Cassie Smith appears in court, Joshua Oxford is a no show

LAS VEGAS - Cassie Smith, the mother of 3-year-old Daniel Theriot appeared in a Las Vegas courtroom Friday morning to be arraigned on the charge of murdering her son.

Her boyfriend, Joshua Oxford was did not show up at court although he was scheduled to appear. He is also facing a murder charge.

Oxford's attorney said he didn't feel well and that was why he didn't appear.

He is now scheduled to be arraigned on the murder charge on Monday morning.

A man charged with murder in the death of a 3-year-old boy refused to appear in court Friday.

Las Vegas Justice of the Peace Melanie Tobiasson ordered 40-year-old Joshua Oxford to be brought to court next week “by any means necessary.”

Deputy Public Defender Scott Coffee, who represents Oxford, suggested that his client did not leave the jail for court Friday morning because of media attention on the case.

After the hearing, Coffee said he met with Oxford, who reported not feeling well and that he was “overwhelmed by the entire situation, including the media.”

Can you believe this! Overwhelmed! They should have dragged him in there!

I often feel like our court system and prison system is too humane.

Even if this guy gets the death penalty, he will whine about the "inhumanity" of it all, and his "cruel and unusual" punishment.

The defense attorney for Oxford sought a bail of $5,000 far less than what was sought by the prosecutor....

They are currently facing child abuse charges for Daniel's younger brother. They will also face additional charges for Daniel...

9/7/18 Update: Smith was in court for her arraignment. Oxford a no show; said he didn’t feel well. Judge ordered him to appear on Monday, 9/10. Smith returns for Prelim hearing on 9/20.

have been following this case and found details on the 2013 arrest that's been referenced a few times... Charleston is a major seven-lane E/W thoroughfare here in Vegas.

"Oxford pleaded guilty in 2013 to child neglect or endangerment... his 4-year-old son left Oxford’s home and was wandering into the middle of Charleston Boulevard while Oxford was “inside of the apartment completely unresponsive” due to drugs."

Smith and Oxford said they had been dating for a year or two, off and on. They had lived in Las Vegas for two to four weeks in a studio apartment with Smith's two young children. They both said Daniel "had a bad attitude and had been disrespectful' to them, the report noted.
Smith said Oxford "lost it" and spanked Daniel over and over again. After he didn't listen, he poured water on him. When that didn't work, he heated water on a stove and poured that on the boy, Smith said to police. He said 'ow' and Smith watched and did nothing.

Oxford said he had smacked Daniel in the head with an open hand several times that day. He and Smith left to run errands, while Oxford's mother watched the kids. When they returned, Daniel was 'asleep,' so they left him alone, the report said.

Smith said she found Daniel dead on the floor. She said Oxford put his body in a plastic tub, and they then drove out to a secluded desert area near Sunrise Mountain where Oxford dumped Daniel's body into a white box found out in the desert, according to the report.

So Smith is claiming that Daniel only said "Ow" when boiling water was poured on him?!?!? I don't from the depths of what hell these people come from, but send them back immediately!

The Clark County Coroner's Office said Daniel Theriot had several scrapes and bruises, blunt force injuries, broken ribs and a brain bleed. The victim's name was redacted from court records, but Daniel Theriot had previously been identified as the victim by family and the Clark County Coroner's Office.

Smith described her 3-year-old son to police as having a bad attitude, and as being disrespectful toward her and Oxford lately, so Oxford spanked him over and over again.

However, according to what Smith told Metro Police, Daniel still wouldn’t listen, so Oxford turned to water to punish the child.

The report said Oxford poured water on the 3-year-old, but he still wouldn’t listen, so Oxford heated up the water on the stove before once again pouring it on the child.

The child cried out “ow,” and asked for his mother, who was watching everything as it happened, the report said.

At one point, Oxford’s mother, Kathy Evans, who was also in the house came out and told her son to stop, but then she fell asleep, the arrest report said.

Wait... his mother was in the house, knew little Daniel was being abused, and instead of doing ANYTHING to help him, she tells Oxford to stop and goes to sleep? After someone is beating a child and pouring hot water on them???

Three adults that shouldn't be allowed to take their next breath!

And blaming this on a THREE YEAR OLD?!?! Saying he wouldn't listen....and yet...he still wanted his Mommy...and she refused him.

The arrest report said, Smith told officers that she has seen Oxford spank her son, smack him across the face or pinch his ears in the past, she's never seen it escalate the way it did the night of Daniel's death.

Oxford has not admitted to causing the child's death, but the report said he did tell police that he had to put Daniel in the corner that day, pull him up by the arm and smack him in the head several times with an open hand because he kept looking at Oxford "with attitude."

Oxford then went on to tell police that he and Cassie left the home while his mother watched the kids, and when they returned Daniel was sleeping, so they didn't bother him. The report said Oxford told officers, however, when they woke up the next morning he thought he heard the child moving around, but later that morning they discovered he was dead.
