Nicole Addimando released from jail on $600,000 bond

"After posting a $600,000 bond, Nicole Addimando has been released on electronic monitoring to await her murder trial.

Addimando, 30, is accused of shooting and killing 30-year-old Christopher Grover in September 2017. The couple lived with their two children in a Town of Poughkeepsie apartment.

She pleaded not guilty to charges of second-degree murder, first-degree manslaughter, second-degree manslaughter, and second-degree criminal possession of a weapon.

Addimando's supporters and former attorneys say she was abused by Grover....

Decisions on the hearing and other pending motions are expected at her next scheduled court appearance on Jan. 4...."

Testimony was also heard from Marino, retired Town of Poughkeepise police Detective Chris Hamel, and Town of Poughkeepsie police Detective Darrell Honkala.

Honkala interviewed Addimando at the police station, after she spoke with Sisilli.

And Hamel was still on the job in October 2011, when he got a call from a friend of his, a now-retired City of Poughkeepsie police officer, about a possible sexual assault.

The city officer said “he had a person that needed to speak to someone in reference to alleged abuse," Hamel testified. "He said issues had been happening... for almost two years."

The person was Addimando, who was sexually involved with the city police officer, according to discussion that took place in court.

The abuse had allegedly been going on for two years in 2011 and Addimando was at that time sexually involved with a police officer. When did CG and NA meet and have they been together ever since they first met? Did either of them have some one on the side at the time of this crime? Could that have been the start of this fight? I keep thinking about the poor kids and how they are affected by everything that has and is happening in their family.

Jury can hear Nicole Addimando's statements to police: judge


A jury can hear statements Nicole Addimando made to police after Christopher Grover was shot and killed.

Dutchess County Court Judge Edward McLoughlin ruled that Addimando's statements, which prosecutors have called a "full confession," were voluntary and legally obtained.

Meanwhile, the judge denied prosecutors' request to show evidence of Addimando's alleged "uncharged criminal activity or prior bad acts" during a trial, according to the decisions.

But that could change if Addimando goes with an affirmative defense — one in which a defendant admits to breaking the law for a justified reason — such as self-defense.

Since her arrest, Addimando has primarily been awaiting trial in the jail, but she recently posted a $600,000 bond and was released on electronic monitoring. She is scheduled to appear in court Friday, and jury selection is set to start in late January.

Nicole Addimando murder trial to start in March

Nicole Addimando's murder trial will start in mid-March, after prosecutors and defense attorneys were unable to agree on a plea bargain.

Her trial is set to start with jury selection March 13 — a date that "is certain," said Dutchess County Court Judge Edward McLoughlin, at a Friday appearance.

Both sides proposed and rejected the other's offer of a plea deal, the judge said. It's not clear what were the terms of either proposal.

Nicole Addimando murder trial: Jury selection to start; nurse, midwife testimony ruled out

"Jury selection for Nicole Addimando's murder trial is set to start Wednesday in Dutchess County Court.

However, jurors selected will not hear testimony from two forensic nurses or a midwife who examined the Town of Poughkeepsie woman.

That's according to a ruling from Dutchess County Court Judge Edward McLoughlin....

Addimando, her supporters and previous attorneys have alleged that she was abused by Grover, according to court discussion and records.

Addimando was examined by SAFE (Sexual Assault Forensic Examiner) nurses on Sept. 6 and Sept. 9 in 2014, and a midwife in August 2018, according to the ruling, issued in late January.

Reports of each exam contain information, apparently provided by Addimando, "as to how the observable injuries occurred," McLoughlin wrote.

Putnam County Assistant District Attorney Chana Krauss, whose office is handling the case as special prosecutor, filed a motion to stop the defense from using testimony or reports from the three medical personnel, arguing that it's inadmissible evidence.

Prosecutors also asked that defense attorneys be prohibited from referencing it during jury selection, opening and closing statements and while questioning the people's witnesses.

Addimando's team argued that the testimony and medical reports prepared are relevant and admissible, and that precluding them would restrict Addimando's constitutional right to present a defense.

The rule against using "hearsay" evidence is to prevent out-of-court, second-hand statements from being used during trial, according to numerous rulings. ..

Whether Addimando shot Grover is not in question, the judge has said. Rather, her attorneys have "proposed a psychiatric defense that they believe relieves the defendant of responsibility.""
