Serious question for legal minds here. In reality, is a death sentence any different that a LWOP sentence in a state that has not executed anyone since 2006? To my knowledge, there is not an official moratorium on carrying out death sentences, as there is in my state, but it does not seem likely, imo, that the state will exercise their right again. Other than the remote possibility of being put to death, are there any other differences between the two? JMO

not a legal mind but I do believe death row inmates live much more solitary sentences, with an hour out of their cell each day whereas LWOP inmates would have more freedom to interact with other inmates and do more in prison.

What might have been more helpful than a police investigation, was if she'd gone to social media, the local media, etc, warning women about the risks of being followed in your vehicle by men, and please be safe, ie lock your doors.

Not saying she's to blame for not doing that, or that she needed to target the compact car guy directly, but a head's up reminder is always helpful for younger women.

JMO
IMHO, that is not the victim's job. She filed a police report with video evidence. It is the police's job to investigate. Why should a victim have to create a media campaign warning the public that the police aren't investigating or solving these crimes?

I'd rather give men the "head's up" to keep their hands to themselves. Women don't need reminders.
But I totally get what you are saying. We have to protect our own.

Not sure if this is old news but Naomi's dad Herve posted photos of where she was found on his FB:(:(:(

It's absolutely crazy they were able to find her.

Inhuman how someone could do that to another person and try to subject her loved ones to a lifetime of further suffering not knowing what happened to her. The photos of the "burial" location are extra heartbreaking, so cold and remote. Amazing and fortunate they found her and caught him. His using a gun and his attempts not only to hide her but also to destroy evidence by disposing of his tires should cinch first degree murder and life behind bars or worse. So sad that justice is all that can be had, but short of prevention or saving her, justice is still a precious thing. Heart goes out to her family.

So he likely threatened her with a gun when her entered her car? Some were speculating it could have been a taser.

He could have had both. Taser for immediate take over. Gun for compliance later. And death.

Tragic for her family.

From the article: "The Churchill County Sheriff's Office said Tuesday afternoon Irion died from gunshot wounds to the head and chest."

It was previously reported that the COD wasn't apparent.

I guess there's no point in asking how this ex-con with numerous firearms offenses got a gun.

The "new tires on his truck" line really stuck out to me...I don't know why...but it would also make sense why there were so many arguing about the tires on the truck not looking the same as the CCTV photo.

Or did he drive out to where he buried her body, and was worried about tire tracks? Or worried about dirt/vegetation that would indicate where he had been?

Noteworthy is that the amended criminal complaint specifically states that he disposed of his "tires", as opposed to rims or wheels. So he wanted to destroy evidence matching tire tracks near the gravesite, not just disguise his truck from being identified. I think that is strong evidence that he drove her to the gravesite in his truck not in her car. Though it remains a mystery why his truck was photographed near where he left her car in the afternoon. Perhaps he had her and her car for the full day (or two) before returning for his truck.

I thought that what was previously reported was that they knew the cause of death, but weren’t going to release it immediately.

ICKEdMeL (approved) reads the amended criminal complaint. Nothing new but it’s nice for someone to read it to me. 8 min length

That's what I recall as well

...which logically probably means she was either still alive on that afternoon or he was driving around with her body in her car for maybe 12 hours or more. If so then faster action might have located her car with him in it and her either alive or not. ...just pointing out that fast action matters, not jumping to conclusions critical of LE.

If I recall, LE didn't say COD wasn't apparent. Her brother said something to that effect. LE was withholding the details at the time, possibly from Casey too.
