Judge drops charges against 3 people linked to filthy New Mexico compound
Here is "why"
Judge Emilio Chavez ruled that he could not keep the three in custody because prosecutors missed a 10-day limit for an evidentiary hearing to establish probable cause for the neglect charges.

and what prosecutors can do about it,
Prosecutors have other options for pursuing charges against the three — Lucas Morton, Subhannah Wahhaj and Hujrah Wahhaj. That could including refiling the charges or asking a grand jury to indict them.

It's almost as if the prosecutor is throwing the case on purpose. First he provides inadequate details to prove the case in the hearing and then he misses a deadline.

It's hard to tell. It's been one of the strangest cases to me when it comes to the first judge and prosecutor.

Sympathetic? Political ideology? IF I. Maybe we will learn the actual reasons behind it.

The prosecutor could go to the grand jury to get indictments against them all and they can layout their cases to multiple grand jurors instead of going to one judge.

I would think citizens in this county are going to demand justice for these children. Hopefully it puts enough pressure on the DA..to get indictments from the grand jury.

It will be interesting to see what happens.

Dad, partner plead not guilty in toddler's death at New Mexico compound

TAOS, N.M. — The father of a 3-year-old boy found dead in a filthy New Mexico compound and his partner pleaded not guilty Wednesday to new charges of child abuse resulting in death after lesser charges were dismissed against them and other members of their extended family as the result of a deadline missed by prosecutors.

The dead boy's father, Siraj Ibn Wahhaj, and his partner Jany Leveille remained silent as pleas were entered by a judge on their behalf. The charges could carry life sentences in the death of Abdul-ghani Wahhaj.

The FBI on Friday announced that it has arrested all five "extremist Muslim" New Mexico compound suspects, just days after multiple charges were dropped against those involved. The suspects were charged with violating federal firearms and conspiracy laws.

Hard to say whether FBI is reacting to the county snafu or county prosecutor knew charges were coming so let the date slide. Seems to me though that, based on the charges, it may be the former. But I also believe the FBI may be investigating other more serious charges. I can't remember for sure and am frankly guessing, but I would think that there has got to be such a thing as conspiracy to commit domestic terrorism in this case. At least three were nationals.

I doubt it. They are only facing 10 years max for federal charges.

It appears that BOTH state and federal charges will be filed and proceed relatively simultaneously.

State charges related to the death of Abdul, along with other potential charges, will be re-filed after presentation to a grand jury Sept 27.

The new Federal charges will keep all 5 in custody (likely) for the forseeable future.

But it appears that the Federal charges will likely proceed sooner than the State charges. As they are for entirely different criminal charges, I think that's a very good development in this case. Federal prosecutions are much more orderly, organized, by-the-book, and predictable, IMO-- State court is more of a "wild west" situation.

These 5 defendants are not going anywhere soon. I think there will be many new charges coming down in the next few weeks. And that's a very good development, IMO.

Also Friday, the Taos County District Attorney announced the remaining state charges against Leveille and Siraj Wahhaj had been dropped so prosecutors can prepare a better case to present to a grand jury September 27.
"We plan to take the cases against all five defendants to grand jury," District Attorney Donald Gallegos said. "It is also possible, in reviewing the evidence still coming in, the charges could be altered, reduced or increased. Right now it is too early to tell."

At least five of the guns were transported in Leveille’s car from Georgia or Alabama to New Mexico, the federal complaint against her says.

Tom Clark, a lawyer for Ibn Wahhaj, told Reuters that the charges were not a good development for the group.

“Anytime somebody gets in the crosshairs of the federal government it’s problematic,” he said. “It never goes well when you find yourself under federal indictment."

The complaint also included more allegations about the nature of the compound and the suspects’ supposed intentions.

Days after child-abuse charges are dismissed, New Mexico compound suspects are arrested again

Taos County District Attorney Donald Gallegos said Friday his office will now seek grand jury indictments involving the death.

Gallegos said seeking indictments will allow more time to gather evidence.

All five people will remain in custody pending a Tuesday hearing in federal court.
