I am trying to figure out why she has not taken a plea deal. Maybe one wasn't offered? Trials on December 19? Worst ever. No one can focus, they are thinking about parties and gifts. Getting out of there to get somewhere else.

They have trial only lasting 3 days. So not too bad.

*Motions Hearing (abuse) (@ 10am MT) - NM - Saul, newborn (Jan. 7, 2022 found in dumpster behind Rig Outfitters Jan. 2022, Hobbs; newborn is in stable condition at Lubbock hospital) - *Alexis Nicole Avila (18/now 19) arrested & charged (1/8/22) & arraigned (willful) (1/12/22) with attempt to commit a felony, to wit: 1st degree murder (Felony Murder) & attempt to commit a felony, to wit: 1st degree murder (Willful & Deliberate) was changed (3/1/22) & charged (2/8/22) & arraigned (3/14/22) to abuse of a child (results in great bodily harm) with intentional or recklessly. Plead not guilty to previous willful & deliberate charge on 1/12/22. No pleading entered on abuse charge on 3/14/22. On house-arrest.
No movement on felony murder charge as of 7/13/22. Last entry is 1/21/22.
Trial set to begin on 12/19/22 thru 12/21/22 for abuse charge.

NEW MEXICO (KRQE) – The trial for Alexis Avila has been delayed. Avila, now 19-years-old, was accused of throwing her baby into a dumpster behind a Hobbs mall in January.

Avila was set to begin trial on December 19. Tuesday in court, her defense team asked for a delay; saying the defense team had recently lost two attorneys on the team and that someone new had been brought in.

I heard on local news that the judge said he will not delay the trial past April 11, 2023. Too bad it won’t be tried here in Santa Fe so I could attend.

Avila is currently slated to go to trial in April 2023. She remains on house arrest while awaiting trial.

Defense did request a hearing for a change of venue - but the court site has nothing updated yet. keeping an eye out.

It won't matter much where a change of venue could be. When they show the video of her tossing her baby into a dumpster jurors will be respond the same as they would in Lea County.

After hearing arguments Thursday, a judge says he will be making a decision soon. He says that decision could come as early as Monday.

Judge William Shoobridge rejected Avila’s change of venue motion in a decision filed Monday, March 13. The judge ruled, in part, that Avila’s defense “presented no testimony or specific documentary evidence showing an impartial trial is impossible in Lea County” “or any county in the Fifth Judicial District.”

Avila’s trial is currently slated to take place between April 11 and 14, 2023.

Yeah, this case wasn't huge, although it should have been. I dont think a venue change was needed. I watched her whole interrogation. She should be pretty easily found guilty, I'm hoping. I hope the baby is thriving, away from her.
