Why do they keep going to the bench? My DH keeps talking and I haven't been able to listen.

Serna keeps requesting a bench conference each time he objects to Keener's questioning of this witness. She's scoring a few points, but if Serna doesn't shut up, it's all going to be lost on the jury.
Serna' couldn't even remember that McCann tried to demonstrate firing the gun upside down last week. Now he's objecting.

Now he's blaming the newspaper reporter for writing that the experiment of firing the gun upside down last week failed. Saying it didn't. Shut up!

I went back and watched that you tube video and he tried one time on the witness stand for the jury. So Serna is lying. imo

I don't think LC would have had to shove the gun down Tera's throat. Not if she was as drugged as we are led to believe. I think he could have just opened her mouth and put the gun back in her throat before she realized what was going on and pulled that trigger. imo

Why can't the PT team put that idea in the jury's mind.

Keener got the doctor to admit that since TC had been up for 24-36 hours previously, the amount of benedryl in her system would have probably made her very sleepy. So, I totally agree with you....he didn't have to open her mouth and totally gag her, or struggle with her, in order to fire off one round. She may not have even awakened, actually, I hope she never woke up.
I pray the prosecution will find a way to make this point very clear to the jury before they begin deliberations.

I hope they make it crystal clear as well, the position of her hand looks much more like someone who fell asleep with the remote in her hand, esp. given the lack of sleep and taking Nyquil that evening, and I doubt she would have awoken even when LC shoved the gun back as far as he could get it to go.

I can understand why he put it so far back, if the round hits the head it can richot around and cause a lot of damage but not kill a person, the way he did it made sure the bullet would hit the base of her brain and be lethal.

My wonder is this - I think the PT proved she didn't kill herself, I'm not positive they've proven it to the jury that LC did it. He may be the most likely, but I'm not sure if the PT has put the gun in his hand. And with the support he got initially from the APD the crime scene wasn't gone over as anything except a suicide so plenty of murder evidence may have been lost.

Oh - one thing I hope PT brings up also, McCann says she had the gun upside down but this witness said her index finger pointing out was typial of someone who used their index finger to pull a trigger and kill themselves. Which is it, Serna?

I think we all realize, hopefully the jury too, that the crime scene was not investigated as a crime scene. I can't remember now how long afterward when it was that Jones began questioning everything and bringing to light various inconsistencies, plus his knowledge that the magazine in the gun not being seated. So I think, too, that a lot of murder evidence was lost--like the blood in the commode that one of the officers flushed down when he used it. So many unanswered questions.
The extended index finger, I thought, was more proof that she used her thumb to pull the trigger according to the doctor this morning. I may be wrong. I am thinking she fell asleep with the remote in her hand and that's the way her right hand ended up the second she died.
One of my dearest friends, since we were children, had a very sad and horrible incident occur in her life several years ago. Her oldest son had been very depressed and decided to commit suicide. He shot himself in the head but it didn't kill him, he suffered tremendous brain damage and will never be the same. For a few years afterward he was in hospitals and nursing homes and rehab centers....all in vain as all of his doctors and family knew there was nothing that could help him. I am so glad, if this situation with TC and LC had to happen, at least she died and didn't end up like my friend's son. I think that type of living hell would have been much harder on her parents and her children in the long run.

I have been thinking about Detective Aaron Jones' testimony and I wish the prosecution would have waited closer to the end of the trial to put him on. Or perhaps had him on twice, once at the beginning and once nearer the end of their case in chief. His testimony seems so darn long ago now and I don't want the jury forgetting any part of it since he was instrumental in this entire murder trial.

Well that is one big piece but also a big piece to me is whether or not the jury believes that the gun chamber or whatever you call it was seated or unseated IMO. The jury has to put many different pieces together to paint the big picture of what happened and in the context of how and when it occurred. IMO

I have been thinking about Detective Aaron Jones' testimony and I wish the prosecution would have waited closer to the end of the trial to put him on. Or perhaps had him on twice, once at the beginning and once nearer the end of their case in chief. His testimony seems so darn long ago now and I don't want the jury forgetting any part of it since he was instrumental in this entire murder trial.

I hope he's one of the rebuttal witnesses, I'm sure the PT can find plenty to have him rebut.

In other testimony I believe it was said Tylenol PM. Benedryl by its generic name is the common sleep ingredient in most over the counter sleep aids. I don't know of course but 2 tylenol PM's knock me out and a surgeon I have worked with when his patients come in and ask for Ambien he suggests they try Tylenol PM first. If you don't take it on a regular like every night for months and months basis that stuff really can knock you out... it does for me... on an airplane or a strange hotel where I can't sleep I really appreciate the Benedryl ingredient.

Ok, I thought the judge said be ready to start again at 1 or 1:15. It's almost 1:30 now their time and I had a black screen, then it went to the colored bars with a high pitched sound.

I'm sorry if I confused you NCE, I don't think she was mixing anything, the two main ingredients in Nyquil are Benadryl (an antihistimine) and diphenhydramine (cough suppressant) and probably tylenol or something for ache relief, I don't take Nyquil because the few time I did it made the funny bone area of my elbows feel funny, and not in a good way.

But with her having gone more than 24 hours without sleep, having a cold or the flu and taking Nyquil, I'll bet she was out like a light.

LC wants the evening to decide if he wants to take the stand. Will be in the morning when he testifies or serna rests.
