Closing Statements tomorrow!

I missed the whole thing. Anything interesting happen?

Not really, they just go over wording in the jury instructions. Barth was wanting something about Kat and the immunity. Maybe someone else can explain better than me. sorry

  • #983
You didn't miss too much, just some inclusions/exclusions from the judge's draft of instructions - Hinckley wanted investigator added or replacing police officer in those who aren't to be given more weight to their testimony, Barth wanted 'consciousness of guilt' either added or deleted, I lost track of that one, he also wanted 'attempt to' replacing 'must' in the deciding testimony section, also somewhere he wanted clarification on immunity (about Kat) but I didn't see where that came in in the instructions. Judge will decide today on those and make another draft that they can pick up in the morning (or later this afternoon). A little sidebar that we weren't included in on but that's about it.

Oh, I forgot one thing, when media asked for camera, they originally asked for three, one positioned between the jury box and the witness stand, the judge denied that camera placement because he didn't want any chance of jurors nor family members to be able to be seen, and also it might get in the way of jurors coming in/leaving, but above was his primary concern. He brought the issue up again for closings and gave each side a chance to re-argue their position on that, they each stuck with their previous thoughts and judge will decide overnight if a camera can be placed there with the no jury/family rule still in effect.

For such a short time on the stand, we learned a lot from SM's friend, Robert. To recap:

1) As a preteen, SM was sent to special nerd camp.
2) Robert and SM were both really, really, really into role-playing and massively multiplayer online games.
3) Robert did not know of any of the personas, such as Darkhart, Doomsday, Cyrus, etc. that SM routinely used. He did know SM's gaming identities, which were different.
4) SM told people, or at least Robert, that he had a girlfriend in college named Natasha who died in his arms. Robert thinks he is "exaggerating" (i.e., lying). That, or it's very dangerous to be a woman around SM.
5) Robert was at the apartment when KM's family came over and tried to get her to come home. SM was belligerent during that encounter and voices were raised.
6) Robert didn't know Kat very well, but stuck around while SM and KM had sex behind him on the bed.
7) Some additional yucky details about KM and SM that I wish I could unhear.
8) There were "considerably more ropes" around the apartment once KM moved in
9) SM did not seem to have many friends, or at least his friend since middle school hadn't met any or many.
10) While in jail, SM wrote letters to Robert.
11) SM indicated that he was studying abnormal psychology and would become a "master of the human psych (sic)!"
12) SM indicated to Robert that he was studying advanced interrogation techniques
13) SM indicated he was watching, "I Almost Got Away With It"
14) SM was considering an insanity defense.

Seems like there was an interesting revelation every 1-2 minutes during his testimony, most of it unfavorable to the defense.

Excellent, excellent recap, Skigirl. Thanks.

If I were someone reading this list "cold" -- having no knowledge of anything/anybody having to do with whatever-I-don't-know, I would say that several items would make me think the subject of the list was guilty of something and trying to get away with it. Choosing insanity over guilt does not say to people, "I am not guilty of this crime." It says, "I am guilty and I am smart enuff to play crazy and not go to jail for it." And there are no comments there about Kat being the one whodunit.

Interesting, isn't it?!

I'm still trying to process #4 -- "my girlfriend, Natasha, died in my arms". It does seem to me like he's the hero of his own internal movie.

  • #992
I was freaking out! Our internet went down about 4 and came up about 7. Thought I was going to be out shopping for a new modem while closing arguments were going on.

Whew!

  • #993
Wow. I really wish I could have watched his testimony. Thanks for the recap. Ain't it funny how you want to hear it (if you haven't), and you want to un-hear it (if you have).

RIP.

why was Seth not asked to stand and the judge would ask if he is in agreement with not taking the stand ie his own choice etc. Is this a state thing.

  • #997
ok i've cleared the hive schedule.......threatened the pollinators.......assigned the workers.........and warned the drones to KEEP IT DOWN!

see you sleuthy friends in the morning :)

Okay - for starters - I hope the Dream Team has been doing well. I am interested in learning what the Dream Team thinks about the absence of Seth's evidence... the strategy, yes, but also - extreme confidence, no? This is his last curtain call...

Now, on to the really, really, important content.

Robert Mitchell - Please click here: https://twitter.com/Gajonka

You will see that the Gajonka does not look like "Robert Mitchell." Thankfully, I do not sound like him either because he should be in the military - just the sound of his voice - consecutiovely - for an hour or so, can represent the most horrifying, potentially, IMO, disciplinary experience.

I am a Mitchell - [ that's right "Gajonka Mitchell " (smile)which is why I write! Please let me know if I missed anything on the planning: They Bring in Mitchell to introduce a healthy feature of the defendants- "he is a harmless player of role playing games - remember - multiple die are used (hence the term Roll Playing, because you are rolling dice! In addition to Role playing... (cough, sorry, OT). To introduce Kat's active and autonomous actions on laptop, and to simply try and personify DEF. Please share more.

So, just wanted to let the mega-sleuths o of the dream team know, not all Mitchell's are like Robert Mitchell. I couldn't believe it! The tongue sliding to the front of his gums after every question -etc.

Luv ya,
G

PS: WHat's next- deliberations? Can we get a poll going so everyone can share their final just call? ( 1. if you were on the jury, your vote/ 2. what you think this NH jury will do - versus what they should do) TY!
I will catch up on posts.
xo

I saw most of today but not all and my take was the defense has a very weak case and unless there are some bombshell witnesses coming up tomorrow...Seth is done. This last expert was awful and I would imagine Barth had some real problems getting anyone. Sometimes I think putting up no one is better than something like this. The trail is dragging at this point and hopefully will be over tomorrow and jury gets the case. Barth had his day in the sun with a few witnesses including Kat but at the end of the case where he really needs to make an impact he has failed. His "version" cannot hold up.

I forgot about closing's ! I guess they will kick-off Wednesday>?? Still stunned turned down his final opportunity to take the stage - Barth is def in control... knows DEF can't do it... Mrs. Marriot's final sentence - of her testimony - when her voice cracked - in response to the question posed concerning if sh has seen or heard from Lizzie 0 I hope that moment sticks with these jurors - somebody has to pay.

It is quite possible as some of us know too well. We had another case about a year ago the Levi Chavez case. When the trial was over the defense attorneys wife signed up on WS, seems she was monitoring our comments. That was part of her job in the office of her husband. No kidding!

http://www.websleuths.com/forums/showthread.php?t=216304&highlight=levi+chavez

That case- the Levi Chazez case - it stings - another sub-par level of intelligence exhibited by a jury - the latter in tandem with this statement by the first jury member from Zimmerman:
{in re: to a question about Crystal's testimony"
"She didn't want anything to do with this jury..." (s/b with this case, etc.)

both spark an idea involving including some type of intelligence exam - we cannot put cases of critical importance in the hands of those with rice pudding between their ears, and an addiction to real life "Law and Order."

OT, sorry.

I can't get over that Levi case - how the heck did he walk,,, blows my mind.
