I believe that cody's attorney would have better first hand information about what his client was doing or not doing, as opposed to the prosecution or Verne.tybee204 said:Verlin likely has contact with the Prosecution
Cody has been in the Custody of the State since the murders occurred. The Prosecution is "The State". The Prosecution likely has every Incident report made on Cody since his first day of incarceration. All of those reports will more then likely be presented in the sentencing hearing to show Cody's proclivity towards violence.fundiva said:I believe that cody's attorney would have better first hand information about what his client was doing or not doing, as opposed to the prosecution or Verne.
I suspect the fact of the matter is that juvie detention centers are full of gangs, gang violence, and that fights, rapes, and other such behavior occurs on a regular basis. High profile inmates tend to get a lot more grief than others, as they are often assigned "targets" by the gangs, who use them for new fish looking to join up. If you are attacked in jail and DON'T fight back, you've effectively branded yourself atybee204 said:Cody has been in the Custody of the State since the murders occurred. I totally agree. I can well imagine that Cody was attacked first. I certainly hope that this kid gets some kind of treatment and rehabilitation for once in his life.BillyGoatGruff said:I suspect the fact of the matter is that juvie detention centers are full of gangs, gang violence, and that fights, rapes, and other such behavior occurs on a regular basis. And did they charge the other as well? Sometimes they just charge everyone involved if they can't figure out if Peter hit Paul or Paul slapped Peter.tybee204 said:Cody Posey was apparently Charged and Prosecuted for battery while in detention for one of his acts of "Self Defense"

If there is any truth to Cody hitting a Guard (which in itself is a felony) and that Cody served 80 days in Solitary because of it that could reflect badly on his defenses claim that he is not violent.
I really think the truth is somewhere in the middle of all this mess.

Believe me they will have all of those records and they will be presented at hearing. Even Beth said Cody had been in several fights. IMO, Cody has some major issues.

I hope so, Ocean. Frankly I'm surprised by those who will do and say anything to excuse his actions. I find it odd that those that support his actions ignore what he did to his step-sister, or find excuses for that murder as well. It's good to know that I am not the only one who questions his behavior and feels that he has major issues. Fortunately, the Judge will not be swayed by theatrics and will render the sentence based on the facts both before, during and after the murders.oceanblueeyes said:No due to him being in jail the Prosecutor would know every infraction and report about Cody Posey from the time he went in there.

I wouldn't call Cody's supporters "giddy". Most people viewing this case have a problem with an absolutist mindset. Demonizing Cody is as pointless as canonizing Marilea. There is soemthing off kilter about expecting a child to somehow save himself AND his family, despite clear evidence Cody being allowed to save himself by running away or trying to get help from the state had repeatedly failed. No matter how you look at it, it's clear that the state and every adult this boy came into contact with FAILED to prevent this from happening. Delbert Paul Posey spent years loading the gun and pointing it at his head, but no one ever saw fit to keep the inevitable from occuring. The kid needs treatment, he needs to be locked up for a good long while, but not for the rest of his natural life.kathrynr448 said:I think I am beyond surprised and into nauseated...literally. If you read the accounts of Marilea's behavior and treatment of Cody, which was testified to by her friends at school and other ranch hands, as well as the accounts of abusive treatment towards her by her parents (mostly the step-father), you get a rather grim picture of her very likely future.less0305 said:I usually agree with BGG, but I'm not sure we can surmise that Marilea would grow up to marry someone like her step-father and be on CourtTV down the road with abused kids and so on, particularly since Marilea's life and any future she had was taken from her at the age of 13 before she had any chance at an adult life with or without a husband, with or without children. Someone else decided her fate, someone who did not have that right. If Cody were concerned about her future, it would seem that he would have killed the big, mean old step-father to save Marilea a life of abuse and hardship and allowed her to live a better life without her step-father. As it was, he felt it necessary to murder her, and by his own admission, to keep her quiet.
