasec:

ETA- LOL I should have read all the posts before I responded

If the condom matches Seth's DNA then I'm sure it will be introduced. The state has certainly not finished their case.

Oh God I hope Seth does not walk free!

Thinking of Elizabeth tonight. They are both guilty, IMO.

The only evidence a rape took place is, so far, from an acknowledged liar's mouth, we have no evidence yet of that. I actually think it sounds far-fetched that he would suddenly snap, send Kat a text about 'painting', strangle her with a rope from the box under the futon right behind Lizzie (as well as put gloves on without her seeing that either) and then have sex with her deceased corpse before having his girlfriend use his phone to call his Tarot card reader friend to come over and give him advice as to what to do next. That just sounds inane.

bbm

Yes, indeed, geev -- Using a lifeline to call a friend, "Hi, Roberta, it's Seth. Got a question for ya... We've got a dead and nearly naked female here on the floor in our apartment -- what should we do with it? We're all out of ideas here..." Seth needs help? I thought he knew everything...

I know I'm in the minority, but I think that no matter how "advanced" or "sophisticated" (or unlikeable, for that matter) KM is, she was a teenager when a 28-year-old "performing artist" (which basically means a loser with grandiose fantasies about himself but who in reality who did relatively unskilled work as his day-job and participated the very occasional non-paying or local gig) culled her from her family and friends and started grooming her to be what he wanted in a "partner". I have no doubt that a woman his age with any self esteem would have laughed in his face and walked away as soon as he started yammering about his personas and his needs. KM found the attention exciting. She had more than plenty of issues, and has done horrible, horrible things, but I think that without him, she'd have been unlikely to have been involved in a murder, cover-up, or anything but a string of dysfunctional relationships, a job at Target, and a hand-full of local theater productions.

I totally agree, Skigirl. Shades of Charles Manson's technique in what he did. Manson did the same thing when he recruited Mary Brunner, Susan Atkins, Krenwinkle & the rest. Kids who had been kicked out of the house, or were already heading for trouble, or who hated life with over-bearing parents, etc., girls who were looking for "Daddy," or who were being ignored, mistreated, etc. There was an age gap there, too.

I think KM was easy prey when he found her, and I think he knew it, too.

I'm not impressed with this prosecution team. They have no passion, they are flat & it would be too easy for the jury to zone out to them. They need to up there game to get justice for Lizzie.

I agree with you 100%~ We have another poster here who knows Kat and has stated that Kat has lied on the stand about never being with a woman~ She also states seeing/hearing about her shortly after the incident and she was anything but "distressed".

I do not know Kat but I am familiar with Seth~ after hearing from our poster about Kat, speaking with some of Seth's friends that have met Kat I am really starting to lean towards the story that Kat gave in the beginning~ Reasons why;

1. Seth confessed to doing everything from killing her to dumping her in the water~ Kat has testified that she was the one that thought up the suitcase, the duct tape, turning off the phones, where to dump the body etc....

2. The wire conversations, same story, same everything

3. The searches on her computer, her online presence, her lying on the stand that she had never been with another woman

4. Seeing/knowing Seth, he is an introvert IMO... I always thought that if a woman ever said boo to him he would run the other way. I never saw a passive aggressive attitude from him~ I saw him in a romantic role and as a director with one of my good friends~

5. Being in the courtroom, speaking to friends of both of them, Lizzie was not IMO controlled, I think she was the controlling factor in this relationship~

I am not on the fence at all but I do think that both of them should be held accountable for their actions that evening.

I wonder - did you know that SM was into BDSM? Tarot cards? Role playing video game? D&D?

It would be hard to imagine it any other way considering Kat was on the stand for 10 days & Barth grilled her for 80% of that time

Littleone thanks for your insight but on this we will have to agree to to disagree. I have been watching also, just not from the courtroom.

I am not sure where all of these law students are sitting as there seems to be no one in the seats behind SM? Can you expand please?

I sure wish you would get verified, otherwise I will take your statements about SM as just your opinion.

Good Morning!

Did Kat talk about never being with another women only before she met Seth?

  • #375
Morning everyone :gathering:

Good morning all!

Thanks Zoey for all the updates and tweets!

Nothing will get me past SM having a previous gf that he showed controlling behavior with and liked choking her during sex.

To answer your questions: No to BDSM. I had no idea that even went on in our community~

Tarot Cards~ I have found that in the artist world, Tarot cards are pretty common so it doesn't surprise me. I have also found that many of the local artist are very spiritual and have some really odd beliefs. It is a community where everyone is accepted no matter their quirks.

Role playing video game~ never heard of them and have no knowledge of them

D&D~ This game is pretty common for this age group

As I have said several times I only know Seth from within the artist world which I did spend time with him in social situations relating to that. I also had 2 employees that were in the UNH theater program and Seth attended a couple of the private parties that I also attended. He was also present at an after party their senior year.

At the time he never made the impression on me that he was capable of doing something like this.

I got just two words today.... Physical Evidence!

I may be alone here but I can't stand this DV expert. He seems to be talking down to everyone and playing to the camera. As a juror I would be turned off. Maybe it feels different in the courtroom. His stories just put me to sleep. I'm not saying that what he says does not make sense but something about him seems contrived.
